�JKH:3 -8 -67 AN ORDINANCE CLOSING ONE -HALF OF A CFO -FOOT ROAD DEDICATED BYMAP OR PLAT STYLED FLOUR BLUFF AND ENCINAL FARM AN) GARDEN TRACTS, ADJACENT TO THE COMMON BOUNDARY BETWEEN LOT 244, SECTION 13, AND LOT 17, SECTION 18, OF SAID SUBDIVISION, SAID ONE -HALF OF SAID ROADWAY SOUGHT TO BE CLOSED HEREIN BEING LOCATED ALL ON LOT 244, AND BEING MORE FULLY DESCRIBED HEREINAFTER; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CON- CERNING THE CLOSING OF A PORTION OF A 440 —FOOT ROADWAY DEDICATED BY MAP OR PLAT STYLED FLOUR BLUFF AND E'N•CINAL FARM AND GARDEN TRACTS, RECORDED IN VOLUME "A ", PAGES 141 THROUGH 443, MAP RECORDS, NUECES COUNTY, TEXAS, SAID ONE—HALF OF THE ROADWAY BEING ADJACENT TO THE COMMON BOUNDARY BETWEEN LOT 24 AND LOT 17, OF SECTION 18, OF SAID SUBDIVISION, WAS GIVEN BY PUBLICA- TION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID PORTION OF SAID 40 —FOOT ROADWAY AND WITHIN 1450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS A as HELD AT REGULAR COUNCIL MEETING BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, ON MARCH 8, 1967, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING THAT THE PORTION OF THE HEREINAFTER DESCRIBED ROADWAY PROPOSED TO BE ABANDONED IS NOT NEEDED NOW, NOR WILL IT BE WITHIN THE FORESEEABLE FUTURE NEEDED AS A PUBLIC STREET; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE et CITY TO ABANDON THE PORTION OF THE ROADWAY HEREINAFTER DESCRIBED AS A PUBLIC STREET SO THAT THE SAME MAY BE USED FOR OTHER PURPOSES BY THE ABUTTING PROPERTY OWNERS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT PORTION OF THE 440 —FOOT ROAD DEDICATED BY MAP OR PLAT STYLED FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, RECORDED IN VOLUME "A °, PAGES 441 THROUGH 143, MAP RECORDS, NUECES COUNTY, TEXAS, MORE FULLY DESCRIBED HEREINAFTER, BE AND THE SAME IS HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY: IQ r t A 20 -FOOT WIDE TRACT OF LAND OFF OF THE SOUTHEAST SIDE OF LOT 24, SECTION 13, FLOUR BLUFF AND 'EINCINAL FARM AND 4 GARDEN TRACTS; PLAT RECORDED IN VOLUME , PAGE 42, NUECES CO'U'NTY MAP RECORDS, NUECES COUNTY, TEXAS (BEING ONE -HALF OF A 40 -FOOT DEDICATED BUT UNDEVELOPED STREET) AND IS MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING AT A POINT IN THE SOUTHEAST LINE OF LOT 24, SECTION 13 OF SAID FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, SAID POINT BEARS S. 29° w. 65.0 FEET FROM THE EAST CORNER OF SAID LOT 24; THENCE S. 29° W. 1255.0 FEET WITH THE SOUTHEAST LINE OF SAID LOT 24 TO THE SOUTH CORNER OF SAID LOT 24, SAME BEING THE NORTH CORNER OF LOT 32, SECTION 13, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; THENCIE� N. 61° W. 20.0 FEET WITH THE COMMON LINE BETWEEN LOT 24 AND LOT 25, SECTION 13, TO THE WEST CORNER OF THE HEREIN DESCRIBED TRACT; THENCE N. 29' E. 1255.0 FEET ALONG A LINE 20.011 FEET NORTHWEST OF AND PARALLEL TO THE SOUTHEAST LINE OF LOT 24 TO A POINT IN THE SOUTHWEST LINE OO1F� A CITY OF CORPUS CHRISTI TRACT (RECORDED IN VOLUME 1064, PAGE 333, NUECES COUNTY DEED RECORDS) FOR CORNER; THENCE S. 61° E. 20.0 FEET WITH THE SOUTHWEST LINE OF SAID CITY OF CORPUS CHRISTI TRACT TO THE PLACE OF BEGINNING. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE SAID PORTION OF SAID ROAD CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE T HIT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 16�`_DAY OF MARCH, 1967.
