HomeMy WebLinkAbout08398 ORD - 03/29/1967• VMP:3 /30167 AN ORDINANCE CLOSING THE 1100 BLOCK OF NEAL STREET AND A 20 -FOOT ALLEY BETWEEN LOTS 10 AND 12, AMID LOTS 9 AND 11, BLOCK 66, AND BETWEEN LOTS 1 AND 3, AND 2 AND 4, BLOCK 67, BROOKLYN ADDITION, LOCATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE RETENTION BY THE CITY OF AN EXISTING SEWER EASE- MENT IN NEAL STREET; AM DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CONCERNING THE CLOSING OF A PORTION OF NEAL STREET, BEING THE 1100 BLOCK THEREOF, AND A 20 -FOOT ALLEY BETWEEN LOTS 10 AND 12, AND LOTS 9 AND 11, BLOCK 66, AND BETWEEN LOTS 1 AND 3, AND 2 AND 4, BLOCK 67, BROOKLYN ADDITION, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID PORTION OF NEAL STREET AND THE ALLEY HEREINABOVE DESCRIBED, AND WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR COUNCIL MEETING BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, ON MARCH 22, 19671 IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING THAT THE PORTION OF NEAL STREET AND THE 20 -FOOT ALLEY PROPOSED TO BE ABANDONED 15 NOT NEEDED NOW, NOR WILL IT BE WITHIN THE FORESEEABLE FUTURE NEEDED FOR PUBLIC PURPOSES; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS THE CITY'S ADVANTAGE TO ABANDON THE HEREINABOVE DESCRIBED 20 -FOOT ALLEY AND THE PORTION OF NEAL STREET AS A PUBLIC WAY SO THAT THE SAME MAY BE USED FOR OTHER PURPOSES BY THE ABUTTING PROPERTY OWNERS; HOWEVER, THERE IS HEREBY RETAINED AN EXISTING UTILITY EASEMENT IN NEAL STREET: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT PORTION OF NEAL STREET, DESCRIBED AS THE 400 BLOCK THEREOF, BE AND THE SAME IS HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY; SUBJECT, HOWEVER, TO RETENTION BY THE CITY OF THE EXISTING SEWER EASEMENT IN NEAL STREET. THERE IS HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY THE 20 -FOOT ALLEY BETWEEN LOTS 10 AND 12, AND LOTS 9 AND 11, BLOCK 66, AND BETWEEN LOTS 1 AND 3, AND 2 AND 4, BLOCK 67, BROOKLYN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. f ,5 ff I• • SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE SAID PORTION OF SAID STREET AND THE ALLEY HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IM- PERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT ��F77ROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE CR91L.DAY OF MARCH, 1967.
