AN ORDINANCE
CLOSING THE PUBLIC HEARING ON IMPROVEMENTS OF AIRLINE
ROAD FROM SOUTH PADRE ISLAND DRIVE TO ALAMEDA STREET,
AND FINDING AND DETERMINING THAT PROPERTY ABUTTING SAID
STREETS WILL BE SPECIFICALLY BENEFITTED AND ENHANCED IN
VALUE IN EXCESS OF COST OF THE IMPROVEMENTS, AND LEVYING
AN ASSESSMENT FOR PAYMENT; FIXING A CHARGE AND LIEN, PRO-
VIDING FOR ASSIGNABLE CERTIFICATES, THE MANNER AND TIME
OF PAYMENT AND COLLECTION; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS, BY DULY
ENACTED ORDINANCE PASSED AND APPROVED ON FEBRUARY 22, 1967, DETERMINED
THE NECESSITY FOR, AND ORDERED THE IMPROVEMENT OF AIRLINE ROAD, FROM SOUTH-
PADRE ISLAND DRIVE TO ALAMEDA STREET, IN THE MANNER AND ACCORDING TO THE
PLANS AND SPECIFICATIONS HERETOFORE APPROVED AND ADOPTED BY THE CITY COUNCIL
BY ORDINANCE DATED FEBRUARY 22, 1967; A DULY EXECUTED NOTICE OF SAID ORDI-
NANCE HAVING BEEN FILED IN THE NAME OF SAID CITY WITH THE COUNTY CLERK OF
NUECES COUNTY, TEXAS; AND
WHEREAS, SAID CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
AFTER HAVING ADVERTISED FOR AND RECEIVED BIDS ON THE CONSTRUCTION OF SAID
IMPROVEMENTS FOR THE LENGTH OF TIME AND IN THE MANNER AND FORM AS REQUIRED
BY THE CHARTER OF SAID CITY AND THE LAWS OF THE STATE OF TEXAS, AND AFTER
HAVING DULY AND REGULARLY MADE APPROPRIATION OF FUNDS AVAILABLE FOR SUCH
PURPOSE TO COVER THE ESTIMATED COST OF SAID IMPROVEMENTS TO SAID CITY, ALL
AS PROVIDED BY THE CORPUS CHRISTI CITY CHARTER AND BY LAW, DID AWARD A CON-
TRACT FOR THE CONSTRUCTION OF SAID IMPROVEMENTS TO HELDENFELS BROTHERS ON
THEIR LOWEST AND MOST ADVANTAGEOUS BID AND SAID CONTRACT HAS BEEN HERETOFORE
DULY EXECUTED BY SAID CITY OF CORPUS CHRISTI AND HELDENFELS BROTHERS AND
IS DATED FEBRUARY 1, 1967, AND THE PERFORMANCE BOND REQUIRED BY SAID CON-
TRACT HAS BEEN PROPERLY FURNISHED BY SAID HELDENFELS BROTHERS AND ACCEPTED
BY THE SAID CITY COUNCIL OF SAID CITY AS TO FORM AND AMOUNT AS REQUIRED BY
THE CHARTER OF SAID CITY AND THE LAWS OF THE STATE OF TEXAS; AND
WHEREAS, THE SAID CITY COUNCIL HAS CAUSED THE DIRECTOR OF PUBLIC
WORKS TO PREPARE AND FILE ESTIMATES OF THE COST OF SUCH IMPROVEMENTS AND
ESTIMATES OF THE AMOUNT PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE

PROPERTY ABUTTING UPON A PORTION OF AIRLINE ROADS WITHIN THE LIMITS HEREIN
DEFINED TO BE IMPROVED AND THE REAL AND TRUE OWNERS THEREOF AND SAID
DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATE-
MENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCILS AND SAME HAS
BEEN RECEIVED, EXAMINED AND APPROVED BY SAID CITY COUNCIL; AND
WHEREAS, SAID CITY COUNCILS BY DULY ENACTED ORDINANCE DATED
FEBRUARY 22, 1967, DID DETERMINE THE NECESSITY OF LEVYING AN ASSESSMENT FOR
THAT PORTION OF THE COST OF CONSTRUCTING SAID IMPROVEMENTS ON THE ABOVE NAMED
STREETS WITHIN THE LIMITS HEREIN DEFINEDj TO BE PAID BY THE ABUTTING PROPERTY
AND THE REAL AND TRUE OWNERS THEREOF AND DID ORDER AND SET A HEARING TO BE
HELD AT 3:00 O'CLOCK P.M. ON APRIL 12, 1967, IN THE COUNCIL CHAMBER OF THE
CITY HALL OF CORPUS CHRISTIO TEXAS FOR THE REAL AND TRUE OWNERS OF THE PRO-
PERTY ABUTTING UPON SAID STREETS WITHIN THE LIMITS ABOVE DEFINED AND FOR
ALL OTHERS OWNING OR CLAIMING ANY INTEREST IN, OR OTHERWISE INTERESTED IN
SAID PROPERTY, OR ANY OF SAID MATTERS AS TO THE ASSESSMENTS AND AMOUNTS TO
BE ASSESSED AGAINST EACH PARCEL OF ABUTTING PROPERTY AND THE REAL AND TRUE
OWNER OR OWNERS THEREOF AND AS TO THE SPECIAL BENEFITS TO ACCRUE TO SAID
ABUTTING PROPERTY BY VIRTUE OF SAID IMPROVEMENTS, IF ANY, OR CONCERNING
ANY ERROR, INVALIDITY IRREGULARITY OR DEFICIENCY IN ANY PROCEEDINGSy OR
CONTRACTS TO APPEAR AND BE HEARD IN PERSON OR BY COUNSEL AND OFFICER EVIDENCE

WHEREAS, SAID CITY COUNCIL DID FURTHER ORDER AND DIRECT SAID CITY
SECRETARY, IN ADDITION TO SAID PUBLISHED NOTICE AS AFORESAID, WHICH WAS
PROVIDED TO BE VALID AND SUFFICIENT IN ITSELF, TO KEEP ON FILE A COPY OF
SAID DIRECTOR OF PUBLIC WORKS' REPORT, AND INCLUDE THEREIN THE LIST OF

SETTING UBLIC HEARING BEFORE THE CITY COUNCIL AT THE SP AL MEETING OF THE
CITY COUNC T 7:30 p.m., APRIL 24, 1967, IN THE COUNCIL AMBER IN THE CITY HALL
ON THE MATTER OFESTABLISHING A BUILDING LINE FOR T PROTECTION, IMPROVEMENT
AND WIDENING OF 06 AN DRIVE, ON THE EASTERN SI THEREOF, INCLUDING ALL THE
AREA BETWEEN THE PRESE ASTERN BOUNDARY LI OF THE RIGHT OF WAY OF OCEAN
DRIVE AND THE SHORE OF CO S CHRISTI BAY ENDING FROM THE SOUTH RIGHT OF
WAY LINE OF LOUISIANA STREET ITS E SION TO THE EASTWARD SHORELINE

AND DECLARING AN EMERGENCY.
The Charter rule was su ended and the foregoi resolution was passed by the following
vote: Blackmon, Sizemo ,Bradley, Lozano, McDaniel, and Ji ez present and voting "Aye ".
Grant absent.
ayor Blackmon announced the meeting would recess for about 30 minutes, ending the
set for the scheduled public hearing on assessments for Airline Road Improvement.
Mayor Blackmon reconvened the meeting at 3:00 p.m., directed that it be noted that a
quorum was present, and announced the Council would now hold a public hearing on assessments
for the proposed street improvements for Airline Road from South Padre Island Drive to South Alameda
Street; explained that each member of the Council had been presented with a Preliminary Assessment
Roll; and that Tom McDowell, Assistant City Attorney, would conduct the public hearing.
Assistant City Attorney McDowell explained the purpose of the public hearing to establish
whether or not each individual property would be specially benefitted, and explained that the
Staff would offer testimony from the City Engineer and evaluation testimony from a real estate
appraiser to substantiate the assessments which appear on the Corrected Preliminary Assessment Roll,
and that the hearing was to form a basis on which the Council, acting as a legislative body, would
determine or establish the assessments on the abutting properties.
Mr. James K. Lantos, City Engineer, stated that he was a qualified, registered professional
engineer; that he was thoroughly familiar with the Plans and Specifications of the proposed Improve-
ments which were prepared by the Engineering Firm of Lockwood, Andrews and Newnam, Consulting
Engineers, and that he had reviewed and thoroughly familiarized himself with these plans; testified
to the nature, extent and specifications of the proposed improvements; stated that the total bid
contract price is $412,736.71; total property owners assessment is $137,005.88, and total cost to

the City is $275,730.83; also as to the manner in which such pro rata share was computed; and
explained that the improvements included a portion of Gollihar Road and McArdle Road at these
intersections. Mr. Lantos stated that Airline Road and the section of Gollihar Road to be improved
shall be excavated to a width and depth to permit construction of a minimum 6" compacted lime
stablized sub -base, 11" compacted caliche base and 2" hot -mix asphaltic concrete surface pave-
ments to a width of 67' back to back of curb; that the portion of McArdle to be improved shall
have the some specified sub -base, base, and pavement surface except to a width of 45' back to
back of curb; that all streets shall have a 5' wide, 4" thick sidewalk tied to back of curb, concrete
driveways where specified on plans; that all utilities, water lines, storm sewers, and appurtenances
necessary to this project shall be included in the contract bid price; that credit has been given for
all existing improvements in place and meeting requirements, or that have been previously assessed
against the abutting property owner; and stated that the assessment rates for this project have been
calculated according to the unit bid prices applied to the front foot of each property.
Interested property owners in the audience were given the opportunity to question Mr. "
Lantos for clarification of calculations basedon the size of the respective lots, credit given existing
improvements, and varied costs, after which the following persons appeared: Mr. Guy Winstead,
Mr. Fred R. Sanders, Charles Bonniwel1, Mrs. Vennie Mae Peck, Mr. Bill Warren, Mr. Alfred Hesse,
and Mr. J. L. Portman.
Mr. Harold A. Carr, Real Estate Broker, testified as to his background and experience
which he felt qualified him as a real estate appraiser for all types of properties iw this City; and
testified that he had personally viewed and understood the extent and specifications of the proposed
improvements.
Mr. Carr presented colored slides of Airline Road, beginning at South Padre Island Drive
all the way to South Alameda Street, to more clearly describe the condition of the area and the
need for the proposed improvements. The pictures made visible, deep ditches on either side of
Airline Road, in most instances, filled with water and trash; broken and rough shoulders on the
pavement along most of the thoroughfare; foot paths on banks of ditches made by children attending
Fraser School; showed the enterance to Fraser School in very bad condition, and generally, the

entire length of Airline Road from South Padre Island Drive to Alameda, in need of the proposed
improvements. Mr.Carralsoexhibited colored slide pictures of the recently improved South Staples
Street, depicting the benefit of the improvements in comparison and paral led to that of the subject
property.
Mr. Carr stated that he had personally viewed within the past week the Preliminary
Assessment Roll and that, based on his detailed and careful examination of each and every piece of
property, in his opinion, each of the properties so assessed would be enhanced in value at least to
the extent of the proposed assessments with the following exception:
Item 040, Guy Winstead, reduce assessment from $5,246.01 to $3,830, reduction based
on the formula applied to triangular shaped lots.
Mr. Joe Pierce, Paving Coordinator of the City Staff, stated that he was in agreement
with the opinion of Mr. Carr that the assessment on Item 40, Guy Winstead, appearing on the
Assessment Roll as $5,246.01, should be reduced to $3,830 based on the irregular shape of his
property.
Mayor Blackmon stated that he would call the names of the property owners as they are
listed on the Assessment Roll, and invited each property owner to state his approval or objection to
any of the proposed improvements or assessments to his property. The following persons appeared:
Item 03, Texaco, Inc. - Mr. J. L. Pace appeared and stated that he did not object to
the paving project, but stated that he noted that the rate of $13.56 appearing on the Assessment
Roll on Item 03, based on 80 percent of one -half of the 67 -foot street, was the same as Items # 85,
86 and 87 which were calculated on the basis of 80 percent of one -half of the 47 -foot street.
Mr. Lontos advised Mr. Pace that the figures on Items 085, 86 and 87 were in error and
will be rechecked and corrected.
Item #40, Mr. Guy Winstead appeared and protested the amount of the assessments on his
property, stated that "he is giving the City ten feet and paying some $3,000 to have it paved ";
that some of this land is vacant and is of no value, and stated that instead of the reduction to
$3,830 as recommended by Mr. Carr, he feels it should be further reduced to $2,164, and in that
event he would be willing to give the City the ten feet.

Item 044, Mendell Seyrnore & Irvin Gendy - Mr.. Mendell appeared and stated that a fence
had been erected on two sides of this property and that they plan to continue the fence on down
Airline, and asked if the curbs could be dispensed with as there would be no need for them if the
fence is installed.
Mr. Lantos stated that something could be worked out in this connection, and Mayor Blackmon
requested that Mr. Lantos submit a recommendation as to the feasibility of complying with this request.
Item 954, Business Real Estate Company - Mr. J. L. Portman, representing the subject
company, stated that he does not object to the street improvements, but that he feels it is unfair to
be penalized for owning a corner lot; that the improvements on the side street will be of no value to
him since he has no access to it; that he feels the assessment is out of proportion, and stated that he
would be willing to sell this property to the City for the amount of the assessment.
Item 072, Alfred H. Hesse, Jr. - Mr. Hesse stated that he is protesting the assessments on
his property as being unfair and unjust since Airline is completely removed from his use; stated that
the improvements cannot be seen because of existing redwood fence between his property and Airline;
that he had discussed this matter with the FHA and was advised that this improvement would not add a
penny to the value of his property. Mr. Hesse further stated that the sidewalks would be of little
value to anyone in this neighborhood as there are very few children, and that there are no foot paths
on these streets.
Item #73, William L. Harris - Mr. Harris appeared and stated that he is protesting the
improvements for the some reasons as stated by Mr. Hesse.
Item #84, Russell A. Paulsen - Mr. Paulsen appeared and concurred in the remarks made by
Mr. Hesse in connection with Item #72.
Item 069, William S. Minor, III, also protested the improvements for the reasons as stated
by Mr. Hesse.
Item 081, St. Bartholomew's Episcopal Church - Mr. Charles Bonniwell, attorney, appeared
representing the Episcopal Church and stated that they were not making a specific protest against
sidewalks but asked Mr. Carr if he thought there was enough foot traffic to justify the construction of
sidewalks in view of the fact that there are no buildings near.

Mr. Carr stated that in his opinion, the related activities of any church would justify side-
walks; also stated that they are necessary to the general improvement of the area since paving pieces
of property does not tend to improve a neighborhood; and further stated that there is no question as to
the value of sidewalks and that the greater benefits wi II be realized in the future as a result of this
improvement.
Items 982 & 983, Guy 1. Warren and Jack.Modesette, Jr. - Mr. Bill Warren appeared to
represent these properties, and questioned the need for sidewalks from Gollihor to Alameda, but
stated that they are interested in crosswalks from Belmeade to Alameda. Mr. Warren stated that his
clients are not opposed to the improvements in general.
Mr. Winstead stated that he definitely favored the construction of sidewalks as proposed.
No one else appeared in connection with the proposed street improvements.
Mayor Blackmon thanked the property owners for their presence and for the considerate
manner in which they had presented their protests, and explained that communications from property
owners will still be accepted, but that the hearing could be officially closed subject to receipt of
additional information and further investigation.
Motion by McDaniel, seconded by Jimenez and passed that the hearing be closed.
There being no further business to come before the Council, the meeting was adjourned.
THERE BEING NO FURTHER TESTIMONY OFFERED OR ANY FURTHER PARTIES
APPEARING TO BE HEARD, UPON PROPER MOTIONS DULY SECONDED AND UNANIMOUSLY
CARRIED, THE SAID HEARING WAS DECLARED. CLOSED; AND
WHEREAS NO FURTHER PARTIES APPEARING AND NO FURTHER TESTIMONY
BEING OFFERED AS TO THE SPECIAL BENEFITS IN RELATION TO THE ENHANCED VALUE
OF SAID ABUTTING PROPERTY AS COMPARED TO COST OF THE IMPROVEMENTS OF SAID
PORTION OF SAID STREET PROPOSED TO BE ASSESSED AGAINST SAID PROPERTY OR
AS TO ANY ERRORS INVALIDITIES OR IRREGULARITIES, IN THE PROCEEDINGS OR
CONTRACT HERETOFORE HAD IN REFERENCE TO THE PORTIONS OF SAID STREETS TO BE
IMPROVED; AND
WHEREAS, SAID CITY COUNCIL HAS HEARD EVIDENCE AS TO THE SPECIAL
BENEFITS AND ENHANCED VALUE TO ACCRUE TO SAID ABUTTING PROPERTY AND THE
REAL AND TRUE OWNER OR OWNERS THEREOF AS COMPARED WITH THE COST OF MAKING
SAID IMPROVEMENTS ON SAID STREETS WITHIN THE LIMITS ABOVE DEFINED, AND HAS
HEARD ALL PARTIES APPEARING AND OFFERING TESTIMONY, TOGETHER WITH ALL PRO-
TESTS AND OBJECTIONS RELATIVE TO SUCH MATTERS AND AS TO ANY ERRORS, IN-
VALIDITIES OR IRREGULARITIES IN ANY OF THE PROCEEDINGS AND CONTRACT FOR
SAID IMPROVEMENTS AND HAS GIVEN A FULL AND FAIR HEARING TO ALL PARTIES
MAKING OR DESIRING TO MAKE ANY SUCH PROTESTS OBJECTION OR OFFER TESTIMONY
AND HAS FULLY EXAMINED AND CONSIDERED ALL EVIDENCES MATTERS, OBJECTIONS AND
PROTESTS OFFERED AND BASED UPON SAID EVIDENCE, TESTIMONY AND STATEMENTS,
SAID CITY COUNCIL FINDS THAT EACH AND EVERY PARCEL OF PROPERTY ABUTTING
UPON THE PORTION OF AIRLINE ROADS WITHIN THE LIMITS TO BE IMPROVED AS HEREIN
DEFINED, WILL BE ENHANCED IN VALUE AND SPECIALLY BENEFITTED BY THE CONSTRUC-
TION OF SAID IMPROVEMENTS UPON THE SAID STREET UPON WHICH SAID PROPERTY
ABUTS IN AN AMOUNT IN EXCESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENTS
PROPOSED TO BED AND AS HEREINBELOW ASSESSED AGAINST EACH AND EVERY SAID
PARCEL OF ABUTTING PROPERTY1 AND THE REAL AND TRUE OWNERS THEREOF AND SAID
CITY COUNCIL DID CONSIDER AND CORRECT ALL ERRORS INVALIDITIES OR DEFICIEN-
CIES CALLED TO ITS ATTENTION AND DID FIND THAT ALL PROCEEDINGS AND CONTRACTS
WERE PROPER AND IN ACCORDANCE WITH THE CHARTER OF SAID CITY AND THE LAWS OF

ON SAID PORTION OF SAID AIRLINE ROAD, WITHIN THE LIMITS DEFINED, AND THE
REAL AND TRUE OWNER OR OWNERS THEREOF, ARE JUST AND EQUITABLE AND DID ADOPT
THE RULE OF APPORTIONMENT SET OUT BELOW AND THE DIVISION OF THE COST OF SAID
IMPROVEMENTS BETWEEN SAID ABUTTING PROPERTIES, AND THE REAL AND TRUE OWNER
OR OWNERS THEREOF, AS JUST AND EQUITABLE, AND AS PRODUCING SUBSTANTIAL
EQUALITY CONSIDERING THE BENEFITS TO BE RECEIVED AND THE BURDENS IMPOSED
THEREBY, AND THAT ALL OBJECTIONS AND PROTESTS SHOULD BE OVERRULED AND DENIED
EXCEPT THE CORRECTIONS AND CHANGES AS APPEAR ON THE FINAL ASSESSMENT ROLL
INCLUDED IN THIS ORDINANCE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THERE BEING NO FURTHER PROTEST OR TESTIMONY FOR
OR AGAINST SAID IMPROVEMENTS, SAID HEARING GRANTED TO THE REAL AND TRUE
OWNERS OF ABUTTING PROPERTY ON SAID STREET, WITHIN THE LIMITS ABOVE DEFINED,
AND TO ALL PERSONS, FIRMS, CORPORATIONS AND ESTATES, OWNING OR CLAIMING
SAME OR ANY INTEREST THEREIN, BE AND THE SAME IS HEREBY CLOSED AND ALL PRO-
TESTS AND OBJECTIONS, WHETHER SPECIFICALLY MENTIONED OR NOT, SHALL BE, AND
THE SAME ARE HEREBY OVERRULED AND DENIED.
SECTION 2. THAT SAID CITY COUNCIL HEREBY FINDS AND DETERMINES
UPON THE EVIDENCE HEARD IN REFERENCE TO EACH AND EVERY PARCEL OF PROPERTY
ABUTTING UPON AIRLINE ROAD, WITHIN THE LIMITS DEFINED, THAT THE SPECIAL
BENEFITS IN THE ENHANCED VALUE TO ACCRUE TO SAID PROPERTY AND THE REAL AND
TRUE OWNER OR OWNERS THEREOF, BY VIRTUE OF THE CONSTRUCTION OF SAID IMPROVE-
MENTS TO SAID PORTION OF SAID STREET UPON WHICH SAID PROPERTY ABUTS, WILL
BE IN EXCESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENTS AS PROPOSED TO
BE, AND AS HEREIN ASSESSED AGAINST SAID ABUTTING PROPERTY AND THE REAL AND
TRUE OWNERS THEREOF, AND FINDS THAT THE APPORTIONMENT OF THE COST OF SAID

THE SAID CITY COUNCIL.
SECTION 3. THAT IN PURSUANCE OF SAID ORDINANCES DULY ENACTED BY
SAID CITY COUNCILS AUTHORIZING AND ORDERING THE IMPROVEMENTS OF THE ABOVE
DESCRIBED STREETS WITHIN THE LIMITS DEFINED AND IN PURSUANCE OF SAID PRO-
CEEDINGS HERETOFORE HAD AND ENACTED BY SAID CITY COUNCIL IN REFERENCE TO
SAID IMPROVEMENTS AND BY VIRTUE OF THE POWERS VESTED IN SAID CITY WITH
RESPECT TO SAID STREET IMPROVEMENTS BY THE LAWS OF THE STATE OF TEXAS AND
THE CHARTER OF SAID CITY, WITH PARTICULAR REFERENCE TO CHAPTER lO6 OF THE
ACTS OF THE FIRST CALLED SESSION OF THE 40TH LEGISLATURE OF THE STATE OF
TEXASj KNOWN AND SHOWN AS ARTICLE 11058 OF VERNON'S ANNOTATED CIVIL STATUTES
OF TEXAS AS AMENDED THERE SHALL BE, AND IS HEREBY LEVIED, ASSESSED AND
TAXED AGAINST THE RESPECTIVE PARCELS OF PROPERTY ABUTTING UPON SAID PORTION
OF SAID STREETS AND AGAINST THE REAL AND TRUE OWNERS THEREOF, WHETHER SUCH

AIRLINE ROAD IMPROVEMLITS from S. PADRE ISLAND DRIVE TO S. ALAPEDA ST.
Project numbers - 220 -64 -60 and 202 -59 -26 call for the following improvements
to Airline Road, from South Padre Island Drive to South Alameda Street, in-
cluding a portion of Gollihar Road and McArdle Road at these intersections
as shown.
Airline Road and that section of Gollihar Road to be improved shall be ex-
cavated to a width and depth to permit the construction'of a minimum 6"
compacted line stabilized sub -base, 11" compacted caliche base and 2" hot -
mix asphaltic concrete surface pavements to a width of 67' back to back
of curb.
That portion of McArdle to be improved in this project shall have the same
specified sub -base, base, and pavement surface except to a width of 45'
back to back of curb.
All streets shall have a 5' wide, 4 "thick sidewalk tied to back of curb,
concrete driveways where specified on plans, all utilities, water lines,
storm sewers and appurtenances necessary to this project shall be included
in the contract bid price.
Credit has been given for all existing improvements in place and meeting
requirements, or that have been previously assessed against the abutting
property owner.
The assessment rates for this project have been calculated according to the
unit bid price applied to thg _front foot f ach property thus:

SECTION 5. THAT THE SEVERAL SUMS MENTIONED ABOVE IN SECTION 3
HEREOF ASSESSED AGAINST SAID PARCELS OF PROPERTY ABUTTING ON THE PORTION

THEREOF WHETHER NAMED OR CORRECTLY NAMED HEREIN OR NOTE SUBJECT TO THE
PROVISIONS OF SECTION 4 HEREOF. TOGETHER WITH INTEREST THEREON AT THE RATE
OF FIVE PERCENT (5p) PER ANNUM WITH REASONABLE ATTORNEY'S FEE AND ALL COSTS
AND EXPENSES OF COLLECTION, IF INCURRED, ARE HEREBY DECLARED TO BE MADE A
FIRST AND PRIOR LIEN UPON THE RESPECTIVE PARCELS OF PROPERTY AGAINST WHICH

PARAMOUNT LIEN SUPERIOR TO ALL OTHER LIENS CLAIMS OR TITLES EXCEPT FOR
LAWFUL AD VALOREM TAXES; AND THAT THE SAME SO ASSESSED SHALL BE PAYABLE AS
FOLLOWS TO -WIT: SIXTY (60) EQUAL MONTHLY INSTALLMENTS, THE FIRST OF WHICH
WILL BE PAYABLE ON OR BEFORE TWENTY (20) DAYS AFTER THE COMPLETION OF SAID
IMPROVEMENTS TO THE STREETS UPON WHICH THE RESPECTIVE PROPERTY ABUTSp AND
ACCEPTANCE THEREOF BY THE SAID CITY COUNCIL, THE REMAINING INSTALLMENTS TO
BE DUE AND PAYABLE, RESPECTIVELY ONE EACH MONTH BEGINNING SIXTY (6O) DAYS
AFTER THE DATE OF ACCEPTANCES DEFERRED PAYMENTS TO BEAR INTEREST FROM DATE
OF SAID ACCEPTANCE AT THE RATE OF FIVE PERCENT (5 %) PER ANNUM, PAYABLE
MONTHLY CONCURRENTLY WITH EACH OF SAID INSTALLMENTS PAST DUE INSTALLMENTS
OF PRINCIPAL AND INTEREST TO BEAR - INTEREST AT THE SAME RATE PER ANNUM UNTIL
PAID) HOWEVER, PROVIDED THAT ANY OWNER OF SUCH PROPERTY SHALL HAVE THE RIGHT
TO PAY OFF THE ENTIRE SUM OF SUCH ASSESSMENTS OR ANY INSTALLMENT THEREOF
BEFORE MATURITY BY PAYING PRINCIPAL AND ACCRUED INTEREST TO DATE OF SAID
PAYMENT; AND PROVIDED FURTHER, THAT IF DEFAULT SHALL BE MADE IN THE PAY-
MENT OF ANY INSTALLMENT OF PRINCIPAL OR INTEREST WHEN DUES THEN THE ENTIRE
AMOUNT OF SAID ASSESSMENT UPON WHICH SUCH DEFAULT IS MADE, SHALL AT THE
OPTION OF HELDENFELS BROTHERS THEIR SUCCESSORS OR ASSIGNS, BED AND BECOME
IMMEDIATELY DUE AND PAYABLE AND SHALL BE COLLECTIBLE TOGETHER WITH REASON-
ABLE ATTORNEY'S FEES AND ALL COSTS AND EXPENSES OF COLLECTION, IF INCURRED.

SECTION 6. THAT THE CITY OF CORPUS CHRISTI TEXAS SHALL NOT IN
ANY MANNER BE LIABLE FOR THE PAYMENT OF ANY SUMS HEREBY VALIDLY ASSESSED
AGAINST ANY ABUTTING PROPERTY, AND THE REAL AND TRUE OWNER OR OWNERS THEREOF,
BUT HELDENFELS BROTHERS SHALL LOOK SOLELY TO SUCH PROPERTY AND THE REAL AND
TRUE OWNER OR OWNERS THEREOF FOR THE PAYMENT OF THE SUMS VALIDLY ASSESSED
AGAINST SAID RESPECTIVE PARCELS OF PROPERTY BUT SAID CITY SHALL BE OBLIGATED
TO FURNISH HELDENFELS BROTHERS VALID ASSESSMENTS AND ASSESSMENT CERTIFICATES
AND SHALL EXERCISE ALL OF ITS LAWFUL POWERS AND AID IN THE ENFORCEMENT AND
COLLECTION OF SAID LIENS AND ASSESSMENTS; AND IF DEFAULT SHALL BE MADE IN
THE PAYMENT OF ANY OF SAID SUMS HEREIN ASSESSED AGAINST THE SAID PARCELS OF
PROPERTY, AND THE REAL AND TRUE OWNER OR OWNERS THEREOF COLLECTION THERE-
OF SHALL BE ENFORCED AT THE OPTION OF HELDENFELS BROTHERS THEIR SUCCESSORS
OR ASSIGNS, EITHER BY SUIT IN ANY COURT HAVING JURISDICTION OR BY SALE OF
THE PROPERTY ASSESSED AS NEARLY AS POSSIBLE IN THE MANNER AS MAY BE PRO-
VIDED BY LAW AND CHARTER IN FORCE IN SAID CITY FOR THE SALE OF PROPERTY
FOR THE COLLECTION OF AD VALOREM TAXES.
SECTION 7. THAT FOR THE PURPOSE OF EVIDENCING SAID ASSESSMENTS,
THE LIENS SECURING SAME AND THE SEVERAL SUMS ASSESSED AGAINST THE SAID PAR-
CELS OF PROPERTY AND THE REAL AND TRUE OWNER OR OWNERS THEREOF AND THE TIME
AND TERMS OF PAYMENT, AND TO AID IN THE ENFORCEMENT THEREOF ASSIGNABLE
CERTIFICATES SHALL BE ISSUED BY THE CITY OF CORPUS CHRISTIj TEXAS TO
HELDENFELS BROTHERS UPON THE COMPLETION OF SAID IMPROVEMENTS IN SAID
STREET AND ACCEPTANCE THEREOF BY SAID CITY COUNCILS WHICH CERTIFICATES
SHALL BE EXECUTED BY THE MAYOR IN THE NAME OF THE CITY ATTESTED BY THE
CITY SECRETARY WITH THE CORPORATE SEAL OF SAID CITY, AND WHICH CERTIFICATES
SHALL DECLARE THE AMOUNTS OF SAID ASSESSMENTS AND THE TIMES AND TERMS THERE -
OFD THE RATE OF INTEREST THEREON THE DATE OF THE COMPLETION AND ACCEPTANCE
OF THE IMPROVEMENTS FOR WHICH THE CERTIFICATE IS ISSUED, AND SHALL CONTAIN
THE NAMES OF THE APPARENT TRUE OWNER OR OWNERS AS ACCURATELY AS POSSIBLE
AND THE DESCRIPTION OF THE PROPERTY ASSESSED BY LOT AND BLOCK NUMBERS OR
FRONT FOOT THEREOF, OR SUCH OTHER DESCRIPTION AS MAY OTHERWISE IDENTIFY
THE SAME AND IF THE SAID PROPERTY SHALL BE OWNED BY AN ESTATE OR FIRM

THEN TO SO STATE THE FACT SHALL BE SUFFICIENT AND NO ERROR OR MISTAKE IN
DESCRIBING SUCH PROPERTY OR IN GIVING THE NAME OF ANY OWNER OR OWNERS OR
OTHERWISE SHALL IN ANYWISE INVALIDATE OR IMPAIR THE ASSESSMENT LEVIED
HEREBY OR THE CERTIFICATE ISSUED IN EVIDENCE THEREOF.
THAT THE SAID CERTIFICATE SHALL FURTHER PROVIDE SUBSTANTIALLY
THAT IF DEFAULT SHALL BE MADE IN THE PAYMENT OF ANY INSTALLMENT OF PRINCIPAL
OR INTEREST WHEN DUE THEN AT THE OPTION OF HELDENFELS BROTHERS THEIR
SUCCESSORS OR ASSIGNS, OR THE HOLDER THEREOF THE WHOLE OF SAID ASSESS-
MENT EVIDENCED THEREBY SHALL AT ONCE BECOME DUE AND PAYABLE AND SHALL BE
COLLECTIBLE WITH REASONABLE ATTORNEYS FEES AND ALL EXPENSES AND COSTS OF
COLLECTION, IF INCURRED2 AND SAID CERTIFICATE SHALL SET FORTH AND EVIDENCE
THE PERSONAL LIABILITY OF THE REAL AND TRUE OWNER OR OWNERS OF SUCH PROPERTY,
WHETHER NAMED OR CORRECTLY NAMED THEREIN OR NOT, AND THE LIEN UPON SUCH PRO-
PERTY, AND THAT SAID LIEN IS FIRST AND PARAMOUNT THEREON, SUPERIOR TO ALL
OTHER LIENS TITLES AND CHARGES EXCEPT FOR LAWFUL AD VALOREM TAXES FROM
AND AFTER THE DATE SAID IMPROVEMENTS WERE ORDERED BY SAID CITY COUNCIL, TO-
WIT: FEBRUARY 22, 1967, AND SHALL PROVIDE IN EFFECT THAT IF DEFAULT SHALL
BE MADE IN THE PAYMENT THEREOF THE SAME MAY BE ENFORCED2 AT THE OPTION OF
HELDENFELS BROTHERS OR THEIR SUCCESSORS AND ASSIGNS, BY THE SALE OR THE
PROPERTY THEREIN DESCRIBED IN THE MANNER PROVIDED FOR THE COLLECTION OF
AD VALOREM TAXES AS ABOVE RECITED OR BY SUIT IN ANY COURT HAVING JURISDICTION.
THAT SAID CERTIFICATES SHALL FURTHER RECITE IN EFFECT THAT ALL THE
PROCEEDINGS WITH REFERENCE TO MAKING SAID IMPROVEMENTS HAVE BEEN REGULARLY
HAD IN COMPLIANCE WITH THE LAW AND CHARTER IN FORCE IN SAID CITY AND THE
PROCEEDINGS OF SAID CITY COUNCIL OF SAID CITY AND THAT ALL PREREQUISITES
TO THE FIXING OF THE ASSESSMENT LIEN AGAINST THE PROPERTY THEREIN DESCRIBED
OR ATTEMPTED TO BE DESCRIBED AND THE PERSONAL LIABILITY OF THE REAL AND
TRUE OWNER OR OWNERS THEREOF, EVIDENCED BY SUCH CER7IFICATES2 HAVE BEEN
REGULARLY DONE AND PERFORMED WHICH RECITALS SHALL BE EVIDENCE OF ALL THE
MATTERS AND FACTS SO RECITED AND NO FURTHER PROOF THEREOF SHALL BE REQUIRED

ENFORCEMENT AND COLLECTION THEREOF AND SAID CERTIFICATES MAY CONTAIN OTHER
AND FURTHER RECITALS, PERTINENT AND APPROPRIATE THERETO. IT SHALL NOT BE
NECESSARY THAT SAID CERTIFICATES SHALL BE IN THE EXACT FORM AS ABOVE SET
FORTH BUT THE SUBSTANCE AND EFFECT THEREOF SHALL SUFFICE.
SECTION 8. THAT ALL SUCH ASSESSMENTS LEVIED ARE A PERSONAL LIA-
BILITY AND CHARGE AGAINST THE REAL AND TRUE OWNER OR OWNERS OF THE PROPERTY
DESCRIBED OR ATTEMPTED TO BE DESCRIBED NOTWITHSTANDING SUCH OWNER OR
OWNERS MAY NOT BE NAMED OR CORRECTLY NAMED AND ANY IRREGULARITY IN THE NAME
OF THE PROPERTY OWNER, OR THE DESCRIPTION OF ANY PROPERTY OR THE AMOUNT OF
ANY ASSESSMENT, OR IN ANY OTHER MATTER OR THING SHALL NOT IN ANYWISE IN-
VALIDATE OR IMPAIR ANY ASSESSMENT LEVIED HEREBY OR ANY CERTIFICATE ISSUED
AND SUCH MISTAKE, OR ERROR, INVALIDITY OR IRREGULARITY WHETHER IN SUCH
ASSESSMENT OR IN THE CERTIFICATE ISSUED IN EVIDENCE THEREOF MAY BE, BUT
IS NOT REQUIRED TO BED TO BE ENFORCEABLE AT ANY TIME CORRECTED BY THE SAID
CITY COUNCIL OF THE CITY OF CORPUS CHRISTI. FURTHER THAT THE OMISSION OF
SAID IMPROVEMENTS IN FRONT OF ANY PART OR PARCEL OF PROPERTY ABUTTING UPON
THE AFOREMENTIONED STREETS, WHICH IS EXEMPT FROM THE LIEN OF SAID ASSESS-
MENT, SHALL IN NO WISE AFFECT OR IMPAIR THEVALIDITY OF ASSESSMENTS AGAINST
THE OTHER PARCELS OF PROPERTY ABUTTING UPON SAID STREET; AND THAT THE TOTAL

CITY COUNCIL RELATIVE TO SAID IMPROVEMENTS AND ASSESSMENTS THEREOF, AND WITH

THE TERMS POWERS AND PROVISIONS OF SAID CHAPTER 1O6 OF THE ACTS OF THE
FIRST - CALLED SESSION OF THE 40TH LEGISLATURE OF THE STATE OF TEXAS, KNOWN
AS ARTICLE 1105B OF VERNON'S ANNOTATED CIVIL STATUTES OF TEXAS AND THE
CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS, UNDER WHICH TERMS, POWERS
AND PROVISIONS SAID PROCEEDINGS, SAID IMPROVEMENTS AND ASSESSMENTS WERE
HAD AND MADE BY SAID CITY COUNCIL.
SECTION 9. THE FACT THAT THE ABOVE DESCRIBED STREET HAS BECOME
AN IMPORTANT THOROUGHFARE AND THE FACT THAT THE PRESENT CONDITION OF SAID
STREET, WITHIN THE LIMITS DEFINED, IS DANGEROUS TOTHE HEALTH AND PUBLIC WEL-
FARE OF THE INHABITANTS THEREOF CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY, REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI-
NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION,
AND THAT SAID ORDINANCE SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY
EXISTS, AND HAVING REQUESTED THAT SAID CHARTER RULE BE SUSPENDED, AND THAT
THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER
ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF

RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
