RUSSELL FARM BLOCKS, ITS WEST LINE BEGINNING AT LOS PALMAS STREET IN THE EAST BOUNDARY LINE OF THE CORPUS CHRISTI IN- DUSTRIAL DISTRICT, OF RECORD IN VOLUME 20, PAGE 1, MAP RECORDS, NUECES COUNTY, TEXAS, AND EXTEND- ING EAST TO THE WEST RIGHT -OF -WAY LINE OF AIRPORT ROAD AS SHOWN ON SKETCH ATTACHED HERETO AND MADE A PART HEREOF, SAID EASEMENT BEING OF RECORD IN VOLUME 774, PAGE 579, NUECES COUNTY, TEXAS, DEED RECORDS; AND DECLARING AN EMERGENCY. WHEREAS, A CERTAIN 10 -FOOT UTILITY EASEMENT EXISTS IN BLOCK 17 OF THE J. C. RUSSELL FARM BLOCKS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY MAP OR PLAT OF RECORD IN VOLUME 20, PAGE 61, MAP RECORDS OF NUECES COUNTY, TEXAS; AND WHEREAS, SAID UTILITY EASEMENT IS NOT NOW USED OR NEEDED BY THE CITY OF CORPUS CHRISTI: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ALL OF THAT CERTAIN 10 -FOOT UTILITY EASEMENT HERETOFORE EXISTING WITHIN BLOCK 17 OF THE J. C. RUSSELL FARM BLOCKS, ITS WEST LINE BEGINNING AT LOS PALMAS STREET IN THE EAST BOUNDARY LINE OF THE CORPUS CHRISTI INDUSTRIAL DISTRICT, OF RECORD IN VOLUME 20, PAGE 611 MAP RECORDS, NUECES COUNTY, TEXAS, AND EXTENDING EAST TO THE WEST RIGHT -OF -WAY LINE OF AIRPORT ROAD AS SHOWN ON SKETCH ATTACHED HERETO AND MADE A PART HEREOF, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BE AND THE SAME IS HEREBY ABANDONED AND RELEASED AND RELINQUISHED BY THE CITY OF CORPUS CHRISTI UNTO THE PRESENT OWNER OF SAID PROPERTY. SECTION 2. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE EASEMENT HERETOFORE EXISTING AND ABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST, AND HAVING 8442 • REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 11 DAY OF MAY, 1967. Bo*. 1622 Corpus Christi, Texas Dear Mr. Ledbetter: With reference to your letter of February 6, 1967 addressed to the Driscoll Foundation, pertaining to the re- location of the city's 6 inch gas line as more fully reflected by your letter and the attachments thereto, it is our understand- ing that the re- Location work has now been completed. The Driscoll Foundation agreed to bear the cost of re- locating the gas line to the extent of $2 927.99, providing, however, the city released to the foundation all rights in and to the easement in which the gas line was laid and which crosses the foundation property at Baldwin and Airport Road, all as shown by the plat attached to your letter. Payment of such sum shall be made immediately following receipt by the Driscoll Foundation of an acceptable instrument releasing to the foundation the abandoned right -of -way easement.
