GRANTING AN APPEAL FROM THE REFUSAL OF THE ZONING
AND PLANNING COMMISSION TO GRANT AN APPLICATION FOR
A SPECIAL USE PERMIT UNDER ARTICLE 25 OF THE ZONING
ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON
AUGUST 27, 1937, APPEARING IN VOLUME 9, PAGES 565,
ET SE4, OF THE ORDINANCE AND RESOLUTION RECORDS, AS
AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED
BY ORDINANCE NO. 61o6, AS AMENDED, UPON APPLICATION
OF S. B. DEGAISH BY GRANTING A SPECIAL USE PERMIT TO
LOCATE AN INDIVIDUAL TRAILER HOUSE OR MOBILE HOME ON
A TRACT OF LAND CONSISTING OF 0.8031E ACRES OUT OF
THE SOUTHEAST CORNER OF LOT 15, SECTION 41, FLOUR BLUFF
AND ENCINAL FARM AND GARDEN TRACTS, LOCATED ON THE
SOUTHWEST CORNER OF THE INTERSECTION OF FLOUR BLUFF
DRIVE AND GRAHAM ROAD, FRONTING 200 FEET ON FLOUR
BLUFF DRIVE AND EXTENDING APPROXIMATELY 175 FEET FOR THE
MOST DEPTH, WITH CERTAIN CONDITIONS IMPOSED ON SAID
SPECIAL PERMIT GRANTED, AS MORE FULLY HEREINAFTER SET
OUT; AND DECLARING AN EMERGENCY.
WHEREAS, APPLICATION WAS MADE TO THE ZONING AND PLANNING COM-
MISSION FOR SPECIAL USE PERMIT UNDER ARTICLE 25 OF THE ZONING ORDINANCE OF
THE CITY OF CORPUS CHRISTI; AND
WHEREAS, PUBLIC HEARING WAS HELD, AFTER DUE NOTICE, AT WHICH
t HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD BY THE ZONING
AND PLANNING COMMISSION, AND WHICH APPLICATION WAS DENIED BY SAID ZONING
AND PLANNING COMMISSION; AND
WHEREAS, AN APPEAL WAS TAKEN TO THE CITY COUNCIL FROM SAID DENIAL
AND PUBLIC HEARING WAS HELD BY THE CITY COUNCIL AT WHICH HEARING ALL PERSONS
WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAID APPLICA-
TION FOR SPECIAL USE PERMIT, IN ACCORDANCE WITH PUBLIC NOTICE TO THE PUBLIC,
SAID PUBLIC HEARING HAVING BEEN HELD ON MAY 17, 1967, AT REGULAR MEETING
OF THE CITY COUNCIL IN THE COUNCIL CHAMBERS AT CITY HALL IN THE CITY OF
CORPUS CHRISTI; AND
WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED
BY THE CITY COUNCIL THAT TO GRANT THE SAID APPLICATION FOR SPECIAL USE
PERMIT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE
GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE APPLICATION FOR SPECIAL USE PERMIT FOR A
SINGLE MOBILE HOME OR TRAILER USE IN ACCORDANCE WITH SUBSECTION 10 OF

SECTION 25 -4 OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ORIGINALLY
ADOPTED ON AUGUST 27, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565,
ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO
BE GRANTED
TIME AND PARTICULARLY AS AMENDED BY ORDINI NCE No. 6106, AS AMENDED,/SO
AS TO PERMIT THE USE OF A TRACT OF LAND CONSISTING OF 0.8034 ACRES OUT
OF THE SOUTHEAST CORNER OF LOT 15, SECTION 41, FLOUR BLUFF AND ENCINAL FARM
AND GARDEN TRACTS, LOCATED ON THE SOUTHWEST CORNER OF THE INTERSECTION OF
FLOUR BLUFF DRIVE AND GRAHAM ROAD, FRONTING 200 FEET ON FLOUR BLUFF DRIVE
AND EXTENDING APPROXIMATELY 175 FEET FOR THE MOST DEPTH, SITUATED IN CORPUS
CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE FOLLOWING- CONDIT16NS:
1) THAT A PLAT BE SUBMITTED AND APPROVAL OBTAINED FROM
THE CITY PLANNING AND ZONING COMMISSION FOR SAID AREA
TO THE EFFECT THAT THE LOT OCCUPIED BY SAID TRAILER
IS OTHERWISE UNOCCUPIED BY ANY RESIDENTIAL USE; AND
2) THAT THIS SPECIAL USE PERMIT SHALL BE FOR A PERIOD
OF TWO YEARS, AND SHALL AUTOMATICALLY EXPIRE TWO
YEARS FROM THE DATE OF THE PASSAGE OF THIS ORDINANCE.
SECTION 2. THAT ALL ORDINANCES OF THE CITY OF CORPUS CHRISTI
APPLICABLE TO THE USE OF THE PREMISES OR LOCATION FOR SINGLE MOBILE HOME
OR HOUSE TRAILER BE OBSERVED.
SECTION 3. THAT A NOTATION BE MADE ON THE OFFICIAL ZONING MAP
OF THE CITY REFLECTING THE SPECIAL USE PERMIT HEREBY GRANTED. -
SECTION 4. THAT THE NECESSITY OF IMMEDIATELY MAKING EFFECTIVE
THE AFORESAID GRANTING OF SPECIAL USE PERMIT CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL'BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH PUBLIC EMERGENCY AND NECESSITY EXIST, AND HAVING
REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO

SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
