HomeMy WebLinkAbout08471 ORD - 05/24/1967p i AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH THE STATE OF TEXAS, ACTING BY AND THROUGH ITS STATE HIGHWAY ENGINEER, PROVIDING FOR THE PARTICIPATION IN A CONTINUING, COMPREHENSIVE, COOPERATIVE PLANNING PROCESS, AS PROVIDED IN THE FEDERAL HIGHWAY ACT OF 1962, KNOWN AS THE CORPUS CHRISTI URBAN TRANSPORTATION STUDY, AS MORE FULLY DESCRIBED IN THE SUPPLEMENTAL AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH THE STATE OF TEXAS, ACTING BY AND THROUGH ITS STATE HIGHWAY ENGINEER, PROVIDING FOR THE PARTICIPATION IN A CONTINUING, COMPREHENSIVE, COOPERATIVE PLANNING PROCESS, AS PROVIDED IN THE FEDERAL HIGHWAY ACT OF 1962, KNOWN AS THE CORPUS CHRISTI URBAN TRANSPORTATION STUDY, AS MORE FULLY DESCRIBED IN THE SUPPLEMENTAL AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO IMMEDIATELY ENTER INTO THE AFORESAID AGREEMENT WITHOUT DELAY IN ORDER THAT THE PROPOSED CORPUS CHRISTI URBAN TRANSPORTATION STUDY MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT F76M AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF MAY, 1967. ATTE I Y SEC ET RY 0 APPROVED AS T LEGAL FORM HE CITY OF CORPUS CHRISTI, TEXAS THIS 11/ DAY OF MAY, 1967: CITY ATTORNEY �I 8471 SUPPLEMENTAL AGREEMENT Project 1101 Corpus Christi's Urban Transportation Study WHEREAS, on the 25th day of June, A. D., 1965, an agreement was entered into by and between the State of Texas, acting by'and through its State Highway Engineer, and the City of Corpus Christi and the County of Nueces, providing for participation in a con- tinuing, comprehensive, cooperative planning process as provided in the Federal Aid Highway Act of 1962; and, WHEREAS, the City of Corpus Christi has determined that the best and most economical means of keeping land use data current, which data is essential to the continuing planning process of the Corpus Christi Urban Transportation Study, is by automatic data , processing, using the equipment in the City's Data Processing Center, and has estimated the cost of setting up such a system to.be $20,400, and have recommended to the Advisory Committee that one half of the cost for establishing the automatic land use data processing system be reimbursed from study funds; and, WHEREAS, the Advisory Committee for the Corpus Christi Urban Transportation Study has concurred in the City's recommendation and determined that a portion of the'cost of establishing the automatic land use data processing system should be an eligible charge to the Z Study subject to reimbursement from study funds; and, WHEREAS, it has been determined that the best way of reimburse- ment to the City of Corpus Christi would be a lump sum amount of one half the total estimated cost of establishing the system; and, WHEREAS, the aforesaid agreement does specifically provide for renegotiation as necessary to meet changing conditions, and as recommended by the Advisory Committee, any changes which would materially alter the amount of expense involved. NOW, THEREFORE, it is agreed by the parties hereto, that the City of Corpus Christi will perform the work needed to update land use in the Study Area, securing such data by survey zone and will prepare this data in a form suitable for automatic data processing, as outlined in the report "Land Use Data System, Corpus Christi Urban Area" prepared for the Corpus Christi Area Development Committee by Harland Bartholomew and Associates and as discussed at the Advisory Committee meeting April 27, 1967, will process this data on equipment in the City's Data Processing Center completing this initial processing not later than December 31, 1967, and will periodically update and summarize such data and make it available to the Transportation Study Office. It is agreed that such summarized data will be made available to the Study Office of the Texas Highway , Department within 60 days after written request has been made but.that such requests will not be made at intervals of less than 6 calendar months without the consent of the Advisory Committee.
