HomeMy WebLinkAbout08476 ORD - 05/31/19675/31/67:E AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AN AGREEMENT BETWEEN THE CITY AND THE STATE OF TEXAS, THE STATE OF TEXAS ACTING BY AND THROUGH ITS STATE HIGHWAY COMMISSION AND COMMISSION MINUTE ORDER 30665, FOR THE RESURFACING OF CERTAIN STREET PAVEMENT WITHIN THE CITY, BY WHICH AGREEMENT THE CITY WILL REIMBURSE THE STATE FOR THE COST OF SUCH STREET RESURFACING OF COOPERS ALLEY, A PORTION OF CHAPARRAL STREET AND A PORTION OF KINNEY AVENUE ON STATE HIGHWAY 414; APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $3,500, APPLI- CABLE TO PROJECT 220 -53 -18.2, TO COVER COSTS OF RE- SURFACING SAID STREETS; PROVIDING FOR DEPOSIT WITH THE STATE OF THE SUM OF $3,500 FOR SAID COSTS, ALL IN ACCORDANCE WITH SAID AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND THE STATE OF TEXAS, SAID STATE ACTING BY AND THROUGH ITS STATE HIGHWAY COMMISSION AND COMMISSION MINUTE ORDER 30665, BY WHICH AGREEMENT THE CITY WILL REIMBURSE THE STATE FOR THE CITY'S SHARE OF THE COST OF RESURFACING COOPERS ALLEY, A PORTION OF CHAPARRAL STREET AND A PORTION OF KINNEY AVENUE, ON STATE HIGHWAY NO. 44, ALL IN CONNECTION WITH PROJECT 220 -53 -18.2, MIDTOWN TRAFFIC EXCHANGE, ALL AS IS MORE FULLY SET OUT IN SAID AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THAT THE SUM OF $3,500 IS HEREBY APPROPRIATED OUT OF NO. 220 STREET BOND FUND TO COVER COSTS OF RESURFACING SAID STREETS, IN- CLUDING CONTINGENCIES AND CONSTRUCTION ENGINEERING. SECTION 3. THAT THE SUM OF $3,500 BE DEPOSITED WITH THE STATE TO COVER THE CITY'S SHARE OF SAID STREET RESURFACING, AS IS SET OUT IN SAID ATTACHED AGREEMENT. - SECTION 4. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE ATTACHED AGREEMENT AND TO APPROPRIATE THE NECESSARY SUM AND DEPOSIT SAME WITH THE STATE, IN ORDER THAT THE CONSTRUCTION OF THE MIDTOWN TRAFFIC EXCHANGE MAY PROGRESS WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN ®Y!u IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS ASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF , 1967. C 102 -1 -29 Nueces County STATE OF TEXAS COUNTY OF TRAVIS THIS AGREEMIU, made this day of , 19673 by and between the City of Corpus Christi, Texas, hereinafter called the "City ", Party of the First Part, acting by and through its City Manager and the State of Texas, hereinafter called the "State", Party of the Second Part, acting by and through its State Highway Commission. WHERAS, the City desires the construction of asphaltic concrete pavement along Cooper Alley, Chaparral Street and Kinney Avenue on State Highway No. 44 as outlined in Field Change Request No. 1. The estimated construction cost of this additional work amounts to Three Thousand Five Hundred and No /100 Dollars ($3,500.00), including contingencies and construction engineering. NCiT THEREFORE, it is understood that this proposed work consisting of the con- struction of asphaltic concrete pavement along Cooper Alley, Chaparral Street and Kinney Avenue on State Highway No. 44 as outlined in Field Change Request No. 1, will be constructed by the State and the City will transmit to the State with the return of this agreement, executed by the City, a warrant made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of Three Thousand Five Hundred and No /100 Dollars ($3,500.00), to be. used in paying for the proposed additional work required by the City. In the event the amount as paid is more than the actual cost of the City's share, as herein estab- lished, then the excess amount will be returned to the City.
