AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A SUPPLEMENTAL AGREEMENT WITH CENTRAL POWER AND LIGHT
COMPANY, TO SUPPLEMENT THE AGREEMENT AUTHORIZED BY
ORDINANCE NO. 5193, PASSED AND APPROVED BY THE CITY
COUNCIL ON NOVEMBER 12, 1958, CONCERNING FREEWAY
LIGHTING, OPERATION AND MAINTENANCE, A COPY OF SAID
SUPPLEMENTAL AGREEMENT BEING ATTACHED HERETO AND MADE
A PART HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS: °
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A
SUPPLEMENTAL AGREEMENT WITH CENTRAL POWER AND LIGHT COMPANY, SUPPLEMENTING
THE AGREEMENT AUTHORIZED BY ORDINANCE No. 5193, PASSED AND APPROVED BY THE
CITY COUNCIL ON NOVEMBER 121 1958, CONCERNING FREEWAY LIGHTING, OPERATION
AND MAINTENANCE, A COPY OF SAID SUPPLEMENTAL AGREEMENT BEING ATTACHED HERETO
AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY TO EXECUTE THE AFORESAID AGREEMENT AS
PROMPTLY AS POSSIBLE IN ORDER TO EFFECTUATE THE TERMS THEREOF CREATES A
PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPEN-
SION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLU-
TION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED
THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE
IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO

AMENDMENT TO
FREEWAY LIGHTING, OPERATION,
AND MAINTENANCE AGREEMENT
OF NOVEMBER 12, 1958
This Supplemental Agreement shall constitute an amendment to that certain
"FREEWAY LIGHTING, OPERATION, AND MAINTENANCE AGREEMENT" (hereinafter referred
to as the "Agreement ") entered into and executed as of the 12th day of November,
1958, between and by the City of Corpus Christi (hereinafter referred to as the
"City ") and the Central Power and Light Company (hereinafter referred to as the
"Company "),
W I T N E S S E T H
WHEREAS, the City is responsible for the operation and maintenance of a
Freeway Safety Lighting System in the City of Corpus Christi on Interstate
Highway 37 from East end of Corn Products Road Interchange to the M.P.R.R. Under-
pass near Calallen (locally known as "Interstate Highway 37 "), which system is
shown on the drawing marked Exhibit "A" attached hereto and made a part hereof,
and which system shall, for the purpose of the agreement as amended, be known as
"Project No. 7, which said Project No. 7 consists of eighty -nine (89) lamps mounted
on aluminum or steel standards, all being twenty thousand (20,000) lumen mercury
vapor lamps, and sixteen (16) lamps mounted on bridge cap walls, all being ten
thousand (10,000) lumen mercury vapor lamps in said Project No. 7, and
WHEREAS, the Company agrees to provide electric service and maintain the
above described ten thousand (10,000) lumen mercury vapor lamps at a rate of $2,50
per fixture per month upon the terms and conditions of the original contract.
NOW, THEREFORE, this Supplemental Agreement shall become an amendment to the
Agreement and Project No. 7 shall from the date hereof be operated under said
Agreement as though originally included as a part thereof but the Agreement as
amended shall not be otherwise affected hereby.
IN TESTDDNY WHEREOF, the Central Power and Light Company has caused these
presents to be signed in its name by its authorized officer, and to be attested
by its Secretary, and the City has caused these presents to be signed by the City
Manager of the City of Corpus Christi and attested by its City Secretary as of the
day of 19_.

RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED/ OR AT THE PRESE.HT MEETING OF THE
CITY COUNCIL.
