SOLEDAD, FROM THE NORTHWESTERLY SIDE OF CARVER TO THE INTERSECTION OF VIRGINIA STREET; 2. VIRGINIA STREET, FROM SOLEDAD INTERSECTION TO THE INTERSECTION OF MORGAN AVENUE; 3. POST STREET FROM BEECHCRAFT TO INTERSECTION OF OLD '• BROWNSVILLE ROAD; Y. RYAN STREET, FROM THE INTERSECTION OF POST STREET TO THE INTERSECTION OF VIRGINIA STREET; 5. CURTIS STREET, FROM THE INTERSECTION OF POST STREET TO THE INTERSECTION OF VIRGINIA STREET; 6. REYNOSA STREET, EXTENDING FROM THE NORTH RIGHT -OF - WAY LINE, OF BURNET STREET NORTHWARD A DISTANCE OF 268 FEET TO THE NORTH RIGHT -OF -WAY LINE OF BURNET STREET; 7. BURNET STREET, FROM THE EAST RIGHT -OF -WAY LINE OF REYNOSA STREET TO THE WEST RIGHT -OF -WAY LINE OF NIAGARA STREET; 8. NIAGARA STREET FROM THE NORTH RIGHT -OF -WAY LINE OF BURNET STREET SOUTHWARD A DISTANCE OF 372 FEET TO THE CENTERLINE OF BURNET STREET; AND 9. BURNET STREET, FROM THE EAST RIGHT -OF -WAY LINE OF NIAGARA STREET TO THE WEST RIGHT -OF -WAY LINE OF PRESCOTT STREET; DETERMINING AND FIXING THE PORTION OF SAID COSTS TO BE PAID BY AND ASSESSED AGAINST ABUTTING PROPERTY, THE PORTION TO BE PAID BY THE CITY OF CORPUS CHRISTI; DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING PROPERTY; ORDERING AND SETTING A HEARING TO BE HEIR ON AUGUST 9, 1967, TO GIVE NOTICE OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE OF TEXAS ADD THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, HERETOFORE ON THE 19TH DAY OF JULY, 1967, BY DULY ENACTED ORDINANCE DETERMINED THE NECESSITY FOR AND ORDERED THE IMPROVEMENT OF THE PORTION OF: 1. SOLEDAD, FROM THE NORTHWESTERLY SIDE OF CARVER TO THE INTERSECTION OF VIRGINIA STREET; 2. VIRGINIA STREET, FROM SOLEDAD INTERSECTION TO THE INTERSECTION OF MORGAN AVENUE; 3. POST STREET FROM BEECHCRAFT TO INTERSECTION OF OLD BROWNSVILLE ROAD; 4. RYAN STREET, FROM THE INTERSECTION OF POST STREET TO THE INTERSECTION OF VIRGINIA STREET; .85286 • 5. NIAGARA STREET FROM THE NORTH RIGHT- OF- WAY LINE TOFTHE BURNET STREET SOUTHWARD A DISTANCE OF 37 FEET CENTERLINE OF BURNET STREET; AND 9• STREET To THE WEST RIGHT OFT G WAY LINE FA F PRESCOTTSTIREET; A DULY EXECUTED NOTICE OF SAID ORDINANCE HAVING THEREAFTER BEEN FILED IN THE NAME OF THE CITY WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS; AND WHEREAS, PURSUANT TO THE ORDINANCE OF JULY 19, 1967, ABOVE MENTIONED, AND AFTER HAVING ADVERTISED FOR AND RECEIVED BIDS ON THE CON- STRUCTION OF SAID IMPROVEMENTS FOR THE LENGTH OF TIME AND IN THE MANNER AND FORM AS REQUIRED BY THE CHARTER OF SAID CITY AND THE LAWS OF THE STATE OF TEXAS, HAVING AWARDED A CONTRACT FOR THE CONSTRUCTION OF SAID IMPROVEMENTS TO BURTEX CONSTRUCTORS, INC., ON ITS LOWEST AND MOST ADVANTAGEOUS BID, AND HAVING DULY AND REGULARLY MADE APPROPRIATION OF FUNDS AVAILABLE FOR SAID PURPOSE TO COVER THE ESTIMATED COST TO SAID CITY OF SAID IMPROVEMENTS, ALL AS PROVIDED BY THE CORPUS CHRISTI CITY CHARTER AND BY -LAW AND THE LAWS OF THE STATE OF TEXAS, DID EXECUTE HERETOFORE ON JULY 191 1913 7, A CONTRACT WITH BURTEX CONSTRUCTORS, INC., AND THE PERFORMANCE BOND REQUIRED BY SAID CONTRACT HAVING BEEN PROPERLY FURNISHED AND POSTED BY SAID BURTEX CONSTRUCTORS, INC., AND ACCEPTED BY SAID CITY COUNCIL AS TO FORM AND AMOUNT AS REQUIRED BY THE CHARTER OF THE CITY AND THE LAWS OF THE STATE OF TEXAS; AND WHEREAS, THE SAID CITY COUNCIL HAS CAUSED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE ESTIMATES OF THE COSTS OF SUCH IMPROVEMENTS AND ESTIMATES OF THE AMOUNT PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE PROPERTY ABUTTING SAID STREET TO BE IMPROVED, AND THE REAL AND TRUE OWNERS THEREOF, AND SAID DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTI- MATES AND A STATEMENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCIL, AND THE SAME HAVING BEEN RECEIVED AND EXAMINED BY SAID CITY COUNCIL; AND -2- WHEREAS, IN ACCORDANCE WITH SAID STATEMENT OF ESTIMATES AND OTHER MATTERS PREPARED AND FILED BY SAID DIRECTOR OF PUBLIC WORKS HEREIN APPROVED BY SAID CITY COUNCIL, THE TOTAL ESTIMATED COST OF THE WHOLE IMPROVEMENT OF SOLEDAD, VIRGINIA, POST, RYAN, CURTIS,I REYNOSA, BURNET, AND NIAGARA, WITHIN THE LIMITS HEREINABOVE DEFINED, IS $204,18!}•47. SECTION 2. THAT IT IS HEREBY FOUND AND DETERMINED THAT THE TOTAL ESTIMATED COST OF THE WHOLE IMPROVEMENT OF THE ABOVE NAMED STREETS, WITHIN THE LIMITS ABOVE DEFINED, IS $204,184.17. THAT THE TOTAL ESTIMATED AMOUNT OF THE COST OF SAID IMPROVEMENTS TO THE FOREGOING STREETS PROPOSED TO BE ASSESSED AGAINST THE ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF, IS $103,259.11; THE TOTAL ESTIMATED AMOUNT OF THE COST OF SAID IMPROVEMENTS TO THE FOREGOING STREETS WITHIN THE LIMITS ABOVE DEFINED PROPOSED TO BE PAID BY THE CITY OF CORPUS CHRISTI IS $100,925.36• SECTION 3. THAT A PORTION OF THE COST OF SAID IMPROVEMENTS SHALL BE PAID AND DEFRAYED BY THE CITY OF CORPUS CHRISTI, TEXAS, AND THAT A PORTION OF THE COST OF SAID IMPROVEMENTS SHALL BE PAID BY AND ASSESSED AGAINST THE -5- PROPERTY ABUTTING UPON SAID STREETS WITHIN THE LIMITS ABOVE DEFINED, AND AGAINST THE REAL AND TRUE OWNERS THEREOF IN ACCORDANCE WITH, AND IN THE MANNER PROVIDED BYE THE CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS, AND BY ARTICLE 1105 -B OF VERNON'S ANNOTATED CIVIL STATUTES OF TEXAS AND THAT THE TOTAL COST OF SAID IMPROVEMENTS SHALL BE AND ARE HEREBY APPORTIONED BETWEEN SAID PARTIES AND SHALL BE PAID AND DEFRAYED AS FOLLOWS: (A) THE CITY OF CORPUS CHRISTI SHALL PAY THE WHOLE COST OF CON- STRUCTION, RECONSTRUCTION OR REPAIR OF THE CURBS, GUTTERS AND SIDEWALKS WITHIN THE INTERSECTIONS OF SAID STREETS WITH OTHER STREETS AND ALLEYS AND SHALL PAY NOT LESS THAN ONE -TENTH (I/10TH) OF THE TOTAL REMAINING COST OF SAID IMPROVEMENTS ON SAID STREETS EXCLUSIVE OF THE COST OF THE CURBS, GUTTERS AND SIDEWALKS, IN FRONT OF THE RESPECTIVE PROPERTIES ABUTTING UPON SAID STREETS, SAID COSTS BEING IN THE AMOUNTS AS HEREINBEFORE SET OUT IN SECTION 2 HEREOF. (B) THE PROPERTY ABUTTING UPON SAID STREETS WITHIN THE LIMITS ABOVE DEFINED, AND THE REAL AND TRUE OWNERS THEREOF SHALL BE ASSESSED AND PAY FOR EIGHTY ($O %) PERCENT OF THE TOTAL COST OF CONSTRUCTION, RECONSTRUC- TION OR REPAIRING, AS THE CASE MAY BED OF SIDEWALKS, CURBS, GUTTERS, AND DRIVEWAYS IN FRONT OF THEIR RESPECTIVE PROPERTY1 EXCLUSIVE OF THE AMOUNT THEREIN SPECIFIED TO BE PAID BY THE CITY OF CORPUS CHRISTI AS SET OUT IN SUB- SECTION (A) ABOVE AND EXCLUSIVE OF THE COST OF ANY STORM SEWERS BUT INCLUSIVE OF THE COSTS OF ALL INCIDENTALS AND APPURTENANCES THERETO. HOW - EVERT THE TOTAL COSTS TO BE ASSESSED AGAINST AND PAID BY ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS THEREOF, SHALL NOT IN ANY CASE EXCEED NINE- TENTHS (9 /10THS) OF THE TOTAL COST OF SAID IMPROVEMENTS ON THE STREETS UPON WHICH THEY ABUTS EXCLUSIVE OF THE COST OF CURBS GUTTERS AND SIDEWALKS SAID COSTS BEING AT THE RATE OF, AND IN THE AMOUNTS AS HEREINABOVE SET OUT IN SECTION 2 HEREOF.
