HomeMy WebLinkAbout08564 ORD - 08/16/1967i- A AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON w BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT EXTENDING AND RENEWING AN AGREEMENT DATED THE 8TH DAY OF JUNE,,.1966, BETWEEN THE CITY OF CORPUS CHRISTI AND THE STATE DEPARTMENT OF PUBLIC WELFARE CONCERNING THE PROVIDING OF FACILITIES IN CORPUS CHRISTI FOR A PROGRAM OF TRAINING OF PERSONS FOR TRADES AND OCCUPATIONS; SAID CONTRACT TO BE EFFECTIVE ON SEPTEMBER 1, 1967 AND CONTINUING INDEFINITELY, SUBJECT TO AVAILABILITY OF FUNDS; A COPY OF c SAID CONTRACT BEING ATTACHED HERETO AND MADE A PART HEREOF; S AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT EXTENDING AND RENEWING AN AGREEMENT DATED THE 8TH DAY OF JUNE, 1966, AND AUTHORIZED BY ORDINANCE NO. 8051, BETWEEN THE CITY OF CORPUS CHRISTI AND THE STATE DEPARTMENT OF PUBLIC WELFARE, CONCERNING THE PROVID- ING OF FACILITIES IN CORPUS CHRISTI FOR A PROGRAM OF TRAINING OF PERSONS FOR TRADES AND OCCUPATIONS, SAID CONTRACT TO BE EFFECTIVE ON SEPTEMBER 1, 1967 4. AND CONTINUING INDEFINITELY, SUBJECT TO THE AVAILABILITY OF FUNDS, A COPY b OF WHICH CONTRACT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NEED TO EXECUTE THE AFORESAID CONTRACT OF EXTENSION AND RENEWAL AS PROMPTLY AS POSSIBLE IN ORDER THAT THE PROGRAM OF TRAINING OF PERSONS FOR TRADES AND OCCUPATIONS BY THE CITY OF CORPUS CHRISTI MAY BE BEGUN WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING Fi REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED ' FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT yyFROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _ /(Q,(�U DAY OF AUGUST, 1967. ATTES .� //.�.P -Q.� 4 C(Tf SECR TA Y U APPROVED AS TO EGAL FORM THIS THE CITY OF CORPUS CHRISTI, TEXAS 16TH DAY OF AUGUST, 1967: CITY ATTORNEY p � 1 STATE OF TEXAS X COUNTY OF TRAVIS X CONTRACT WHEREAS, the City of Corpus Christi, Texas, hereinafter referred to as the City, and the State Department of Public Welfare, hereinafter re- ferred to as the Department, for the purpose of carrying out the provisions of Title V of the Federal "Economic Opportunity Act of 1964 ", entered into a Contract on the 8th day of June, 1966, which was approved by the Attorney General of Texas on the 23rd day of June, 1966; and WHEREAS, provisions of the Texas Constitution prohibit the State of Texas from entering into financial obligations which extend beyond the bien- nium, thus necessitating the renegotiation of existing contracts to be effec- tive on the first day of the nev biennium. THEREFORE, the City and the Department hereby agree to the renewal and continuation of the aforesaid Agreement which terms and provisions are 'adopted and incorporated herein and continued in full force and effect except- as specifically amended hereafter: t (1) That said Agreement be renewed -and extended for the period effective the first day of September, 1967, and continuing indefinitely, subject to availability of appropriated funds.
