VAUGHAN, JR., INDIVIDUALLY AND AS INDEPENDENT EXECUTOR OF THE ESTATE OF RACHAEL DOUGHERTY VAUGHAN, DECEASED, OF CORPUS CHRISTI, TEXAS; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THERE IS HEREBY APPROPRIATED OUT OF N0. 220 -67 -97 OCEAN DRIVE, COLE PARK TO ALAMEDA JUNCTION FUNDS THE SUM OF $38,570.50, OF WHICH AMOUNT $38,345.00 IS FOR ACQUISITION OF PARCELS OF LAND NO. 51 6 AND 7, $225.50 IS FOR TITLE EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT N0. 220 -67 -97 OCEAN DRIVE, COLE PARK TO ALAMEDA JUNCTION, SAID PARCELS BEING DESCRIBED AS FOLLOWS: "T u;'• - PARCEL # 5 TRACT # 1 All that certain tract of land east of Block 7, Port Aransas Cliffs Addition to the City of Corpus Christi, Texas, as shown by the maps thereof recorded in Volume A, Page 27, and Vol. 4, Page 51, Map Records of Nueces County, Texas, and being the portion of said land lying between the east boundary line of Ocean Drive and the shore of Corpus Christi Bay, lying opposite Lots 7 to 12, inclusive and Lots 53 to 58, inclusive, of said Block 7, bounded on the north by the easterly extension of the north line of Lots 53 and 12, and on the south by the south line the easterly extension of the south line of Lots 58 and 7, of said Block 7; and being more particularly described in Deed dated October 14, 1949, from Harvie Branscomb, Jr., to Ben F. Vaughan, Jr., recorded in Volume 497, Page 350, Deed Records of Nueces County, Texas, to which reference is here made for all pertinent purposes. PARCEL # 6 TRACT # 2 All of that certain tract of land lying east of Block 7, Port Aransas Cliffs Addition to the City of Corpus Christi, Texas, as shown by the maps thereof recorded in Volume A, Page 27, and Vol. 4, Page 51, Map Records of Nueces County, Texas, and being that portion of said land between the east boundary of Ocean Drive and the shore of Corpus Christi Bay and being more particularly described as follows, to -wit: Beginning at a point where the southeast boundary line of Williams Street, if extended, would intersect the East boundary line of Ocean Drive; thence with . said East boundary line of Ocean Drive in a northerly direction to a point where the northerly boundary line of Lot 59 and Lot 6, and the southeast boundary line of Lot 58 and Lot 7, all in Block 7, if extended in an Easterly direction would intersect the East boundary line of Ocean Drive; thence with said extended and projected line North 580 54' E. to the waters of Corpus Christi Bay; thence in a southerly direction with and following the meanders of the shore of Corpus Christi Bay to a point where the Southeast boundary line of Williams Street, if extended, would intersect the Bay shore; thence with said projected line S. 580 54' West to the place of beginning; and being more particularly described in Deed dated December 2, 1948 from A. D. Corgey and wife, Edna Corgey to Ben F. Vaughan, Jr., and wife, Rachael Dougherty Vaughan, rec. Vol. 415, Page 292, Deed Records of Nueces County, Texas, to which reference is here made for all purposes. PARCEL # 7 TRACT # 3 All that certain tract of land lying between the Northeast boundary line of the public road known as Ocean Drive and the shore line of Corpus Christi Bay, having for its Northwest boundary line an extension in a Northeasterly direction of the Southeast boundary line of Block No. Seven (7) of Port Aransas Cliffs Addition to the City of Corpus Christi, Texas, as shown by the map thereof, recorded in Vol. A, page 27, Map Records of Nueces County, Texas, from the Northeast boundary line . of said Ocean Drive to the shore line of said Corpus Christi Bay, and having for its southeast boundary line a similar extension of the Southeast boundary line of Lot No. Twenty -nine (29) in Block No. Eight (8) of said Port Aransas Cliffs Addition. -2- SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI WITH OWNERS, BEN F. VAUGHAN, JR., INDIVIDUALLY AND AS INDEPENDENT EXECUTOR OF THE ESTATE OF RACHAEL DOUGHERTY VAUGHAN, DECEASED, OF CORPUS CHRISTI, TEXAS. SECTION 3. THE NECESSITY TO EXECUTE THE AFORESAID REAL ESTATE SALES CONTRACT IN ORDER TO ACQUIRE FOR THE CITY THE AFORESAID PARCELS OR TRACTS OF LAND CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 0'4 DAY OF AUGUST, 1967.
