A RESOLUTION
RECOMMENDING AND REQUESTING THAT THE TEXAS HIGHWAY
DEPARTMENT PROVIDE IN THEPR ROADWAY CONTRACT THE
RELOCATION OF WATER LINES THAT WILL INTERFERE WITH
HIGHWAY CONSTRUCTION ON STATE HIGHWAY 358, FROM STATE
HIGHWAY 286 TO AIRLINE ROAD; AND DECLARING AN EMERGENCY.
WHEREAS, THE STATE HIGHWAY DEPARTMENT HAS COOPERATED WITH THE

*HIGHWAY 286 TO AIRLINE ROAD IN CORPUS CHRISTI, TEXAS; AND

WHEREAS, IN THE CONSTRUCTION OF THE PRESENTLY PLANNED EXPRESSWAY,
IT HAS BEEN DETERMINED THAT A WATER LINE OWNED BY THE CITY OF CORPUS CHRISTI
-r MUST BE RELOCATED TO ELIMINATE A CONFLICT WITH THE PROPOSED HIGHWAY FACILITIES;
AND
WHEREAS, IT IS NOT POSSIBLE FOR THE CITY OF CORPUS CHRISTI TO RE-
LOCATE THIS WATER LINE PRIOR TO THE AWARD OF HIGHWAY CONTRACTS:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of THE CITY
OF CORPUS CHRISTI, TEXAS, THAT WE REQUEST THE TEXAS HIGHWAY DEPARTMENT TO
INCLUDE IN THEIR ROADWAY CONTRACTS THE RELOCATION OF THE WATER LINES AND THE
CITY WILL PROVIDE THE FOLLOWING:
1. PROVIDE WITHOUT COST TO THE STATE ANY ADDITIONAL
RIGHT OF WAY NEEDED TO ACCOMPLISH THE WATER LINE RE-
LOCATION. IT IS UNDERSTOOD THAT NO ADDITIONAL RIGHT
A4 OF WAY IS NEEDED ACCORDING TO PRELIMINARY PLANS AND
THAT ANY RIGHT OF WAY NEEDED WILL BE HELD TO A MINIMUM.
• 2. PROVIDE AT ITS COST ALL ENGINEERING WORK NECESSARY TO .
DESIGN AND RELOCATE THE WATER LINE, SUCH RELOCATION TO
MEET THE POLICY REQUIREMENTS OF THE HIGHWAY DEPARTMENT.
3. RETAIN ALL RESPONSIBILITIES FOR FUTURE CONSTRUCTION,
RECONSTRUCTION, OPERATION AND MAINTENANCE OF THE
RELOCATED WATER LINE, AND INDEMNIFY THE STATE AGAINST
ANY DAMAGES OR CLAIMS FOR DAMAGES IN CONNECTION THERE-
WITH.
4. SUBJECT TO APPROPRIATION BY THE CITY COUNCIL IMMEDIATELY
PRIOR TO ADVERTISING FOR BIDS BY THE STATE, MAKE AN AD- ,¢
VANCED CONTRIBUTION IN THE AMOUNT OF $1450,000 TO CONSTI-
TUTE THE FIXED COST TO THE CITY IN ACCOMPLISHING THE WATER "
LINE RELOCATION AS INCLUDED IN THE HIGHWAY DEPARTMENT'S
CONSTRUCTION CONTRACT.

REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
