HomeMy WebLinkAbout08605 ORD - 09/21/1967r - JKH:9 -19 -67 [. •1 AN ORDINANCE ADOPTING MINUTE ORDER N0. 59912 PASSC9 BY THE STATE HIGHWAY COMMISSION ON AUGUST 31, 1967, REGARDING THE RELOCATION OF THE WATER LINE ON PAD E E FROM STATE HIGHWAY 2 TO AIRLINE ROAD, IN THE CITY OF CORPUS CHRISTI, WHEREBY THE CITY OF CORPUS CHRISTI WILL PARTICIPATE WITH THE STATE HIGHWAY DEPARTMENT IN THE RELOCATION OF THE SAID WATER LINE WITHIN THE LIMITS AFORESAID; AND DECLARING AN EMERGENCY. WHEREAS, THE STATE HIGHWAY DEPARTMENT HAS SUBMITTED A COPY OF MINUTE ORDER N0. 59912, PASSED BY THE STATE HIGHWAY COMMISSION ON AUGUST 31, 1967, AS FOLLOWS: WHEREAS, IN NUECES COUNTY, ON STATE HIGHWAY 358 FROM STATE HIGHWAY 286 TO AIRLINE ROAD, AN ITEM IS INCLUDED IN THE 1967 -68 CONSOLIDATED HIGHWAY PROGRAM PROVIDING FOR EXPRESSWAY TYPE CONSTRUCTION AT AN ESTIMATED COST OF $3,395,800, AND WHEREAS, THE MAJOR AMOUNT OF RIGHT OF WAY AS NEEDED TO ACCOMPLISH THIS CONSTRUCTION WAS FURNISHED WITHOUT COST TO THE STATE PRIOR TO THE PRESENT 50 -50 RIGHT OF WAY PROGRAM AS AN ELEMENT OF LONG RANGE PLANNING FOR THE ULTIMATE DESIGN OF THIS SECTION'OF HIGHWAY, AND WHEREAS, IN CONNECTION WITH THE PRESENTLY PLANNED EXPRESSWAY IT HAS BEEN DETERMINED THAT A WATER LINE OWNED BY THE CITY MUST BE RELOCATED TO ELIMINATE A CONFLICT WITH THE PROPOSED HIGHWAY FACILITY, AND WHEREAS, THE CITY OF CORPUS CHRISTI, BY RESOLUTION NUMBERED 8577, DATED AUGUST 28, 1967, HAS PROPOSED THAT THE RELOCATION OF THE WATER LINE BE ACCOMPLISHED IN THE HIGHWAY CONSTRUCTION CONTRACT AND IN ADDITION HAS AGREED TO ADVANCE TO THE HIGHWAY DEPARTMENT THE SUM OF $1150,000 WHICH WILL CONSTITUTE THE FIXED COST PARTICIPATION BY THE CITY IN THE COST OF RELOCATING THE WATER LINE; NOW, THEREFORE, THE STATE HIGHWAY ENGINEER IS DIRECTED TO TENDER THE FOLLOWING PROPOSAL TO THE CITY OF CORPUS CHRISTI: PROVIDED THE CITY WILL: 1. PROVIDE WITHOUT C05T TO THE STATE ANY ADDITIONAL RIGHT OF WAY NEEDED TO ACCOMPLISH THE WATER LINE RELOCATION. IT IS UNDERSTOOD THAT NO ADDITIONAL RIGHT OF WAY IS NEEDED ACCORDING TO PRELIMINARY PLANS, AND ANY RIGHT OF WAY NEEDED WILL BE HELD TO A MINIMUM. 2. PROVIDE AT ITS COST ALL ENGINEERING WORK NECESSARY TO DESIGN AND RELOCATE THE WATER LINE, SUCH RELOCATION TO MEET THE POLICY REQUIREMENTS OF THE HIGHWAY DEPARTMENT. 3. RETAIN ALL RESPONSIBILITIES FOR FUTURE CONSTRUC- TION, RECONSTRUCTION, OPERATION AND MAINTENANCE OF THE RELOCATED WATER LINE, AND INDEMNIFY THE STATE AGAINST ANY DAMAGES OR CLAIMS FOR DAMAGES IN CONNEC- TION THEREWITH. 4. IMMEDIATELY PRIOR TO ADVERTISEMENT FOR BIDS BY THE STATE, APPROPRIATE AND MAKE AN ADVANCED CONTRIBUTION IN THE AMOUNT OF $450,000 TO CONSTI- TUTE THE FIXED COST TO THE CITY IN ACCOMPLISHING THE WATER LINE RELOCATION AS INCLUDED IN THE HIGHWAY DEPARTMENTS CONSTRUCTION CONTRACT. THE STATE HIGHWAY DEPARTMENT WILL: 1. INCORPORATE IN ITS HIGHWAY CONSTRUCTION CON- TRACT THE CITY'S PLANS FOR RELOCATION OF THE WATER LINE AND WILL ACCOMPLISH SUCH RELOCATION AT NO ADDI- TIONAL COST TO THE CITY. THE STATES AND CITY'S COSTS WILL BE INCLUDED IN THE CONSTRUCTION CONTRACT AS AN ITEM OF RIGHT OF WAY COST. THIS ORDER SHALL BECOME OPERATIVE UPON ACCEPTANCE BY THE CITY OF CORPUS CHRISTI AND IF NOT ACCEPTED WITHIN 90 DAYS HEREOF, THE ACTION HEREIN CONTAINED SHALL BE AUTOMATICALLY CANCELLED. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT MINUTE ORDER No. 59912, PASSED BY THE STATE HIGHWAY COMMISSION ON AUGUST 31, 1967, REGARDING RELOCATION OF THE WATER LINE ON PADRE ISLAND DRIVE, FROM STATE HIGHWAY 286 TO AIRLINE ROAD, IN THE CITY OF CORPUS CHRISTI, BE AND THE SAME IS HEREBY ADOPTED BY THE CITY OF CORPUS CHRISTI, TEXAS. You may consider this letter your authority to purchase these materials in the amount of $7,473.95• This constitutes an immediate expense to the City which will be credited against the City's share of funds in this project. Please document your files in such a manner that you will be in position to show your bids or quotes and the actual invoiced amount when the settlement is made on this arrangement. We understand that you have a 60 to 90 day delivery period for these valves, and we urge you to order them at the earliest possible date. Before this Minute can become operative, it is necessary that it be accepted by the city of Corpus Christi within ninety days of August 31, 1967. Long District Engineer District 16 f• TmY fllDhwe7� D.pvtaeat ` Poem DDa-A 88788- 811.7m MINUTE ORDER NURCES 1 2 County Page of- _._ Pages Dfetriet No. _ 16 WHEREAS, in NUECES COUNTY, on State Highway 358 from State Highway 286 to Airline Road, an item-is included in the 1967 -68 Consolidated Highway Program providing for Expressway type construction at an estimated cost of $3,395,800, and WHEREAS, the major amount of right of way as needed to accomplish this construction was furnished without cost to the State prior to the present 50 -50 Right of Ray Program as an element of long range planning for the ultimate- design of this section of highway, and hWHEREAS, in connection with the presently planned Expressway it has been determined that a water line owned by the City must be relocated to eliminate a conflict with the proposed highway facility, and WHEREAS, the City of Corpus Christi, by resolution numbered 8577, dated August 28, 19679 has proposed that the relocation of the water line be accomplished in the highway construction contract and in addition has agreed to advance to the Highway Department the sun of $450.000 which will constitute the fixed cost participation by the City in the cost of relocating the water .t line{ IM, THEREFORE, the State Highway Engineer is directed to tender the following proposal to the City of Corpus Christis Provided the City wills 1. Provide at its cost all engineering work necessary to design and relocate the water line, such relocation to meet the policy require- =auto of the Highway Department. 3. Retain all responsibilities for future construction, reconstruction, operation and maintenance of the relocated water line, and indemnify the State against any damages or claims for damages in connection therewith. 4. Immediately prior to advertisement for bids by the State, appro- priate and mate an advanced contribution in the amount of $450,000 to constitute the fixed cost to the City in accomplishing the water line relocation as included in the Highway Department's construction contract. The State Highway Department wills 1. Incorporate in its highway construction contract the City's plans for relocation of the water line and will accomplish such , relocation at no additional cost to the City. The State's and City's coats will be included in the construction contract as an Item of right of way cost. This order sball become operative upon acceptance by the City of Corpus Christi and if not accepted within 90 days hereof, the action herein contained shall be automatically cancelled.
