HomeMy WebLinkAbout08615 ORD - 09/27/1967vMP:9/27/67 AN ORDINANCE AMENDING CHAPTER 18 OF CORPUS CHRISTI CITY CODE, 1958, ENTITLED "GARBAGE, TRASH AND WASTES ", AS AMENDED, BY AMENDING THE SECOND PARAGRAPH OF SECTION 18 -22, AS AMENDED AUGUST 2, 1967, BY ORDINANCE NO. 8553; BY AMEND- ING SECTION 18 -28; BY AMENDING SECTION 18 -31+; BY ADOPTING A NEW SECTION OF NEW AND ADDITIONAL REGULATIONS; CONTAIN- ING A SEVERANCE CLAUSE; PROVIDING FOR PUBLICATIONS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 18 -22 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED BY ORDINANCE ND. 8553, ADOPTED AUGUST 2, 1967, BE AND THE SAME IS HEREBY AMENDED BY AMENDING THE SECOND PARAGRAPH OF SAID SECTION 18 -22 TO HEREAFTER READ AS FOLLOWS: "FOR THE SERVICE OF DISPOSAL ONLY OF GARBAGE AND TRASH, ALL OCCU- PIED BUSINESS AND COMMERCIAL INSTITUTIONS AND ALL OTHER PLACES IN THE CITY, EXCEPT AS NOTED IN SECTION 18 -21 OF THIS CODE, SHALL BE CHARGED AT A MINIMUM RATE OF SEVENTY -FIVE CENTS PER MONTH OR 316 THE AMOUNT OF THE CHARGE WHICH THE SUPERINTENDENT OF THE SANITATION DIVISION OF THE DEPARTMENT OF PUBLIC WORKS SHALL DETERMINE WOULD BE THE PROPER AND EQUITABLE CHARGE FOR BOTH COL- LECTION AND DISPOSAL, IF CITY SERVICES WERE USED, BASED ON THE TYPE AND AMOUNT t OF REFUSE." SECTION 2. THAT SECTION 18 -28 OF THE CORPUS CHRISTI CITY CODE, 1958, BE AND THE SAME IS HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: "SECTION 18 -28. REQUIRED FOR PERSON NOT AGENT OR EMPLOYEE OF CITY. NO PERSON EXCEPT A DULY AUTHORIZED AGENT OR EMPLOYEE OF THE CITY SHALL EMPTY GARBAGE OR TRASH RECEPTABLES OF ANY OTHER PERSON, OR CONVEY OR TRANSPORT GAR- SAGE OR TRASH ON THE STREETS, ALLEYS OR PUBLIC THOROUGHFARES OF THE CITY, OR DISPOSE OF SUCH GARBAGE AND TRASH, AT A CITY MAINTAINED DISPOSAL SITE; WITHOUT A WRITTEN PERMIT GRANTED AND ISSUED BY 'TINE DIRECTOR OF PUBLIC WORKS, AND PAY THE ANNUAL FEE PROVIDED IN SECTION 28 -3Y." SECTION 3. THAT SECTION 18 -34 OF THE CORPUS CHRISTI CITY CODE, 1958, BE AND THE SAME IS HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: "SECTION 18 -3'I. TERM; ANNUAL FEE. PERMITS AS REQUIRED IN SECTION 18 -28 OF THIS CODE SHALL BE ISSUED TO QUALIFIED APPLICANTS FOR A PERIOD OF ONE YEAR; PROVIDED, HOWEVER, THAT APPLICANTS OR HOLDERS OF A PERMIT SHALL PAY TO THE CITY AN ANNUAL FEE OF $24.00 PER TRUCK USED FOR SUCH SERVICES, AT THE TIME OF ISSUANCE OF THE PERMIT." 8615 SECTION 4. THAT CHAPTER 18 OF THE CORPUS CHRISTI CITY CODES 1958, BE AND THE SAME IS HEREBY AMENDED BY ADDING A NEW SECTIONS NUMBERED SECTION 18 -42, ENTITLED "ADDITIONAL REGULATIONS PERTAINING TO GARBAGE COLLECTION AND DISPOSAL ", AND R'E'ADING AS FOLLOWS: SECTION 18 -4Z. ADDITIONAL REGULATIONS PERTAINING TO GARBAGE COLLECTION AND DISPOSAL. A. ALL COMMERCIAL HAULERS ARE HEREBY REQUIRED TO SUBMIT A LIST EACH MONTH OF ALL CUSTOMERS FOR WHICH SAID HAULER HAS RENDERED SERVICE FROM ANY POINT OUTSIDE OF THE CITY LIMITS AND TO MAKE PAYMENT OF A DISPOSAL CHARGE FOR EACH SUCH CUSTOMER AT THE SAME RATE AS FOR CUSTOMERS FOR WHOM SERVICE IS REN- DERED FROM ANY POINT INSIDE THE CITY LIMITS. B. ALL PRIVATE HAULERS USING A CITY - MAINTAINED SITE FOR DISPOSAL OF GARBAGE AND TRASH FROM ANY POINT OUTSIDE THE CITY SHALL] BEFORE MAKING SUCH DISPOSAL OR USING ANY SUCH DISPOSAL SITE, SHALL OBTAIN A LICENSES INCLUD- ING PAYMENT OF THE LICENSING FEES AND BE SUBJECT TO ALL THE RULES AND REGULA- TIONS AS IS REQUIRED OF HAULERS FROM POINTS WITHIN THE CITY LIMITS. C. ALL PERSONS WHO HAUL MATERIAL FROM GREASE TRAPS OR SAND TRAPS OR WHO HAUL ANY OTHER SIMILAR MATERIAL TO ANY DISPOSAL SITE MAINTAINED BY THE CITY SHALL BE SUBJECT TO AND SHALL PAY A DISPOSAL CHARGE BASED ON ESTIMATED QUANTITIES OF HAULING ON THE SAME BASIS AS ALL OTHER DISPOSAL MATERIAL. D. ALL BUILDING OR CONSTRUCTION CONTRACTORS DISPOSING OF REFUSE BUILDING MATERIAL, CONCRETE, BRICKS AND/OR OTHER REFUSE ARE HEREBY ASSESSED AND SHALL BE REQUIRED TO PAY A DISPOSAL FEE BASED ON ESTIMATED QUANTITIES OF REFUSE OR BASED ON A PROJECT BASIS SAVE AND EXCEPT THAT THERE SHALL BE NO CHARGE FOR ONE TRUCKLOAD OF REFUSE EACH MONTH. E. THERE SHALL BE NO DISPOSAL CHARGE FOR ANY PERSON USING HIS OWN CAR OR PICKUP TRUCK FOR THE DISPOSAL OF PERSONAL REFUSE. F. THERE SHALL BE NO CHARGE FROM ANYONE FOR THE DISPOSAL OF CLEAN EARTHEN MATERIAL OR FOR BRUSH CUTTINGS FREE OF OTHER REFUSE. -2- SECTION 5. THE NECESSITY TO AMEND THE CORPUS CHRISTI CITY CODE AS HEREINABOVE SET FORTH CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE_Y_7 DAY OF SEPTEMBER, 1967.
