HomeMy WebLinkAbout08618 ORD - 09/28/19679/28/67 r AN ORDINANCE CANVASSING RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON SEPTEMBER 28, 1967, FOR THE PURPOSE OF DETERMIN- ING WHETHER OR NOT TO ADOPT A ONE PERCENT (1 %) LOCAL SALES AND USE TAX WITHIN THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, HERETOFORE ON THE 28TH DAY OF AUGUST, 1967, AT A SPECIAL COUNCIL MEETING, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED AN ORDINANCE CALLING AN ELECTION TO BE HELD IN SAID CITY ON THE 28TH DAY OF SEPTEMBER, 1967, ON THE FOLLOWING PROPOSITION: "SHALL THERE BE ADOPTED WITHIN THE CITY OF CORPUS .CHRISTI A SALES AND USE TAX AT THE RATE OF ONE PERCENT (1,%) ON THE RECEIPTS FROM THE SALE AT RETAIL OF ALL TANGIBLE PERSONAL PROPERTY WITHIN THE CITY, WHICH PROPERTY IS SUBJECT TO TAXATION BY THE STATE OF TEXAS UNDER THE PROVISIONS OF THE LIMITED SALES, EXCISE AND USE TAX ACT, AS ENACTED, AND AS HERETOFORE OR HEREAFTER AMENDED." AND WHEREAS, NOTICE OF SAID ELECTION WAS ACTUALLY GIVEN AS REQUIRED BY LAW AND AS DIRECTED IN THE ORDINANCE CALLING THE ELECTION, AS IS SHOWN BY• AFFIDAVITS PROPERLY FILED IN THE OFFICE OF THE CITY SECRETARY; AND WHEREAS, SAID ELECTION WAS DULY AND LEGALLY HELD ON THE 28TH DAY OF SEPTEMBER, 1967, IN CONFORMITY WITH THE ELECTION ORDINANCE HERETOFORE PASSED BY THIS CITY COUNCIL, AND THE RESULT OF SAID ELECTION HAS BEEN CERTI- FIED AND RETURNED TO THIS COUNCIL BY THE PROPER JUDGES AND CLERKS THEREOF; W AND WHEREAS, THIS COUNCIL HAS TODAY CONSIDERED THE RETURNS OF SAID ELEC- TION ON THE PROPOSITION HEREINA80VE STATED, WHICH WAS HELD ON THE 28TH DAY OF SEPTEMBER, 1967; AND WHEREAS, IT APPEARS TO THE COUNCIL, AND THE COUNCIL SO FINDS, THAT SAID ELECTION WAS IN ALL RESPECTS LAWFULLY HELD AND SAID RETURNS DULY AND LEGALLY MADE AND THAT THERE WERE CAST AT SAID ELECTION THE FOLLOWING VOTES: TOTAL VOTES: "FOR ADOPTION OF A ONE PERCENT (1 %) LOCAL 9- �r Z SALES AND USE TAX WITHIN THE CITY." AGAINST ADOPTION OF A ONE PERCENT (1 %) / LOCAL SALES AND USE TAX WITHIN THE CITY." (o AND WHEREAS, THE COUNCIL, HAVING FULLY CHECKED ALL OF THE PROCEDURE RELATIVE TO SUCH ELECTION, AND IT APPEARING TO THE COUNCIL, AND THE COUNCIL SO FINDS, THAT A MAJORITY OF THE LEGALLY QUALIFIED VOTERS OF AND WITHIN THE CITY OF CORPUS CHRISTI VOTING AT SAID ELECTION, VOTED IN FAVOR OF THE ADOPTION OF A ONE PERCENT (1 %) LOCAL SALES AND USE TAX WITHIN THE CITY, AS WAS REFERRED TO IN THE ORDINANCE HERETOFORE PASSED BY THE CITY COUNCIL ORDERING AN ELECTION, AND WHICH ORDINANCE WAS PASSED ON AUGUST 28, 1967: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, HEREBY OFFICIALLY AND AFFIRMATIVELY DECLARES THAT SAID ONE PERCENT (1 %) LOCAL SALES AND USE TAX WITHIN SAID CITY OF CORPUS CHRISTI HAS BEEN PROPERLY AND LAWFULLY ADOPTED IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 1o66c, VERNON'S TEXAS CIVIL STATUTES (ACTS 1967, 60TH LEGISLATURE, REGULAR SESSION, CHAPTER 36, PAGE 62). SECTION 3. THAT THE CITY SECRETARY IS HEREBY AUTHORIZED AND DIRECTED TO TRANSMIT TO THE COMPTROLLER OF PUBLIC ACCOUNTS OF THE STATE OF TEXAS, IN AUSTIN, TEXAS, BY UNITED STATES REGISTERED MAIL, OR BY UNITED STATES CERTIFIED MAIL, A CERTIFIED COPY OF THIS ORDINANCE CANVASSING THE RETURNS OF SPECIAL ELECTION, UNDER THE OFFICIAL SEAL OF THE CITY OF CORPUS CHRISTI, TEXAS, SHOWING THE APPROVAL OF SAID LOCAL SALES AND USE TAX BY THE QUALIFIED VOTERS OF SAID CITY OF CORPUS CHRISTI, TOGETHER WITH A MAP OF SAID CITY OF CORPUS CHRISTI, CLEARLY SHOWING THE BOUNDARIES THEREOF AS OF THE DATE OF SAID ELECTION. SECTION 4. THE FACT THAT SUCH ELECTION HAS BEEN HELD AND THE VOTES COUNTED AND CANVASSED AND THE RESULTS OF THE ELECTION DECLARED IN FAVOR OF ADOPTION OF A ONE PERCENT (1 %) LOCAL SALES AND USE TAX WITHIN THE CITY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT /J FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE !p' P DAY OF SEPTEMBER, 1967.
