HERETO AND MADE A PART HEREOF; APPROPRIATING OUT OF NO.

WATER MAIN RELOCATION ; - AND APPROPRIATING OUT OF NO. 202
WATER SYSTEM BOND FUND THE SUM OF 00 FOR SERVICES
APPLICABLE TO PROJECT NO. 202-59-20, DESIGNATED AS WATER
SYSTEM ENGINEERING STUDIES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE HEREBY IS, AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A
CONTRACT WITH REAGAN AND MCCAUGHAN FOR ENGINEERING SERVICE IN CONNECTION
WITH STUDIES OF THE CORPUS CHRISTI WATER SYSTEM AND /OR DESIGN OF PLANS AND
SPECIFICATIONS RELATED THERETO, A COPY OF WHICH CONTRACT IS ATTACHED HERETO
AND MADE A PART HEREOF.
SECTION 2. THAT THERE IS HEREBY APPROPRIATED OUT OF NO. 220 STREET
BOND FUND THE SUM OF $25,800, FOR SUCH SERVICES AS ARE APPLICABLE TO PROJECT
ND. 220- 56 -98, PADRE ISLAND WATER MAIN RELOCATION; AND THERE IS HEREBY
APPROPRIATED OUT OF NO. 202 WATER SYSTEM BOND FUND THE SUM OF $5,500 FOR
SUCH SERVICES AS ARE APPLICABLE TO PROJECT NO. 202- 59 -28, DESIGNATED AS
WATER SYSTEM ENGINEERING STUDIES.
SECTION 3. THE NECESSITY TO EXECUTE THE ABOVE DESCRIBED CONTRACT
AND APPROPRIATE THE NECESSARY FUNDS FOR THESE ENGINEERING SERVICES, SO THAT
THIS FIRM MAY COMMENCE ITS WORK AS SOON AS POSSIBLE, CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST,

THE CITY OF CORPUS CHRISTI, HEREINAFTER CALLED "CITY ", AND
REAGAN AND MCCAUGHAN, HEREINAFTER CALLED "ENGINEER ", WHETHER ONE OR MORE
AGREE AS FOLLOWS:
1. SERVICES TO BE PERFORMED. THE ENGINEER HEREBY AGREES, AT
HIS OWN EXPENSES TO PERFORM ALL ENGINEERING OR RELATED ARCHITECTURAL
SERVICES NECESSARY TO PROPERLY DEVELOP STUDIES, DESIGNS AND SPECIFICA-
TIONS ON THE FOLLOWING IMPROVEMENTS TO THE WATER DISTRIBUTION SYSTEM IN
CORPUS CHRISTI:
PART I:
ITEM 1 -A: A TRANSMISSION LINE FROM THE 0. N. STEVENS PLANT
TO SOME POINT IN THE DISTRIBUTION SYSTEM TO BE DETERMINED
BY THE CITY COUNCIL AFTER PRELIMINARY STUDY OF ENGINEERS:
ITEM 1 -B: EXTENSION OF A MAIN TO SERVE THE FLOUR BLUFF AREA
THE ROUTE AND LOCATION OF MAIN TO BE EXTENDED TO BE MADE
BY THE CITY COUNCIL AFTER PRELIMINARY STUDY BY ENGINEERS.
ITEM 1 -C:' AN OVERALL STUDY OF THE WATER SYSTEM TO DETERMINE
NECESSARY BASIC CRITERIA FOR ITEMS 1 -A AND 1 -8 AND TO
DETERMINE THE IMMEDIATE MAJOR CAPITAL IMPROVEMENTS WHICH
MIGHT BE NEEDED, INCLUDING TRANSMISSION FACILITIES,
GENERAL CAPACITY OF TREATMENT FACILITIES, MAJOR MAIN
EXTENSIONS AND OVERHEAD OR GROUND STORAGE.
PART 11:
RELOCATION OF WATER LINES IN PADRE ISLAND DRIVE, BEARING IN MIND
THE REQUIREMENTS OF THE TEXAS HIGHWAY DEPARTMENTS ITEM 1 -C SHALL BE ACCOM-
PLISHED FIRST AND ITEMS 1 -A, 1 -B AND PART II TO FOLLOW ONLY ON WRITTEN
AUTHORIZATION FROM THE CITY MANAGER. UNDER PART I, THE SERVICES OF THE
ENGINEER SHALL BE AS SET OUT IN PARAGRAPH 2, WHICH FOLLOWS.
2. SCOPE OF SERVICES - PART I
ENGINEERS SERVICES FOR ITEMS 1-A, 1-8, AND 1 -C WILL BE THOSE SER-
VICES WHICH ARE IN ACCORDANCE WITH THE MANUAL OF ENGINEERING PRACTICE,
GENERAL ENGINEERING SERVICE, AS PUBLISHED IN 1963 BY THE TEXAS SOCIETY OF
PROFESSIONAL ENGINEERS, AND WILL INCLUDE THE FOLLOWING SCOPE OF BASIC SERVICES:
A. IN THE PRELIMINARY PHASE:
(1) CONFERENCES WITH THE PROPER CITY REPRESENTATIVES REGARDING
THE PROPOSED PROJECT.
(2) STUDIES AND REPORTS DIRECTLY RELATED TO AND PART OF
THE WORK BEING CONSIDERED. THESE STUDIES WILL INCLUDE
THE MAIN SUPPLY LINES] TREATMENT PLANT FACILITIES
GROUND STORAGE, AND ELEVATED STORAGE] TOGETHER WITH
OUR RECOMMENDATIONS. THE OVERALL STUDY IN ITEM I -C
WILL BE A GENg RAL REPORT AND REVIEW OF THE SYSTEM
WITH PROJECTION OF NEEDS INTO THE NEAR FUTURE, AND
WILL BE ARRANGED AND PRESENTED FOR MAXIMUM USEFUL -
NESS, THOUGH NOT IN FORMAL MASTER PLAN FORM.
(3) PRELIMINARY LOCATIONS SIZES AND TYPES OF MATERIALS.
(4) PRELIMINARY COST ESTIMATES OF PROPOSED CONSTRUCTION
SUITABLE TO BE USED FOR BOND ELECTION PURPOSES IF
NECESSARY.
(5) THE CITY WILL FURNISH US WITH COPIES OF PLANS OF SUCH
EXISTING FACILITIES AS ARE NECESSARY AND AVAILABLE
WITH OTHER INFORMATION PERTINENT TO THE PLANNING AND
DESIGN.
B. IN THE DESIGN PHASE (FOR WORK AS AUTHORIZED BY THE CITY
(1) FIELD SURVEYS FOR DETAILED PLANS.
(Z) PLANNING ANY SOIL OR SUBSURFACE EXPLORATIONS SPECIAL
LAND BOUNDARY SURVEYS INVOLVING DISPUTES SOIL
CORROSIVITY STUDIES OR RESISTIVITY PROFILES, OR ANY
OTHER SPECIAL SURVEYS AND TESTS WHICH MAY BE REQUIRED
FOR DESIGN] ARRANGING FOR SUCH WORK TO BE DONE DIRECTLY
FOR OWNERS ACCOUNT OR AS OTHERWISE AGREED, AND ENGINEERING
INTERPRETATION OF RESULTS OF SUCH INVESTIGATION.
(3) FURNISHING ENGINEERING DATA NECESSARY FOR PERMFTS REQUIRED
BY LOCAL, STATE AND FEDERAL AUTHORITIES.
(4) PREPARATION OF DETAILED CONTRACT PLANS AND SPECIFICATIONS
FOR CONSTRUCTION, WITH FIVE (5) SETS OF PLANS AND TWENTY -
FIVE (25) SETS OF SPECIFICATJONS AND CONTRACT DOCUMENTS
FURNISHED TO THE CITY. (ADDITIONAL COPIES WILL BE
FURNISHED AS REQUIRED AT ACTUAL COST OF REPRODUCTION.)
(5) PREPARATION OF ESTIMATES OF QUANTITIES AND COSTS.
(6) ASSISTANCE TO THE CITY IN SECURING BIDS.
(7) ANALYSIS OF BIDS AND RECOMMENDATIONS CONCERNING AWARDS.
(8) ASSISTANCE IN AWARD OF CONTRACTS.
C. IN THE CONSTRUCTION PHASE:
(1) CHECKING OF SHOP AND WORKING DRAWINGS FURNISHED BY THE
CONTRACTOR.
(2) SUPERVISION AND REVIEW OF LABORATORY, MILD AND SHOP TESTS.
(3). CONSULTATION WITH THE CITY AND ADVICE DURING CONSTRUCTION.
(4) GENERAL SUPERVISION OF THE WORK AND INTERPRETATION OF THE
PLANS AND SPECIFICATIONS BY PERIODIC VISITS TO THE SITE
BY A PRINCIPAL OF'THE FIRM.

(5) PREPARATION OF MONTHLY AM FINAL ESTIMATES FOR PAYMENTS
TO THE CONTRACTORS.
(6) FINAL INSPECTION.
(7) REVISION OF,THE CONSTRUCTION DRAWINGS TO SHOW THE
PROJECT AS BUILT.
3. FEE PARTS I AND 11
THE BASIC FEE FOR PERFORMING THE BASIC ENGINEERING SERVICES FOR
ITEMS 1 -A AND 1 -8 WILL BE BASED ON A PERCENTAGE OF THE COST OF EACH INDIVIDUAL
CONSTRUCTION CONTRACT AS MAY BE AUTHORIZED BY THE CITY. THE AMOUNT OF THE
PERCENTAGE FOR EACH CONTRACT IS TO BE BASED ON THE AMOUNT OF THE COST OF
EACH INDIVIDUAL CONSTRUCTION CONTRACT IN ACCORDANCE WITH THE FOLLOWING
SCHEDULE:

IN NO CASE IS THE TOTAL
FEE FOR ANY ONE CONSTRUCTION CONTRACT OF
PART I TO BE LESS THAN THE MAXIMUM FEE CALCULATED UNDER THE NEXT LOWER CON-
STRUCTION COST BRACKET. THE FEE FOR ALL SERVICES UNDER PART II SHALL BE A
LUMP SUM AS PROVIDED IN THE LAST PARAGRAPH OF SECTION 4 OF THIS CONTRACT
WHICH SHALL BE CONSIDERED THE BASIC FEE TO BE PAYABLE UPON COMPLETION.
THE FEE FOR SERVICES FOR ITEMS 1 -A AND 1-5 TO BE DUE AND PAYABLE
AS FOLLOWS (SAID SERVICES ABOVE LISTED):
A. IN THE PRELIMINARY PHASE:
FOR SERVICES RENDERED UNDER THE PRELIMINARY PHASE AS
DESCRIBED ABOVE, AN AMOUNT EQUAL TO 20% OF THE BASIC FEE
FOR ITEM 1 -A (TRANSMISSION LINE FROM 0. N. STEVENS PLANT),
AND ITEM 1 -B (EXTENSION OF MAIN TO FLOUR BLUFF) WILL BE DUE
AND PAYABLE. UNTIL RECEIPT OF PROPOSALS FOR EACH OF THESE
TWO CONTRACTS, THE BASIC FEE SHALL BE BASED ON ENGINEER'S
ESTIMATES OF COSTS.
B. IN THE DESIGN PHASE (FOR WORK AS AUTHORIZED BY THE CITY):
FOR SERVICES RENDERED UNDER THE DESIGN PHASE, AS DESCRIBED
ABOVE, AN AMOUNT EQUAL TO 65% OF THE BASIC FEE FOR WORK
AUTHORIZED BY THE CITY SHALL BE DUE AND PAYABLE.

IN THE EVENT THAT PROPOSALS FOR CONSTRUCTION ON THE WORK
ARE RECEIVED AFTER SUBMISSION OF COMPLETE CONTRACT PLANS
AND SPECIFICATIONS TO THE CITY, THE FEE FOR THE SERVICES
RENDERED FOR THE PRELIMINARY AND DESIGN PHASES OF THIS
PORTION OF THE WORK SHALL BE ADJUSTED TO THE "CONSTRUCTION
COST" AS REFLECTED BY THE LOWEST BONA FIDE BID. WHERE
NO PROPOSALS ARE RECEIVED WITHIN A- PERIOD OF 90 DAYS,
THEN THE ENGINEERS ESTIMATES SHALL BE THE BASIS FOR FINAL
PAYMENT FOR SERVICES RENDERED UNDER THE PRELIMINARY AND
DESIGN PHASES.
C. CONSTRUCTION PHASE:
FOR SERVICES RENDERED UNDER THE CONSTRUCTION PHASES AS
DESCRIBED ABOVE AN AMOUNT EQUAL TO I5ro OF THE BASIC FEE
FOR THOSE PORTIONS OF THE WORK COVERED BY CONSTRUCTION
CONTRACTS SHALL BE DUE AND PAYABLE BASED ON MONTHLY
ESTIMATES OF WORK PERFORMED BY THE CONTRACTOR.
D. RESIDENT INSPECTION:
SHOULD THE CITY ELECT, THE SERVICES OF A RESIDENT ENGINEER
AND/OR INSPECTORS FOR CONTINUOUS ON- THE -SITE INSPECTION
DURING CONSTRUCTION WILL BE PROVIDED AT A SALARY COST TIMES
A FACTOR OF 2.0 PLUS REIMBURSEMENT FOR NON -LABOR EXPENSE AND
SUB- CONTRACT EXPENSE AT INVOICE COST PLUS 10%; ALL AS SET
OUT AND DEFINED IN THE MANUAL OF PROFESSIONAL PRACTICE.
E. FEE FOR ITEM 1-C:
A LUMP SUM FEE OF $5,500 WILL BE PAID FOR THE PERFORMANCE
OF THE SERVICES IN ITEM 1-C.
4. SCOPE OF SERVICES - PART 11 - PADRE ISLAND DRIVE RELOCATION
ENGINEER'S SERVICES FOR THE RELOCATION OF THE WATER LINE IN PADRE
ISLAND DRIVE (S.H. 358) WILL BE IN ACCORDANCE WITH THE REQUIREMENTS OF THE
TEXAS STATE HIGHWAY DEPARTMENT FOR THE PREPARATION OF PLANS AND SPECIFI-
CATIONS FOR THE RELOCATION OF THE WATER LINE. THESE SERVICES WILL INCLUDE,
BUT WILL NOT NECESSARILY BE RESTRICTED TO THE FOLLOWING:
A. CONFERENCES WITH THE CITY AND STATE HIGHWAY DEPARTMENT
REPRESENTATIVES.
B. STUDIES RELATED TO AND PART OF THE DESIGN WORK BEING
CONSIDERED.
i C. PRELIMINARY LAYOUTS AND PROFILES, WHERE NECESSARY.
D. PREPARATION OF DETAILED CONTRACT PLANS AND SPECIFI-
CATIONS FOR CONSTRUCTIONS ALL IN ACCORDANCE WITH THE
REQUIREMENTS OF THE STATE HIGHWAY DEPARTMENT FOR INCLUSION
IN THEIR CONTRACTS PLANS AND DOCUMENTS.
E. PREPARATION OF ESTIMATES OF QUANTITIES AND COSTS.
THIS WORK WILL BE DIVIDED INTO TWO SECTIONS. THE FIRST SECTION
ITEM II-A, TO EXTEND FROM NEAR BARRERA DRIVE TO NEAR RICHTER STREETS IS TO
BE PLANNED FIRST AND PLANS ARE DUE BY

THE SECOND SECTIONS ITEM II -B, IS TO EXTEND FROM NEAR RICHTER STREET TO
NEAR RODD FIELD ROAD AND PLANS FOR THIS SECTION ARE SCHEDULED FOR SOME
TIME IN THE SUMMER OR FALL OF 1968. DETAILED PLANS FOR THE SECOND SECTION
CANNOT BE COMMENCED UNTIL HIGHWAY PLANS ARE MORE COMPLETE AND WE WILL
FURNISH SUCH PRELIMINARY ASSISTANCE TO THE CITY AND-HIGHWAY DEPARTMENT AS
MAY BE REQUIRED.
THE ENGINEERING FEE FOR THIS WORK IS DIVIDED INTO THE TWO SECTIONS.
FOR THE FIRST SECTION FROM SARRERA TO RICHTER THE FEE WILL BE A LUMP SUM OF
$10,300, PAYABLE UPON SUBMISSION AND ACCEPTANCE BY BOTH THE CITY AND THE
HIGHWAY DEPARTMENT. FOR THE SECOND SECTION FROM RICHTER TO ROOD FIELD ROAD
THE FEE WILL BE A LUMP SUM OF $15500, ALSO PAYABLE UPON SUBMISSION AND
ACCEPTANCE BY BOTH THE CITY AND THE HIGHWAY DEPARTMENT.
5. TERMINATION OF CONTRACT
THE CITY MAY AT ANY TIME, WITH OR WITHOUT CAUSES TERMINATE THIS
CONTRACT. IN THIS EVENT THE ENGINEER SHALL BE COMPENSATED FOR HIS SERVICE
ON ALL STAGES AUTHORIZED AS FOLLOWS:
A. IF TERMINATION OCCURS PRIOR TO THE FINAL COMPLETION AND
APPROVAL OF THE DRAWINGS AND SPECIFICATIONS, THE ENGINEER
SHALL BE PAID A REASONABLE COMPENSATION FOR THE SERVICES
ACTUALLY RENDERED BY HIM IN ACCORDANCE WITH THE ABOVE
DESCRIBED SCHEDULE OF FEES AND IN PROPORTION TO THE AMOUNT
OF WORK DONE ON SUCH STAGE OR PHASE AS HAVE BEEN AUTHORIZED.
B. IF TERMINATION OCCURS AFTER FINAL COMPLETION AND APPROVAL
OF THE DRAWINGS AND SPECIFICATIONS THE FEE OF THE ENGINEER
SHALL BE 50% OF THE BASIC FEE BASED ON ENGINEERS CONSTRUC-
TION ESTIMATE SUBMITTED WITH THE DESIGN PHASE, PLUS THE FEE
PAID FOR THE PRELIMINARY PHASES LESS THE CREDIT AS AFORE -
DESCRIBED.
C. IF TERMINATION OCCURS AFTER THE LETTING OF THE CONTRACTS BUT
PRIOR TO FINAL COMPLETION OR ACCEPTANCE BY THE CITY, THE FEES
OF THE ENGINEER SHALL BE COMPUTED IN ACCORDANCE WITH THE
PROVISIONS OF PARAGRAPHS 3 AND 4 OF THIS CONTRACT TO THE DATE
OF TERMINATION.
D. THE FOREGOING SHALL NOT BE CONSTRUED TO REQUIRE THE CITY TO
COMPENSATE THE ENGINEER FOR ANY SERVICES NOT PERFORMED IN A
PROPER PROFESSIONAL MANNER SUITABLE FOR USE IN THE CONSTRUC-
TION OF THE PROJECT COMTEMPLATED BY THE PARTIES TO THIS
AGREEMENT.
6. OWNERSHIP OF DOCUMENTS
UPON COMPLETION OF THE PROJECT (OR UPON TERMINATION OF THIS CONTRACT
IF PREVIOUSLY TERMINATED) THE ENGINEER SHALL FURNISH TO THE CITY, IN A SUITABLE

CONTAINER FOR FILING, "AS BUILT" PLANS, REPRODUCED ON LINEN OR PLASTIC
DRAFTING FILM FROM THE ORIGINAL DRAWINGS, TOGETHER WITH A CORRECT AND
LEGIBLE SET OF SPECIFICATIONS.,
7. ASSIGNABILITY.
THE ENGINEER SHALL NOT ASSIGN, TRANSFER OR DELEGATE ANY OF HIS
OBLIGATIONS OR DUTIES IN THIS CONTRACT TO ANY.OTHER PERSON WITHOUT THE
PRIOR WRITTEN CONSENT OF THE CITY, EXCEPT FOR ROUTINE DUTIES DELEGATED TO
PERSONNEL ON THE ENGINEERS STAFF. IF THE ENGINEER IS A PARTNERSHIP, IN
THE EVENT OF THE TERMINATION OF THE PARTNERSHIP, THIS CONTRACT SHALL INURE
TO THE INDIVIDUAL BENEFIT OF SUCH PARTNER OR PARTNERS AS THE CITY MAY
DESIGNATE. NO PART OF THE ENGINEERS FEE MAY BE ASSIGNED IN ADVANCE OF
RECEIPT BY THE ENGINEER WITHOUT WRITTEN CONSENT OF THE CITY.
8. TECHNICAL ASSISTANCE AND CONSULTATIONS.
THE CITY SHALL NOT PAY THE FEES OF EXPERT OR TECHNICAL ASSISTANCE
AND CONSULTANTS UNLESS SUCH EMPLOYMENT, INCLUDING THE RATE OF COMPENSATION,
HAS BEEN APPROVED IN WRITING BY THE CITY.
EXECUTED IN DUPLICATE, EACH OF WHICH SHALL BE CONSIDERED AN ORIGINAL,
