HomeMy WebLinkAbout08671 ORD - 11/22/1967IMS:JKH:11 -22 -67 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, PERTAINING TO SPECIAL USES BY ADDING TO SAID SUBSECTIO 10 PARAGRAPHS "A" THROUGH "N" ALL AS MORE FULLY SET FORTH HEREINAFTER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING CERTAIN AMENDMENTS TO THE TEXT OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY OF CORPUS CHRISTI CITY COUNCIL, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON NOVEMBER 15, 1967, AT REGULAR COUNCIL MEETING OF THE CITY COUNCIL IN THE CITY COUNCIL CHAMBER OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENTS WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE No. 6106, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 29TH DAY OF MARCH, 1961, BE,AND THE SAME IS HEREBY, AMENDED BY MAKING THE CHANGES HEREINAFTER SET OUT. 8671 SECTION 2. THAT ARTICLE 3, SUBSECTION 3 -1.66 OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED TO HEREAFTER READ AS FOLLOWS: "3 -1.66 MOBILE HOME OR TRAILER. A MOBILE HOME OR TRAILER IS A SINGLE - FAMILY DWELLING DESIGNED FOR TRANS- PORTATION, AFTER FABRICATION, ON STREETS AND HIGHWAYS ON ITS OWN WHEELS, OR ON TRUCKS OR OTHER TRAILERS, AND ARRIVING AT THE SITE WHERE IT IS TO BE OCCUPIED AS A DWELLING COMPLETE AND READY FOR OCCUPANCY, EXCEPT FOR MINOR AND INCIDENTAL UNPACKING AND ASSEMBLY OPERATIONS, LOCATION ON JACKS OR PERMANENT FOUNDATIONS, CONNECTION TO UTILITIES AND THE LIKE." SECTION 3. THAT ARTICLE 3 OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 3- 1.66.1, READING AS FOLLOWS: "3- 1.66.1. MOBILE HOME OR TRAILER SUBDIVISION. A SUBDIVISION DESIGNED AND INTENDED FOR RESIDENTIAL USE, WHERE RESIDENCE IS PERMITTED IN MOBILE HOMES OR TRAILER HOUSES, EACH MOBILE HOME BEING LOCATED ON A SEPARATE LOT. SUCH SUBDIVISION COULD RETAIN A CENTRAL MANAGEMENT AND COULD BE OPERATED AS A CONDOMINIUM, RETAINING OWNERSHIP OF STREETS AND COMMON OPEN SPACES." SECTION 4. THAT ARTICLE 3 OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SUBSECTION 3 -1.67 TO HEREAFTER READ AS FOLLOWS: "3 -1.67 MOBILE HOME PARK OR TRAILER PARK. AN AREA OF LAND ON WHICH TWO OR MORE MOBILE HOMES OR TRAILERS, BEING USED FOR LIVING PURPOSES, OCCUPY RENTAL SPACES." SECTION 5. THAT ARTICLE 25, SUBSECTION 25 -4, SUBSECTION (10) OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED TO HEREAFTER READ AS FOLLOWS: -2- • . Ab . . "(10) MOBILE HOME PARKS AND MOBILE HOME SUBDIVISIONS IN ANY DISTRICT EXCEPT THE 'I -3' HEAVY INDUSTRIAL DISTRICT PROVIDED: A. THAT ACCESS TO THE MOBILE HOME OR TRAILER PARK SHALL BE FROM AN ARTERIAL HIGHWAY OR SECONDARY THOROUGHFARE, THAT NUMBER AND LOCATION OF ACCESS DRIVES SHALL BE CON- TROLLED FOR TRAFFIC SAFETY AND PROTECTION OF SURROUNDING PROPERTIES, THAT NO MOBILE HOME OR TRAILER SPACE SHALL BE DESIGNED FOR DIRECT ACCESS TO A STREET OUTSIDE THE BOUND- ARIES OF THE MOBILE HOME OR TRAILER PARK, AND THAT THE INTERIOR ACCESS DRIVES SHALL BE AT LEAST TWENTY —FOUR (24) FEET IN WIDTH. IN A MOBILE HOME SUBDIVISION THE STREETS SHALL MEET ALL CITY REQUIREMENTS AS TO WIDTH, CURBS, AND GUTTERS AS SET FORTH IN THE PLATTING ORDINANCE. B. THE MINIMUM WIDTH ANDAR DEPTH OF THE MOBILE HOME PARK OR SUBDIVISION SHALL BE THREE HUNDRED (300 ) FEET; AND THE MINIMUM TOTAL AREA SHALL BE FIVE (5) ACRES, INCLUDING ONE —HALF (1/2) THE WIDTH OF BORDERING STREETS. C. THE MINIMUM LOT AREA IN A MOBILE HOME SUBDIVI- SION SHALL BE 4,500 SQUARE FEET EXCEPT WHERE A SUBDIVISION IS A CLUSTER DEVELOPMENT (AS DEFINED IN THE PLATTING ORDINANCE)) IN WHICH CASE, THE LOT SIZE MAY BE REDUCED TO 3,000 SQUARE FEET PROVIDED THAT MINIMUM YARD REQUIREMENTS ARE MET AND THAT THERE 15 A MINIMUM OF 1,500 SQUARE FEET PER LOT OF COMMON OPEN SPACE. ALL CORNERS OF EACH MOBILE HOME LOT IN A SUBDIVISION SHALL BE VISIBLY MARKED BY A PERMANENT MARKER. D. IN ADDITION TO THE REQUIREMENTS OF (C) ABOVE, THERE SHALL BE NO MORE THAN TEN (10) MOBILE HOMES PER ACRE IN A MOBILE HOME SUBDIVISION. FURTHERMORE, THERE SHALL BE A MINIMUM FRONT YARD OF TWENTY —FIVE (25) FEET, A MINIMUM REAR YARD OF TEN (10) FEET AND A MINIMUM SIDE YARD OF SIX (H) FEET, WITH A TOTAL UNOBSTRUCTED SIDE YARD REQUIREMENT OF TWENTY (20) FEET. E. THERE SHALL BE NO MINIMUM LOT AREA FOR A MOBILE HOME OR TRAILER SITE IN A MOBILE HOME OR TRAILER PARK, EXCEPT THAT MOBILE HOMES SHALL BE SO HAR- BORED ON EACH SPACE THAT THERE SHALL BE AT LEAST A TWENTY (20) FOOT UNOBSTRUCTED CLEARANCE BETWEEN MOBILE HOMES, PROVIDED HOWEVER, THAT WITH RESPECT TO MOBILE HOMES PARKED END— TO —END I THE END —TO —END CLEARANCE MAY BE LESS THAN TWENTY (20) FEET BUT SHALL NOT BE LESS THAN TEN (10) FEET. NO PART OF A MOBILE HOME OR TRAILER SHALL BE LOCATED CLOSER THAN TWENTY (20) FEET TO ANY BUILDING WITHIN THE PARK NOR CLOSER THAN FIVE (5) FEET TO AN ACCESS DRIVE. F. THE MOBILE HOME PARK SHALL BE SURROUNDED BY A LANDSCAPED STRIP OF OPEN SPACE THIRTY (30) FEET WIDE ALONG THE STREET FRONTAGE WITH AN ARTERIAL HIGHWAY AND FIFTEEN (15) FEET WIDE ALONG ALL OTHER LOT LINES OR STREET FRONTAGE. G. THE REQUIREMENTS OF ITEM (F) ABOVE SHALL ALSO APPLY TO MOBILE HOME SUBDIVISIONS, IN WHICH CASE SUCH LANDSCAPED OPEN SPACE SHALL BE A PART OF -3- ABUTTING LOTS UNLESS OTHERWISE DESIGNATED AS COMMON OPEN SPACE. H. OFF- STREET PARKING SPACES IN MOBILE HOMES OR TRAILER PARKS SHALL BE PROVIDED IN THE RATIO OF ONE (1) SPACE PER TRAILER IN LOCATIONS CON- VENIENT TO INDIVIDUAL TRAILERS OR GROUPS OF TRAILERS. IN MOBILE HOME SUBDIVISIONS THERE SHALL BE AT LEAST ONE (1) PARKING SPACE PER LOT. 1. PROPER PROVISION SHALL BE MADE FOR PUBLIC WATER SUPPLY, SANITARY SEWERS, FIRE PROTECTION, REFUSE COLLECTION, LAUNDRY, TOILET AND BATHING FACILI- TIES) AND ALL SUCH PROVISIONS SHALL BE IN FULL COMPLIANCE WITH THE DEPARTMENT OF PUBLIC WORKS AND THE CITY - COUNTY HEALTH DEPARTMENT. J. A MOBILE HOME PARK MAY BE CONVERTED TO A MOBILE HOME SUBDIVISION PROVIDED IT IS REPLATTED AND THAT ALL CONDITIONS PERTAINING TO MOBILE HOME SUBDIVISIONS ARE MET. K. SINGLE- FAMILY DETACHED DWELLINGS SHALL BE PERMITTED ON LOTS WITHIN A MOBILE HOME SUBDIVISION PROVIDED THE LOT SIZE IS A MINIMUM OF 6,000 SQUARE FEET. L. OUTSIDE LIGHTING SHALL BE ERECTED IN SUCH A MANNER THAT IT NOT BE DETRIMENTAL TO OR PROJECT ONTO ADJACENT PROPERTIES. M. OUTDOOR ADVERTISING SHALL BE RESTRICTED BY THE ZONING DISTRICT IN WHICH THE PARK OR SU501VISION IS SITUATED. N. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO MOBILE HOME OR TRAILER PARKS IN EXISTENCE AND OPERATION IN COMPLIANCE WITH EXISTING ORDINANCES AND LAWS AT THE TIME OF THE PASSAGE OF THIS AMEND - MENT; THEY SHALL BETREATED AS NONCONFORMING USES INSOFAR AS THE REQUIREMENTS OF THIS SECTION ARE CONCERNED.' SECTION 6. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 7. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE C17Y OF CORPUS CHRISTI WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 8. THAT THE NECESSITY OF IMMEDIATELY MAKING THE AFORE- SAID CHANGES FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI, TEXAS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION -4- SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,,AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THEAJ DAY OF NOVEMBER, 1967.
