WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL THAT CERTAIN
SIDEWALK IMPROVEMENTS HERETOFORE PROPOSED TO BE INSTALLED IN CONNECTION
WITH SIDEWALK IMPROVEMENTS UNITS 1, 11 AND III HAVE BEEN INSTALLED BUT
THAT CERTAIN PROPERTIES AFFECTED BY REASON OF THE AFORESAID NOTICES
HERETOFORE FILED WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS, HAVE
NOT BEEN IMPROVED AND THAT SAID ABUTTING PROPERTY AND THE OWNERS THEREOF
SHOULD BE RELEASED FROM SAID NOTICE:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRIST(, TEXAS:
SECTION 1. IT HAS BEEN DETERMINED BY THE CITY COUNCIL THAT THE
INTENT TO ASSESS CERTAIN PROPERTIES IN CONNECTION WITH SIDEWALK IMPROVEMENTS
UNIT 1, AS SET FORTH IN ORDINANCE No. 7455, PASSED AND APPROVED BY THE
CITY COUNCIL ON JANUARY 13, 1965, WILL NOT AT THIS TIME, AND BY VIRTUE
OF SAID ORDINANCE AND PROCEEDINGS, BE PURSUED AS SET FORTH IN THE NOTICE
OF THE CITY SECRETARY FILED IN VOLUME 1068, PAGES 207 -205, DEED RECORDS
OF NUECES COUNTY, TEXAS, ON JANUARY 13, 1965, AS TO THE PROPERTIES ABUTTING
THE FOLLOWING STREETS:

CITY COUNCIL ON OCTOBER 6, 1965, WILL NOT AT THIS TIME, AND BY VIRTUE

AND BY VIRTUE OF SAID ORDINANCE AND PROCEEDINGS, BE PURSUED AS SET FORTH
IN THE NOTICE OF THE CITY SECRETARY FILED IN VOLUME 1181, PAGES 404-406,

SECTION 4. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED
TO EXECUTE, FOR AND ON BEHALF OF THE CITY, A GENERAL RELEASE OF ALL
PROPERTIES ABUTTING ON THE ABOVE DESCRIBED STREETS, AND THE OWNERS THEREOF
AFFECTED BY REASON OF THE NOTICES AFORESAID, FILED IN THE OFFICE OF THE
COUNTY CLERK UNDER DATES OF JANUARY 13, 1965, OCTOBER 6, 1965 AND NOVEMBER
23, 1966, RESPECTIVELY.
SECTION 5. THE FACT THAT THE PROPERTIES ABUTTING ON THE HEREIN -
ABOVE DESCRIBED STREETS HAVE NOT BEEN IMPROVED AND THE FURTHER FACT THAT
THE PROPERTIES ABUTTING SAID STREETS ARE PRESENTLY ENCUMBERED AS A RESUL
OF THE AFORESAID NOTICES AND SHOULD BE RELEASED AS PROMPTLY AS POSSIBLE
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING
THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST,
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT
