AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE, FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT FOR
THE PURCHASE OF NINETEEN (19) BUSES FOR $363,185.57,
FROM GENERAL MOTORS CORPORATION; EXTENDING THE
DELIVERY DATE; APPROPRIATING THE SUM OF $177,813
FROM GENERAL FUND NO. 101E FOR TRANSFER TO THE TRANSIT
SYSTEM BOND FUND NO. 218 AND PROVIDING FOR POSSIBLE
REIMBURSEMENT THEREOF; APPROPRIATING THE SUM OF
$363,185.57 FROM TRANSIT SYSTEM BOND FUND NO. 218
FOR SAID PURCHASE PRICE AND EXPENSES INCIDENTAL TO
OBTAINING SAID BUSES; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY DESIRES TO PURCHASE NINETEEN (19) 35 - PASSENGER
AIR - CONDITIONED BUSES AS PART OF ITS TRANSIT SYSTEM IMPROVEMENT PROGRAM;
AND
WHEREAS, THE CITY AND THE DEPARTMENT OF HOUSINGAND URBAN DEVELOP-
MENT (HUD) HAVE ENTERED INTO CONTRACT No. H -768 FOR PROJECT TEX —UTG -3 FOR
HUD PARTICIPATION IN SUCH PROJECT UP TO A MAXIMUM OF 1704,000; AND
WHEREAS, BIDS WERE RECEIVED ON AUGUST 91 1967 FOR SAID PURCHASE
OF 19 BUSES; AND
WHEREAS, THE CITY COUNCIL BY MOTION ON AUGUST 16, 1967 APPROVED
I THE AWARD TO THE LOW AND ONLY BIDDER, GENERAL MOTORS CORPORATION (GMC)
SUBJECT To HUD CONCURRENCE IN THE AWARD AND WRITTEN NOTIFICATION OF TWO -
THIRDS PARTICIPATION; AND I
WHEREAS, HUD APPROVAL OF THE AWARD WAS RECEIVED ON SEPTEMBER 5,
1967; AND
WHEREAS, THE CITY HAS TAKEN ALL KNOWN STEPS TO QUALIFY FOR
TWO- THIRDS HUD PARTICIPATION IN ELIGIBLE PROJECT COSTS, AND ALTHOUGH HUD
HAS AGREED TO ONLY 5010 PARTICIPATION AT THIS TIME; AND
WHEREAS, WC HAS BEEN READY TO MEET ITS DELIVERY SCHEDULE OF
NOVEMBER 15, 1967, AND HAS BEEN DELAYED FROM THIS SCHEDULE BECAUSE THE CONDI-
TIONS OF THE AWARD HAD NOT BEEN MET BY THE CITY AND HUD:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION I. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
TO EXECUTE, FOR AND ON BEHALF OF THE CITY, A CONTRACT FOR THE PURCHASE OF

NINETEEN (19) 35- PASSENGER BUSES FROM GMC FOR A TOTAL CONSIDERATION OF
$363,185.57•
SECTION 2. THAT THE DELIVERY DATE OF NOVEMBER 15, 1967,SUBMITTED
BY GMC IN ITS BID OPENED ON AUGUST 9, 1967, BE EXTENDED TO JANUARY 15,
1968.
SECTION 3. THAT THERE IS HEREBY APPROPRIATED THE SUM OF
$177,813 OUT OF THE UNAPPROPRIATED BALANCE OF THE GENERAL FUND No. 104
FOR TRANSFER TO TRANSIT SYSTEM BOND FUND No. 218 TO BE REPAID WHEN, AND
ONLY WHEN, ADDITIONAL RESOURCES ARE MADE AVAILABLE BY HUD's APPROVAL OF
TWO- THIRDS PARTICIPATION OR BY THE SALE OF USED BUSES BY THE CITY.
SECTION 4. THAT THERE IS HEREBY APPROPRIATED THE SUM OF
$363,185.57 OUT OF TRANSIT SYSTEM BOND FUND N0. 218 FOR THE PURCHASE
OF THE AFORESAID BUSES AND FOR EXPENSES INCIDENTAL TO OBTAINING SAID
BUSES. SAID SUM HEREIN APPROPRIATED SPECIFICALLY INCLUDES $181,592.78
TO BE RECEIVED FROM HUD AS 50%u PARTICIPATION IN THE PURCHASE OF THE
AFORESAID BUSES UNDER CONTRACT No. H -768.
SECTION 5. THE URGENT NEED TO IMPROVE TRANSIT SERVICES
THROUGH THE USE OF AIR- CONDITIONED DEPENDABLE EQUIPMENT AND THE NEED TO
REDUCE MAINTENANCE COSTS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT
SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THE SUSPENSION OF
THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE
AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED,
THIS THE 27TH DAY OF DECEMBER, 1967.
