CITY SERVICE; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY ",
BEING ORDINANCE 8127, PASSED AND APPROVED BY THE CITY
COUNCIL ON AUGUST 3, 1966 AS AMENDED, BY AMENDING
SECTION 7, SUBSECTIONS s AND (c) THEREOF, BY SUBSTI-
TUTING NEW SUBSECTIONS �a AND (c); PROVIDING A SEVERANCE
CLAUSE; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT ORDINANCE N0. 5127, PASSED AND APPROVED BY THE
CITY COUNCIL ON AUGUST 3, 1966, AS AMENDED, BE AND THE SAME IS HEREBY
AMENDED BY AMENDING SECTION 7, SUBSECTIONS (B) AND (C) OF SAID ORDINANCE,
TO HEREAFTER READ AS FOLLOWS:
"(B) OVERTIME COMPENSATION. FULL -TIME HOURLY PAID EMPLOYEES,
EMPLOYEES IN POSITIONS OF CLASSES IN GRADE 22 AND BELOW IN THE LABOR AND
TRADES GROUP, AND ALL POSITIONS IN THE POLICE AND FIRE SERIES EXCEPT
POLICE AND FIRE CHIEFS, SHALL BE PAID FOR AUTHORIZED OVERTIME WORK AT
THE RATE OF ONE AND ONE -HALF TIMES THE REGULAR RATE, PROVIDED THAT SUCH
RATE FOR POSITIONS IN THE FIRE SERIES WITH SCHEDULED WORK WEEKS OTHER
THAN YO HOURS SHALL BE COMPUTED ON THE BASIS OF 208 HOURS PER MONTH.
COMPENSATORY TIME OFF EQUAL TO THE ACTUAL HOURS OF OVERTIME MAY BE GRANTED
BY THE DEPARTMENT HEAD CONCERNED AT THE REQUEST OF THE EMPLOYEE. ALL OTHER
EMPLOYEES IN POSITIONS OF CLASSES IN GRADE 22, EQUIPMENT OPERATOR IVES,
ENGINEERING DESIGN PERSONNEL, AND BELOW SHALL BE COMPENSATED FOR AUTHORIZED
OVERTIME WORK BY BEING GRANTED EQUAL TIME OFF; PROVIDED THAT THE CITY
MANAGER MAY AUTHORIZE PAYMENT AT THE REGULAR SALARY RATE FOR OVERTIME IN
CASES WHEN THE GRANTING OF EQUAL TIME OFF 15 NOT PRACTICAL. OTHER SALARIED
OFFICERS AND EMPLOYEES IN POSITIONS OF GRADE 23 OR ABOVE SHALL NOT BE ELI-
GIBLE FOR REGULAR OVERTIME COMPENSATION AS PROVIDED ABOVE, BUT MAY BE
GRANTED COMPENSATORY TIME OFF IN UNUSUAL CASES WHEN AUTHORIZED BY THE CITY

MANAGER, EXCEPT UPON AUTHORIZATION OF THE CITY MANAGERS OVERTIME MAY BE
PAID ON A STRAIGHT TIME BASIS FOR WORK PERFORMED UNDER CONTRACTS WITH
THE FEDERAL GOVERNMENT FOR CIVIL DEFENSE PURPOSES.
,if \ Cl OVERTIME ADMINISTRATION. WHERE THE NEED FOR OVERTIME WORK
TO BE COMPENSATED IN CASH CAN BE ANTICIPATED2 AND ALL OVERTIME WORK IN-
VOLVING EQUIPMENT OPERATOR IVS AND ENGINEERING DESIGN PERSONNELS AUTHORITY
TO GRANT SUCH OVERTIME SHALL BE REQUESTED BY THE DEPARTMENT HEAD CONCERNED
AND APPROVED IN ADVANCE BY THE CITY MANAGER. IN UNFORESEEN EMERGENCIES2
THE DEPARTMENT HEAD MAY AUTHORIZE OVERTIME WORK TO BE COMPENSATED IN CASH
WHEN HE DEEMS IT ESSENTIAL TO THE PROPER CONDUCT OF THE DEPARTMENT OPERA-
TIONS. IN ALL SUCH CASES2 PROPER REPORT WITH JUSTIFICATION SHALL BE MADE
TO THE CITY MANAGER AS PRESCRIBED IN ADMINISTRATIVE INSTRUCTIONS OF THE CITY
MANAGER. THE ALLOCATION OF FUNDS TO A DEPARTMENT OR UNIT IN ANTICIPATION
OF EMERGENCY OVERTIME PAYMENTS SHALL NOT CONSTITUTE AUTHORITY FOR OVERTIME
WORK PER SE. DEPARTMENT OR DIVISION HEADS MAY AUTHORIZE OVERTIME WORK TO
BE COMPENSATED BY EQUAL TIME OFF WITHOUT APPROVAL OR OF REPORT TO THE CITY
MANAGER.
"IN THE CASE OF EMPLOYEES WHO ARE COMPENSATED FOR OVERTIME WORK
BY EQUAL TIME OFF, DETAILED RECORDS SHALL BE MAINTAINED BY EACH DEPARTMENT
OF OVERTIME WORK AND COMPENSATORY TIME OFF GRANTED EACH EMPLOYEE. ACCRUAL
FOR TIME OFF PURPOSES SHALL NOT EXCEED FIFTEEN (15) WORKING DAYS AT ANY
TIME. IN THE EVENT OF TERMINATION, COMPENSATION FOR TIME ACCRUED COMPEN-
SATORY TIME SHALL NOT EXCEED FIFTEEN (15) DAYS."
SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPHS SUBDIVISION,
CLAUSES PHRASE OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALIDp IT
SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE
CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE.
SECTION 3. THE EFFECTIVE DATE OF THE ABOVE CHANGES SHALL BE
.JANUARY 26, 1968.
SECTION 4. THE FACT THAT THERE IS AN IMMEDIATE NEED TO PROVIDE
OVERTIME COMPENSATION FOR CERTAIN NEW CLASSES AND A NEED TO MAINTAIN AN
EFFICIENT ADMINISTRATION OF CITY AFFAIRS CREATES A PUBLIC EMERGENCY AND

AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY SO ORDAINED, THIS THE __Iq_DAY OF FEBRUARY, 1968.

SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
