AN ORDINANCE
APPROVING AND ADOPTING THE WRITTEN STATEMENT AND
REPORT OF THE DIRECTOR OF PUBLIC WORKS, SHOWING
THE ESTIMATES OF THE TOTAL COSTS OF ALL THE IM-
PROVEMENTS, THE ESTIMATES OF THE COST PER FRONT
FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING
PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF,
FOR THE CONSTRUCTION OF SIDEWALKS ON THE HEREIN-
AFTER NAMED STREETS IN THE CITY OF CORPUS CHRISTI,

THE ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF;
DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST
SAID ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS
THEREOF, FOR THE PORTION OF SAID COST APPORTIONED TO THEM;
ORDERING AND SETTING A HEARING AT 3 O'CLOCK P.M., ON THE
13TH DAY OF MARCH, 1968, IN THE COUNCIL CHAMBER OF THE
CITY HALL OF CORPUS CHRISTI, TEXAS, AS THE TIME AND PLACE
FOR THE HEARING OF THE REAL AND TRUE OWNERS OF SAID ABUTTING
PROPERTY AND ALL OTHERS INTERESTED IN SAID ABUTTING PROPERTY
OR IN ANY OF THE PROCEEDINGS CONCERNING SAID ASSESSMENTS AND
IMPROVEMENTS; DIRECTING THE CITY SECRETARY OF THE CITY OF
CORPUS CHRISTI, TEXAS, TO GIVE NOTICE OF SAID HEARING AS
REQUIRED BY LAW; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, HEREBY FINDS AND DETERMINES:

OF FEBRUARYS 1968) DETERMINED THE NECESSITY FOR AND ORDERED THE CONSTRUC-
TION OF SIDEWALKS ON THE HEREINAFTER NAMED STREETS IN THE CITY OF CORPUS
CHRISTI, TEXAS WITHIN THE LIMITS DEFINED:
1. CARROLL LANE - GOLLIHAR ROAD TO SOUTH STAPLES STREET,
EAST SIDE ONLY;

WHICH SAID PLANS AND SPECIFICATIONS HAVE HERETOFORE BEEN APPROVED AND
ADOPTED BY THE CITY COUNCIL.
(B) THAT A NOTICE DULY ENACTED IN THE NAME OF THE CITY OF CORPUS
CHRISTI, TEXASj OF THE ENACTMENT OF SAID ABOVE DESCRIBED ORDINANCE, HAS
HERETOFORE BEEN FILED WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS, THE
COUNTY IN WHICH THE CITY OF CORPUS CHRISTI IS SITUATED, AND SUCH NOTICE
HAS BEEN DULY RECORDED IN THE DEED OF TRUST RECORDS OF NUECES COUNTY,
TEXAS.
(C) THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI' TEXAS,
HAS CAUSED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE ESTIMATES OF
THE COSTS OF SUCH IMPROVEMENTS AND ESTIMATES OF THE AMOUNT PER FRONT FOOT
TO BE ASSESSED AGAINST THE PROPERTY ABUTTING SAID SIDEWALKS; AND THE
DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATE-
MENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCIL, AND THE

SAME HAVING BEEN RECEIVED, EXAMINED AND APPROVED BY SAID CITY COUNCIL; AND
THAT IN ACCORDANCE WITH SAID STATEMENT OF THE ESTIMATE 50 FILED BY THE
DIRECTOR OF PUBLIC WORKS AND HEREIN APPROVED, THE AMOUNT OF SAID ESTI-
MATED COSTS ARE HEREIN APPROVED, AND THE AMOUNT OF SAID ESTIMATED COSTS
ARE HEREINAFTER STATED AND SET OUT AND A SCHEDULE CONTAINED IN SECTION 2
HEREOF.
SECTION 2. THE WRITTEN STATEMENT AND REPORT OF THE DIRECTOR
OF PUBLIC WORKS HERETOFORE FILED WITH THE CITY COUNCIL, SHOWING THE ESTI-
MATED TOTAL COSTS OF THE CONSTRUCTION OF SAID SIDEWALKS, SHOWING THE AMOUNTS
PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING PROPERTY AND
AGAINST THE REAL AND TRUE OWNERS THEREOF FOR SAID IMPROVEMENTS, SHOWING
TOTAL ESTIMATED COST OF THE CONSTRUCTION OF SAID SIDEWALKS PROPOSED TO
BE ASSESSED AGAINST AND PAID TO THE CITY OF CORPUS CHRISTI BY THE ABUTTING
PROPERTY AND THE REAL AND TRUE OWNERS THEREOF TO REIMBURSE THE SAID CITY
FOR A PORTION OF THE COSTS OF SAID IMPROVEMENTS AND SHOWING THE TOTAL
ESTIMATED COST OF SAID IMPROVEMENTS, HAVING BEEN RECEIVED AND EXAMINED BY
THE CITY COUNCIL SAID REPORT AND THE ESTIMATES THEREIN SHOWN ARE HEREBY
IN ALL THINGS APPROVED AND ADOPTED; AND IT IS HEREBY FOUND AND DETERMINED
BY THE SAID CITY COUNCIL THAT THE ESTIMATED COSTS OF SAID IMPROVEMENTS

This project shall be knows as "Sidewalk Improvements, Unit IV ",
consisting of the construction of concrete and shell sidewalks on the
following streets:
Carroll Lane - Gollihar Road to S. Staples Street - east side only
McArdle Road - Everhart Road to Dody Street - south side only
Nueces Bay Boulevard - Up River Road to I. H. 37 - south side only
Sonora Street - Blake Street to Port Avenue - north side only
Ruth Street - Francesca Street to Harmon Street - north side only
14th Street - 52' N of Elizabeth St. to 450' S of McKenzie St. - south side only
Fairview Drive - Up River Road to Fairfax Drive - west side only
Buford Street - Brownlee Blvd. to 10th Street - north side only
Commanche - 19th Street to Port Avenue - south Bide only
Colonial Court - Fairview Drive to Old Robsto-on Road - north side only
Guatemozin - Morgan St. to Hildalgo Street - east side only

The assessment rates have been determined by calculating the unit
bid price on 4' wide, 4" thick reinforced concrete sidewalk as applied
to the front footage of the abutting properties:
4' wide 4" thick reinforced sidewalk @ $1.55 per front foot
5' wide 4" thick reinforced sidewalk @ $1.94 per front foot
Credits have been issued for existing sidewalk in suitable condition
and location to permit present and future use.

SECTION 3. THE COST OF SAID IMPROVEMENTS SHALL BE PAID AS
FOLLOWS, TO -WIT:
(A) THE CITY SHALL REIMBURSE ITSELF FOR NOT MORE THAN 800
OF THE COST OF THE IMPROVEMENTS BY ASSESSMENT AGAINST THE RESPECTIVE
ABUTTING PROPERTIES AND THE REAL AND TRUE OWNERS THEREOF IN ACCORDANCE
WITH THE PROVISIONS OF SAID ARTICLE 11058, VERNON'S TEXAS CIVIL STATUTES.
NO ASSESSMENTS SHALL BE MADE AGAINST ANY ABUTTING PROPERTY OR THE REAL
AND TRUE OWNERS THEREOF FOR COSTS IN EXCESS OF THE BENEFITS TO SUCH PROPERTY
IN ENHANCED VALUE THEREOF BY MEANS OF SUCH IMPROVEMENTS. THE AMOUNTS OF
SUCH ASSESSMENTS SHALL CONSTITUTE A FIRST AND PRIOR LIEN UPON ALL SUCH
PROPERTIES AND A PERSONAL LIABILITY OF THE REAL AND TRUE OWNERS THEREOF,
WHETHER NAMED OR CORRECTLY NAMED OR NOT. ASSIGNABLE CERTIFICATES IN EVI-
DENCE OF THE ASSESSMENTS SO LEVIED SHALL BE ISSUED IN FAVOR OF THE CITY OF
CORPUS CHRISTI FOR THE AMOUNT OF THE ASSESSMENT. SAID PAYMENTS SHALL BE
PAYABLE IN MONTHLY INSTALLMENTS OF NOT EXCEEDING TWENTY -FOUR (24) IN
NUMBER, SAID PAYMENTS TO BE MADE AT THE CITY HALL IN THE CITY OF CORPUS
CHRISTI, NUECES COUNTY, TEXAS, THE FIRST OF WHICH SHALL BE PAYABLE WITHIN
THIRTY (30) DAYS FROM THE DATE OF THE COMPLETION OF SAID IMPROVEMENTS AND
THEIR ACCEPTANCE BY THE CITY OF CORPUS CHRISTI, AND ONE INSTALLMENT EACH
MONTH THEREAFTER UNTIL PAID, WITH INTEREST THEREON AT THE RATE OF SIX AND
ONE -HALF PERCENT (E -1/2%) PER ANNUM' PAST DUE PRINCIPAL AND INTEREST TO
BEAR INTEREST AT THE SAME RATE. PROVIDED, HOWEVER, THAT THE OWNERS OF
ANY OF SAID PROPERTIES SHALL HAVE THE PRIVILEGE OF PAYING ALL OR ANY OF
SAID INSTALLMENTS AT ANY TIME BEFORE MATURITY THEREOF BY PAYING THE TOTAL
AMOUNT OF PRINCIPAL OF SUCH INSTALLMENT TOGETHER WITH INTERESTACCRUED
THEREON DOWN TO THE DATE OF PAYMENT. THE OWNERS OF ANY OF SAID PROPERTY
MAY PAY THE TOTAL AMOUNT ASSESSED AGAINST THEM AND THEIR PROPERTY WITHOUT
INTEREST WITHIN THIRTY (30) DAYS AFTER THE COMPLETION AND ACCEPTANCE OF
SAID IMPROVEMENTS. IF DEFAULT BE MADE IN THE PAYMENT OF ANY OF SAID
INSTALLMENTS OF PRINCIPAL OR INTEREST, PROMPTLY AS IT MATURES, THEN AT
THE OPTION OF THE CITY OF CORPUS CHRISTI, OR ITS ASSIGNS, THE ENTIRE
AMOUNT OF THE ASSESSMENT UPON WHICH DEFAULT IS MADE, TOGETHER WITH
REASONABLE ATTORNEYS FEES AND ALL COLLECTION COSTS, IF INCURRED, SHALL
BE AND BECOME IMMEDIATELY DUE AND PAYABLE.

SECTION 4. A HEARING SHALL BE HAD AND GIVEN TO THE REAL AND TRUE
OWNERS OF, AND ALL OWNING OR CLAIMING ANY INTEREST IN ANY PROPERTY ABUTTING
UPON SAID SIDEWALKS, AND TO ALL OTHERS OWNING, OR CLAIMING ANY INTEREST IN
SAID PROPERTY OR ANY OF SAID MATTERS, AS TO THE ASSESSMENTS AND AS TO THE
AMOUNT TO BE ASSESSED AGAINST EACH PARCEL OF ABUTTING PROPERTY, AND THE
REAL AND TRUE OWNERS THEREOF, AND AS TO THE SPECIAL BENEFITS, IF ANY, TO
SAID PROPERTY TO BE RECEIVED BY SAID IMPROVEMENTS, AND CONCERNING ANY
ERROR, INVALIDITY, IRREGULARITY OR DEFICIENCY IN ANY PROCEEDING OR CONTRACT
WITH REFERENCE THERETO OR CONCERNING ANY MATTER OR THING CONNECTED THERE-
WITH, WHICH HEARING SHALL BE HELD BY THE CITY COUNCIL OF CORPUS CHRISTI,
TEXAS, IN THE COUNCIL CHAMBER OF THE CITY HALL IN THE CITY HALL OF THE
CITY OF CORPUS CHRISTI, TEXAS, AT 3:00 O'CLOCK P.M., ON THE 13TH DAY OF
MARCH, 1968, AT WHICH TIME AND PLACE ALL PERSONS, FIRMS, CORPORATIONS
OR ESTATES OWNING OR CLAIMING ANY SUCH ABUTTING PROPERTY, OR ANY INTEREST
THEREIN, AND THEIR AGENTS OR ATTORNEYS, AND PERSONS INTERESTED IN SAID
PROCEEDINGS, SHALL BE NOTIFIED TO APPEAR AND BE HEARD IN PERSON, OR BY
COUNSEL, AND MAY OFFER EVIDENCE; AND SAID HEARING MAY BE ADJOURNED FROM
DAY TO DAY AND FROM TIME TO TIME AND KEPT OPEN, UNTIL ALL EVIDENCE AND
PROTESTS HAVE BEEN DULY OFFERED AND HEARD; AND THE CITY SECRETARY OF THE
CITY OF CORPUS CHRISTI, TEXAS, IS HEREBY DIRECTED TO GIVE NOTICE OF SAID
HEARING BY PUBLICATION OF NOTICE IN SOME NEWSPAPER OF GENERAL CIRCULATION
IN THE CITY OF CORPUS CHRISTI, TEXAS; SAID NOTICE SHALL BE PUBLISHED AT

SECTION 5. FOLLOWING SUCH HEARING AS ABOVE PROVIDED ASSESS-
MENTS WILL BE LEVIED AGAINST SAID ABUTTING PROPERTY AND THE REAL AND
TRUE OWNERS THEREOF FOR THAT PORTION OF THE COSTS OF SAID IMPROVEMENTS
HEREINABOVE DETERMINED TO BE PAYABLE BY SAID ABUTTING PROPERTY ANDTHE
REAL AND TRUE OWNERS THEREOF, WHICH ASSESSMENTS SHALL BE A FIRST AND
PRIOR LIEN UPON SAID ABUTTING PROPERTY AND A PERSONAL LIABILITY AND
CHARGE AGAINST THE REAL AND TRUE OWNERS THEREOF. IN LEVYING SAID ASSESS-
MENTS, IF THE NAME OF THE OWNER BE UNKNOWN, IT SHALL BE SUFFICIENT TO

SECTION 6. EACH PORTION OF SAID STREETS HEREINABOVE DESCRIBED
AND DESIGNATED BY UNIT NUMBERS CONSTITUTES A SEPARATE AND INDEPENDENT
UNIT OF THE IMPROVEMENTS AND SHALL BE IMPROVED AND THE IMPROVEMENTS CON-
STRUCTED THEREIN AS SEPARATE AND INDEPENDENT FROM EACH AND EVERY OTHER
UNIT OF SAID STREETS, AND THE ASSESSMENTS TO BE LEVIED FOR SAID IMPROVE-
MENTS IN EACH UNIT OR PORTION OF SAID STREETS SHALL BE ALTOGETHER SEPARATE
AND DISTINCT AND INDEPENDENT OF AND FROM THE ASSESSMENTS TO BE LEVIED IN
EVERY OTHER OF SAID UNITS AND PORTIONS OF SAID STREETS, AND, IN MAKING
AND LEVYING SAID ASSESSMENTS AGAINST THE PROPERTY ABUTTING UPON ONE OF
SAID UNITS, NO MATTER OR CIRCUMSTANCE IN CONNECTION WITH ANY OTHER OF SAID
UNITS SHALL BE CONSIDERED OR HAVE ANY EFFECT UPON THE OTHER, ALL AS FULLY
AND TO THE SAME EXTENT AS IF SEPARATE PROCEEDINGS AND CONTRACTS HAD BEEN
HAD AND EXECUTED WITH REFERENCE TO THE IMPROVEMENTS TO BE MADE IN EACH
OF SAID UNITS.

SECTION 7. THE NEED FOR THE CONSTRUCTION OF SAID SIDEWALKS WITHOUT
(FLAY CREATES AN EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUS-
PENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLU-
TION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING
REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE
IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
