AN ORDINANCE
APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF
$1,551, OF WHICH AMOUNT $1401 IS FOR LAND ACQUISITION COSTS
AND X150 13 FOR TITLE EXPENSES AND RELATED COSTS OF CLOSING,
IN CONNECTION WITH THE ACQUISITION OF PARCELS 36 AND 4,
EVERHART ROAD PADRE ISLAND DRIVE TO HOLLY ROAD RIGHT OF
WAY. BEING PROJECT NO. 220-61-89; AUTHORIZING AND DIRECTING
THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS,
FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE
OWNERS OF THE AFORESAID PARCELS, WHEN AND ONLY WHEN THE
PURCHASE PRICE IS WITHIN THE "APPROVED VALUE" AS DETERMINED
BY THIS ORDINANCE; AMID DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THERE 15 HEREBY APPROPRIATED OUT OF ND. 220 STREET
BOND FUND THE SUM OF $1551, OF WHICH AMOUNT $1401 IS FOR THE LAND ACQUISI-
TION COSTS AND $150 IS FOR TITLE EXPENSES AND RELATED COSTS OF CLOSING, IN
CONNECTION WITH ACQUISITIONS OF PARCELS 313 AND 4, PROJECT N0. 22o- 67-89,
EVERHART ROAD, PADRE ISLAND DRIVE TO HOLLY ROAD, RIGHT OF WAY, SAID PARCELS
BEING MORE FULLY DESCRIBED AS FOLLOWS, TO -WIT:

TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES

SECTION 2. THAT THE CITY MANAGER 13 HEREBY AUTHORIZED AND DIRECTED
TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, REAL ESTATE
SALES CONTRACTS WITH THE OWNERS OF THE AFORESAID PARCELS OR TRACTS OF LAND
WHEN AND ONLY WHEN THE SALES CONTRACTS ARE FOR AN AMOUNT OF MONEY WITHIN
THE "APPROVED VALUE" AS DETERMINED BY THIS ORDINANCE, THE OWNERS OF PARCEL
36 BEING JOSEPH V. LEVEK AND WIFE, AND THE OWNERS OF PARCEL 4 BEING ROY SMITH
AND WIFE.
SECTION 3. THE NECESSITY TO APPROPRIATE THE HEREINABOVE DESCRIBED
FUNDS AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY INSTRUMENTS
TO ACQUIRE SAID PROPERTY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH PUBLIC EMERGENCY AND NECES-
SITY TO EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND
THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND

I CERTIFY TO THE CITY COUNCIL THAT THE MONEY REQUIRED FOR
THE CONTRACTS AGREEMENT, OBLIGATIONS OR EXPENDITURE CONTEMPLATED IN
THE ABOVE AND FOREGOING ORDINANCE IS IN THE TREASURY OF THE CITY OF
CORPUS CHRISTI TO THE CREDIT OF N0. 220 -67 -89
Everhart Road, Padre Island Drive to Holly Road, $1,551.00
FUND FROM WHICH IT IS PROPOSED TO BE DRAWN AND SUCH MONEY IS NOT
APPROPRIATED FOR ANY OTHER PURPOSE.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
