AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A CONTRACT WITH ASPHALT PAVING COMPANY FOR CONSTRUC-
TION OF STREET IMPROVEMENTS ON PORTIONS OF TARLETON,
COLEMAN AND MITCHELL STREETS, PROJECT NO. 22o- 67 -99;
APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM
OF 126.000. 0, OF WHICH $117,807.50 IS FOR THE CON-
STRUCTION CONTRACT AND $8,192.50 IS FOR CONTINGENCIES
AND INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY�AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A
CONTRACT WITH ASPHALT PAVING COMPANY FOR CONSTRUCTION OF STREET IMPROVEMENTS
ON PORTIONS OF TARLETON, COLEMAN AND MITCHELL STREETS, PROJECT NO. 220- 67 -99,
SAID CONSTRUCTION TO CONSIST OF A RESIDENTIAL TYPE PAVING WITH HOT -MIX
ASPHALTIC CONCRETE SURFACE, EXCAVATIONS, CURBS, GUTTERS, SIDEWALKS, DRIVEWAYS,
STORM SEWERS AND APPURTENANCES, ALL AS IS MORE FULLY SET OUT IN THE PLANS
AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY
SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING
TO THE BID OF ASPHALT PAVING COMPANY OPENED ON THE 7TH DAY OF FEBRUARY, 1968,
THE SAID BID OF ASPHALT PAVING COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS
TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 220 STREET
BOND FUND THE SUM OF $126,000.00, OF WHICH AMOUNT $117,507.50 IS FOR THE
CONSTRUCTION CONTRACT AND $5,192.50 IS FOR CONTINGENCIES AND INCIDENTAL
EXPENSES.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE AFORE-
SAID CONTRACT AND THE APPROPRIATION OF THE NECESSARY FUNDS TO PROVIDE A
MODERN TRAFFIC FACILITY AS PETITIONED FOR BY PROPERTY OWNERS CREATES A
PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING

DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH
CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT
FROM AND AF R lTS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE

APPROPRIATED FOR ANY OTHER PURPOSE.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCES A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
