REEVES AND LURA V. TURNER, AND MRS. ETTA NESBITT, FOR CHANGE OF ZONING FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "A -2" APARTMENT HOUSE DISTRICT ON THE EAST 290 FEET OF THE FORMER LOT 17, BLOCK 2, ALAMEDA ESTATES, AND FOR CHANGE OF ZONING FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "A -2" APARTMENT HOUSE DISTRICT ON THE EAST 200 FEET OF THE FORMER LOTS 15 AND 16, BLOCK 2, ALAMEDA ESTATES, NOW APPEARING AS LOT "E ", ALAMEDA CENTER UNIT II, FILED FOR RECORD IN VOLUME 33, PAGE 85, OF THE MAP OR PLAT RECORDS OF NUECES COUNTY, TEXAS, ON JANUARY 17, 1968; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATIONSOF FLOYD A. REEVES AND LURA V. TURNER, AND MRS. ETTA NESBITT, FOR AN AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE CHANGE OF ZONINGFOR FLOYD A. REEVES AND LURA V. TURNER BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON JUNE 6, 1967, AT SPECIAL COUNCIL MEETING IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE CHANGE OF ZONING FOR MRS. ETTA NESBITT BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON JULY 5, 1967, AT REGULAR COUNCIL MEETING IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENTS WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: 835 • • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGES HEREINAFTER SET OUT. SECTION 2. THAT THE ZONING ON THE EAST 290 FEET OF THE FORMER LOT 17, BLOCK 2, ALAMEDA ESTATES, REQUESTED BY FLOYD A. REEVES AND LURA V. TURNER, AND THE ZONING ON THE EAST 200 FEET OF THE FORMER LOTS 15 AND 16, BLOCK 2, ALAMEDA ESTATES, REQUESTED BY MRS. ETTA NESBITT, NOW APPEARING AS LOT "E ", ALAMEDA CENTER UNIT 11, FILED FOR RECORD IN VOLUME 33, PAGE 85, OF THE MAP OR PLAT RECORDS OF NUECES COUNTY, TEXAS, ON JANUARY 17, 1968, BE, AND THE SAME IS HEREBY, CHANGED FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "A -2" APARTMENT HOUSE DISTRICT. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 14. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGES FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF -2- CORPUS CHRISTI TEXAS j/ 7 DAY OF TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI TEXAS • FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCES A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS 1, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT 15 INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUNCIL. This letter is to serve as our agreement that we do, in fact, know that the ordinance is subject to this requirement and do further state that the fence will in fact be constructed simultaneously with the apartment project. I would further like to state that we understand that the City Officials will not issue an official certificate of occupancy until such time as the fence is in fact constructed. The building plans which you have in your possession outline the exact location of the fence to be constructed and it should be easily understood between both parties where and upon what terms the fence will be constructed. It is my understanding that with the addition to your file of this letter the owners of thic property can have a building permit issued and con- struction can start on the property.
