HomeMy WebLinkAbout08839 ORD - 04/17/19680JKH:4-15 -68 r • .1, , TEXAS: AN ORDINANCE GRANTING A REVOCABLE EASEMENT AND AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A REVOCABLE EASEMENT TO HUMBLE OIL & REFINING COMPANY, A CORPORA- TION, HAVING ITS OFFICE IN NUECES COUNTY, TEXAS, TO PLACE ONE 8" GAS LINE STRAPPED TO A 2" GLYCOL LINE IN A 16" CONDUIT CROSSING GRAHAM ROAD AT APPROXIMATELY 1203 FEET WEST OF LAGUNA SHORES ROAD AND ONE 6" GAS LINE STRAPPED TO A 2" GLYCOL LINE AND A 2" OIL LIN 1N_A j6" CONDUIT CROSSING LAGUNA SHORES ROAD AT APPROXI- MATELY 1210 FEET SOUTH OF PADRE ISLAND DRIVE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION I. THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE AND DELIVER TO HUMBLE OIL & REFINING COMPANY, A CORPORATION HAVING AN OFFICE AND PLACE OF BUSINESS IN CORPUS CHRISTI, NUECES COUNTY, TEXAS, A REVOCABLE EASEMENT TO INSTALL ONE 8" GAS LINE STRAPPED TO A 2" GLYCOL LINE IN A 16" CONDUIT CROSSING GRAHAM ROAD AT APPROXIMATELY 1203 FEET WEST OF LAGUNA SHORES ROAD AND ONE 8" GAS LINE STRAPPED TO A 2" GLYCOL LINE AND A 2" OIL LINE IN A 16" CONDUIT CROSSING LAGUNA SHORES ROAD AT APPROXIMATELY 1210 FEET SOUTH OF PADRE ISLAND DRIVE, AS MORE FULLY SET OUT IN THE REVOCABLE EASEMENT ATTACHED HERETO AND MADE A PART HEREOF, UPON THE PAYMENT OF THE FEE PROVIDED THEREIN. SECTION 2. THE NECESSITY FOR COMMENCEMENT OF CONSTRUCTION OF THE AFORESAID PIPELINES AT THE LOCATIONS ABOVE DESCRIBED CREATES A PUBLIC EMER- GENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT IT TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS / / J DAY OF APRIL, 1968. �'_t- YR THE CITY OF CORPUS CHRISTI, TEXAS li839 0 SBR:mk THE STATE OF TEXAS X X 10019 ALL MEN BY THESE PRESENTS: COUNTY OF NUECES X 451934 • THAT the City of Corpus Christi_, Texas, acting by and through its duly authorized City Manager, R. Marvin Townsend, for and in consideration of the sum of One Hundred Fifty Dollars ($150.00) to it in hand paid by Humble Oil & Refining Company, a private corporation, organized, existing and doing business under the laws of the State of Delaware, and having an office and place of business in Corpus Christi, Nueces County, Texas, the receipt of which is hereby acknowledged and confessed, has GRANTED, SOLD AND CONVEYED, and by these presents does grant, sell and convey, upon the conditions hereinafter stated, unto the said Humble Oil & Refining Company the right to lay, construct, operate, maintain, repair and remove three (3) pipelines under Laguna Shores Road (an 8" and two 2" strapped together) and two (2) pipelines under Graham Road (an 8" and a 2" strapped together) for the transportation of glycol, oil, gas and /or other hydrocarbons, the pipelines at each crossing to be placed in a sixteen inch (1611) steel conduit, said crossings are across roads in the City of Corpus Christi, Nueces County, Texas, to -wit: 1. Location of the crossing of Laguna Shores Road is indicated on the attached plat SWE -A -2939. 2. Location of the crossing of Graham Road is indicated on the attached plat SWT -A -2938. TO HAVE AND TO HOLD the same unto the said Humble Oil & Refining Company, its successors and assigns, together with the right and privilege at any and all times to enter upon the above strip of land for the purpose of constructing and maintaining the said pipelines for transportation of glycol, oil, gas and /or other hydrocarbons at said locations, and it is further understood that the foregoing easement and right is granted upon the following conditions: • . • (a) It is understood and agreed that the right and ease- ment herein granted may be revoked at any time by the City of Corpus Christi, Texas. (b) Grantee will save and keep harmless the City of Corpus Christi, Texas, from any and all claims for liability by reason of the construction of said pipelines, or the operation, maintenance or existence thereof. (c) Grantee will repair or cause to be repaired any damage to any street, storm sewer, drainage facility, City water lines, or gas lines, and any City sewers by reason of the construction of said pipelines and the operation and maintenance thereof. (d) All rights granted hereby shall be subordinate to all uses by the City and shall upon notice by the City be made to conform to such other uses as the City may make of such street for public use. Two (2) maps, plats and engineering drawings have been filed in the office of the City Director of Public Works showing all details of installation and construction, including depth of installation proposed to conform and comply with City requirements of such office as to engineering specifications as follows: (1) Sixteen.inch (16 ") welded steel conduit will be used at each crossing and extend across each street the full width of right of way, being 61' on Laguna Shores Road and 97' on Graham Road. (2) Line to be laid by boring under right of way. (3) Grantee to adjust or relocate pipelines, if neces- sary, for construction of public utilities or other facilities. (4) Markers of line to be furnished and maintained at each side of Laguna Shores Road and Graham Road by Grantee.
