HomeMy WebLinkAbout08842 ORD - 04/17/1968JKH:4 -17 -68 j • AN ORDINANCE DECLARING TERMINATION OF THE INTENT TO ASSESS CERTAIN PROPERTY IN CONNECTION WITH SIDEWALK IMPROVEMENTS, UNIT IV, PASSED AND APPROVED BY THE CITY COUNCIL ON FEBRUARY 21, 1968, BY ORDINANCE NO. 8767, AND THE NOTICE OF THE CITY SECRETARY FILED IN THE OFFICE OF THE COUNTY CLERK OF NUECES COUNTY, TEXAS, ON FEBRUARY 21, 1968, IN VOLUME 1258, PAGE 41, DEED RECORDS OF NUECES COUNTY, TEXAS; AUTHORIZING THE CITY MANAGER TO EXECUTE A GENERAL RELEASE OF ALL PROPERTY ABUTTING ON THE FOLLOWING STREETS AFFECTED BY REASON OF SAID NOTICE, IN CONNECTION WITH THE SAID IMPROVEMENTS: 1. BELTON STREET, MCARTHUR TO S.H. 286; 2. HORNE ROAD, FROM ONE —HALF BLOCK EAST OF GREENGROVE TO AYERS STREET; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, F TEXAS: SECTION 1. IT HAS BEEN DETERMINED BY THE CITY COUNCIL THAT THE INTENT TO ASSESS CERTAIN PROPERTIES IN CONNECTION WITH SIDEWALK IMPROVEMENTS UNIT IV, AS SET FORTH IN ORDINANCE No. 8767, PASSED AND APPROVED BY THE CITY COUNCIL ON FEBRUARY 21, 1967, WILL NOT AT THIS TIME, AND BY VIRTUE OF SAID ORDINANCE AND PROCEEDINGS, BE PURSUED AS SET FORTH IN THE NOTICE OF THE CITY SECRETARY, FILED IN VOLUME 1258, PAGE 41, DEED RECORDS OF NUECES COUNTY, TEXAS, ON FEBRUARY 21, 1967, AS TO THE PROPERTIES ABUTTING SAID STREETS AS FOLLOWS: n 1. BELTON STREET, MCARTHUR TO S.H. 286; 2. HORNE ROAD, FROM ONE —HALF BLOCK EAST OF GREENGROVE TO AYERS STREET. SECTION 2. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY, A GENERAL RELEASE OF ALL PROPERTIES ABUTTING ON THE ABOVE DESCRIBED STREET, AND THE OWNERS THEREOF AFFECTED BY REASON OF THE NOTICE AFORESAID, FILED IN THE OFFICE OF THE COUNTY CLERK UNDER DATE OF FEBRUARY 21, 1968. SECTION 3. THE NECESSITY TO IMMEDIATELY RELEASE THE PROPERTIES AND THE OWNERS THEREOF AS TO THOSE PROPERTIES ABUTTING THE HEREINABOVE DESCRIBED STREETS, OR PORTIONS THEREOF, SO THE PROPERTIES WILL NO LONGER BE ENCUMBERED BY SAID NOTICE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO 5842 ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE,THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _L7_ DAY OF APRIL, 1968.
