BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH KING CONSTRUCTION COMPANY FOR CONSTRUCTION OF COLE PARK AND MOODY - GREENWOOD PARK IMPROVEMENTS, THE COLE PARK IMPROVEMENTS TO CONSIST OF PARKING LOTS AND ACCESS ROADS AND THE MOODY - GREENWOOD IMPROVEMENTS TO CONSIST OF CONSTRUCTION OF A BASKETBALL COURT, DESIGNATED AS PROJECT NO. 291 -67 -6, SAID CONSTRUCTION BEING MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF KING CONSTRUCTION COMPANY OPENED ON THE 17TH DAY OF APRIL, 1968, THE SAID BID OF KING CONSTRUCTION COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 291 PARK BOND FUND THE SUM OF $60,000, OF WHICH $55,995.15 IS FOR THE CONSTRUCTION CONTRACT AND $4,004.15 IS FOR THE CONTINGENCIES AND INCIDENTAL EXPENSES, APPLICABLE TO PROJECT NO. 291 -67 -6; AND THERE IS HEREBY REAPPROPRIATED OUT OF N0. 102 GENERAL FUNDS CURRENTLY BUDGETED IN PARK CONSTRUCTION ACTIVITY NO. 4121, THE SUM OF $5,000, OF WHICH $4,595.00 IS FOR CONSTRUCTION CONTRACT, AND $405 IS FOR INCIDENTAL EXPENSES AND CONTINGENCIES APPLICABLE TO THE MOODY - PARK IMPROVEMENTS. 1185V 0 . 1� 0 SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE AFORE- SAID CONTRACT AND THE APPROPRIATION AND REAPPROPRIATION OF THE NECESSARY FUNDS TO PROVIDE IMPROVEMENTS FOR COLE PARK AND MOODY- GREENWOOD PARK CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFE T FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF APRIL, 1968. Activity 4121 -Code 502 = $5.000.00 Fund from which it is proposed to be drawn, and such money is not appropriated for any other purpose.
