A RESOLUTION
REQUESTING THE BAY DRILLING COMMITTEE UNDER SPECIAL
CHAIRMANSHIP OF LENFORD K. WILLIAMS TO STUDY THE
PROBLEM OF ITS SALT WATER WASTE DISPOSAL FROM OIL
AND GAS WELLS, WITHIN THE CITY OF CORPUS CHRISTI;
OUTLINING THE DUTIES OF THE COMMITTEE AND THANKING
THE COMMITTEE FOR ITS UNDERTAKING OF THE PROJECT;
AND DECLARING AN EMERGENCY.
WHEREAS, RAILROAD COMMISSION ORDER N0. 4- 56,681 BECAME EFFECTIVE
MAY 1, 1968. IT PROHIBITS THE USE OF OPEN PITS AND THE LIKE, IN NUECES
COUNTY, TEXAS FOR DISPOSAL OF OIL AND GAS WELL PRODUCED SALT WATER.
EXEMPTIONS TO THIS ORDER ARE NOW BEING GRANTED TO A NUMBER OF OPERATORS
WITHIN THE CITY LIMITS OF CORPUS CHRISTI, FOR THE PURPOSE OF DELIVERING
THE PRODUCED WATER TO THE GARRISON DRAINAGE SYSTEM AND OTHER DRAINAGE
FACILITIES FOR FINAL DISPOSAL INTO O50 BAY THROUGH OSO CREEK, SAID EXEMP-
TIONS BEING SUBJECT TO GRANTING OF EASEMENTS BY THE CITY AND COUNTY AND
ARE TO BE REVIEWED ON A YEAR -TO -YEAR BASIS; AND
WHEREAS, IN ORDER TO PERMIT CONTINUED PRODUCTION WITHIN THE
CITY LIMITS, THE CITY 15 GRANTING REVOCABLE EASEMENTS FOR EACH WELL WHICH
PRODUCES SALT WATER AND FOR WHICH THE OPERATOR HAS MADE PROPER APPLICATION
SHOWING HIS RAILROAD COMMISSION EXEMPTION, INSURANCE COVERAGE AND THE PAY-
MENT OF A $25 PER WELL FEE. THESE REVOCABLE EASEMENTS ARE GRANTED FOR AN
INTERIM PERIOD OF TIME AND EXPIRE DECEMBER 31, 1968. THIS INTERIM PERIOD
IS CONSIDERED NECESSARY TO STUDY AND REVIEW THE MATTER IN AN ATTEMPT TO
DETERMINE WHETHER SOME OTHER PROCEDURE IS MORE DESIRABLE AND/OR ADVISABLE;
AND
WHEREAS, THE CITY COUNCIL HAS DETERMINED THAT THE MEMBERS OF THE
BAY DRILLING COMMITTEE, WHICH COMMITTEE WAS FORMED TO ADVISE ON PETROLEUM
DRILLING AND PRODUCTION MATTERS IN THE BAY AREAS OF THE CITY, IS IN FACT
THE BEST QUALIFIED GROUP TO MAKE THIS STUDY AND DETERMINATION FOR THE CITY
AND THE OIL AND GAS INDUSTRY:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. AS A SPECIAL STUDY, THIS COMMITTEE IS HEREBY REQUESTED
TO STUDY THE OVERALL PROBLEM OF OIL AND GAS WELL PRODUCED SALT WATER DISPOSAL

WITHIN THE CORPORATE LIMITS INTO DITCHES OWNED OR CONTROLLED BY THE CITY.
THIS STUDY SHOULD INCLUDE REVIEW OF EXISTING CONDITIONS TO DETERMINE WHETHER
ALTERNATE SYSTEMS ARE FEASIBLE AND ADVISABLE FOR THE HANDLING OF THIS PRO-
DUCED SALT WATER. IN ORDER TO MAKE IT POSSIBLE TO REVIEW THE COMMITTEE
FINDINGS AND PREPARE POSSIBLE NECESSARY REGULATIONS PRIOR TO THE EXPIRA-
TION ON DECEMBER 31, 1968 OF THE PRESENT PERMITS, IT IS REQUESTED THAT THE
COMMITTEE SUBMIT ITS FINDINGS AND /OR RECOMMENDATIONS ON OR ABOUT
NOVEMBER 1, 1968;
BE IT FURTHER RESOLVED THAT BECAUSE EDWARD HARTEy CHAIRMAN OF
THE BAY DRILLING COMMITTEEI HAS ADVISED THAT HE WILL BE UNABLE TO CHAIR
ALL OF THE ANTICIPATED MEETINGS CONSIDERED NECESSARY TO MAKE THIS STUDY
MR. LENFORD K. WILLIAMSy OF ATLANTIC RICHFIELD COMPANY AND A MEMBER OF
THE COMMITTEE, IS HEREBY APPOINTED CHAIRMAN OF THE COMMITTEE FOR THE PURPOSE
OF MAKING THIS SPECIAL STUDY ONLY;
BE IT FURTHER RESOLVED THAT THE SPECIAL COMMITTEE BE AND IS HERE-
BY AUTHORIZED TO MAKE SUCH INVESTIGATION, HOLD SUCH HEARINGS AND MAKE SUCH
REPORTS AS IT DETERMINES TO BE USEFUL TO FULLY INFORM THE COUNCIL OF THE
PROBLEMS INVOLVED AND RECOMMEND A SOLUTION OR SOLUTIONS AS WOULD BE FAIR
TO THE PUBLIC AND THE OPERATORS. THE COOPERATION OF CITY EMPLOYEES AND
ASSISTANCE OF THE CITY PETROLEUM SUPERINTENDENT IS AVAILABLE AT THE REQUEST
OF THE COMMITTEE. THIS EXTRA SERVICE OF THE MEMBERS OF THE COMMITTEE FOR
THIS PURPOSE IS APPRECIATED.
SECTION 2. THE IMPORTANCE OF REQUESTING THE BAY DRILLING COMMITTEE
UNDER THE SPECIAL CHAIRMANSHIP OF LENFORD K. WILLIAMS TO STUDY THE PROBLEM
OF ITS SALT WATER WASTE DISPOSAL FROM OIL AND GAS WELLS WITHIN THE CITY OF
CORPUS CHRISTI, AND TO OUTLINE THE DUTIES OF THE COMMITTEE, CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCILS AND THE MAYOR
HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXISTy AND HAVING REQUESTED

ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
