HomeMy WebLinkAbout08908 ORD - 06/19/1968VMP:6/19/68 TEXAS: AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH BLUCHER AN NAISMITH FOR ENGINEERING SERVICES FOR THE DEVELOPMENT OF A MASTER DRAINAGE PLAN FOR THE FLOUR BLUFF AND WESTERN AREAS OF THE CITY, DESIGNATED AS PROJECT NO. 295- 67 -57; APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUNS THE SUM OF $23,000, OF WHICH AMOUNT $20,500 IS FOR THE ENGINEERING CONTRACT AN $2,500 IS FOR INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH BLUCHER AND NAISMITH FOR ENGINEERING SERVICES FOR THE DEVELOPMENT OF A MASTER DRAINAGE PLAN FOR THE FLOUR BLUFF AND WESTERN AREAS OF THE CITY, DESIGNATED AS PROJECT N0. 295- 67 -57, A COPY OF WHICH ENGINEERING CONTRACT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 295 STORM SEWER BOND FUNDS THE SUM OF $23,000, OF WHICH AMOUNT $20,500 IS FOR THE ENGINEERING CONTRACT AND $2,500 IS FOR INCIDENTAL EXPENSES. SECTION 3. THE NECESSITY FOR IMMEDIATE COMMENCEMENT OF WORK ON MAKING COMPREHENSIVE STUDIES AND PREPARING A MASTER DRAINAGE PLAN FOR THE FLOUR BLUFF AND WESTERN AREAS OF THE CITY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AN APPROVED, THIS THE DAY OF JUNE, 1968. O 0 ATTEST: A6 .4 MA oR Io1 1Em THE CITY OF US CHRISTI, TEXAS CITY ECRETAR APPROVED: THIS 19 DAY OF JUNE, 1968: CITY ATT RN Y M 1 E CONTRACT FOR ENGINEER'S SERVICES THE STATE OF TEXAS COUNTY OF NUECES The City of Corpus Christi, hereinafter called "City ", and Blucher and Naismith, Inc., hereinafter called "Engineer ", whether one or more, agree as follows: 1. SERVICES TO BE PERFORMED. The Engineer hereby agrees,`at his own expense, to perform all engineering, investigation and related testing and report preparation necessary to properly analyze and study the storm drainage areas as stated below as Area 1 and Area 2. of A. The services of the Engineer shall include but shall not be limited to the following: j+vj . Item 1. Study and analyze the storm drainage of area designated Area 1 and Area 2. This will include use of•plan and topographic information on the study areas as furnished by the City on Cronar transparencies and required on -site visual in- spection of existing conditions. Item 2. Prepare a preliminary report on storm drainage of both areas indicating general recommended drainage pattern and•recommended first -stage improvements. Item 3. Prepare a final report which will include one set of planimetric maps at the same scale as the map information furnished by the City, on Cronar film a with drafting in ink showing subdivided drainage areas, indicated flow quantities, suggested flow line of ditches and other drainage structures, expected quantities of runoff and other related information. Item 4. - Prepare as a part of the final report an outline of the.analysis procedure followed, particular informa- tion on individual drainage area's, suggested solu- tions for special drainage and structural problems, and conclusions., s ` B. Not included in the services of the Engineer are the following: Making duplicate - original on film of topography and planimetric work as furnished by the City, making necessary working prints,,make reduced scale negatives F and blue:line prints for the final report, printing of the final report including collating and binding. The Engineer will direct and coordinate this work for the account =of the.City, if so instructed. ` C. For the, purposes of the above, Drainage Area 1 and Area 2 are r °• as described below: Area 1. That area commonly known as Flour Bluff, limited on the north by the U.S. Government property (Naval Air Station), on the west by Oso Creek, on the south by the King Ranch fence, and on the east by the Laguna Madre., Area 2. That area between the Nueces River and Nueces Bay on the north, the existing city limit line on the south and west, the boundary of the previous study area on the south and east, but not including the Flour Bluff area as outlined above. 2. FEES. The City will pay to the Engineer a fee of Twenty Thousand Five Hundred and no /100 Dollars ($20,500.00), which includes the entire performance of the services outlined above. The fees provided in this paragraph shall constitute complete compensation for all services which Engineer agrees to perform in this contract and said fee shall be payable as follows: A. Upon delivery to City and acceptance by City of the prelim- inary detailed drainage system, $5,000.00. B. Upon completion of Area 1 (Flour Bluff), and acceptance by Engineer and Director of Public Works of City of Corpus Christi, $5,000.00. C. Upon completion of Area 2 (Western Area), and acceptance by Engineer and Director of Public Works of City of Corpus Christi, $5,000.00. D. Upon completion of all work and submission of final report to satisfaction of City, $5,500.00. 3. TERMINATION OF CONTRACT. The City may at any time, with or without cause, terminate this contract. In the event of termination by the City, the Engineer shall be compensated for his services as follows: A. The Engineer shall be paid reasonable compensation for services actually rendered by him but in no event more than the fee for that particular phase of the work A. B, C or D. respectively, as the Engineer may be engaged in performing at the time of termination, in accordance with all payments provided in Paragraph 2 above. B. The foregoing shall not be construed to require the City to compensate the Engineer for any services not performed in a proper professional manner. C. If the Engineer should be unable to complete this contract due to death, illness, or any other cause beyond his reasonable control, he or his estate shall be compensated in the manner set forth above. 4. TECHNICAL ASSISTANCE AND CONSULTATIONS. The City shall not pay the fees of expert or technical assistants and consultants unless such employment, including the rate of compensation, has been approved in writing by the City. -2- r 5. TIME AND ORDER OF ENGINEER'S SERVICES. The Engineer shall furnish the documents and personally render or provide the services required by this contract in such sequence and at such times as may be necessary to insure the timely completion of the study. The Engineer agrees to furnish the preliminary studies for approval of the City not later than April 15, 1969, and to furnish the completed report ready for printing and binding no later than June 15, 1969. 6. ASSIGNABILITY. The Engineer shall not assign, transfer or delegate any of his obligations or duties in this contract to any other person without the prior written consent of the City, except for routine duties delegated to personnel on the Engineer's staff. If the Engineer is a partnership, in the event of the termination of the partnership, this contract shall inure to the individual benefit of such partner or partners as the City may designate. No part of the Engice er's fee may be assigned in advance of receipt by the Engineer without written consent of the City. 7. OWNERSHIP OF DOCUMENTS. Upon the completion of the project (or upon the termination of this contract, if previously terminated), the Engineer shall furnish to the City, in a suitable container for filing, the original tracing, or reproductions, on linen or equivalent, showing all field changes, from which reproductions may be made, of all designs and drawings. Box 1622 Corpus Christi, Texas 78403 SUBJECT: Drainage study for Flour Bluff and Western part of the City Dear Mr. Lantos: We appreciate your invitation to submit a proposal for the preparation of a master drainage plan for the area of our City commonly known as Flour Bluff and that portion of the City west of Clarkwood Road, which areas were not included in the master drainage study which we prepared in 1961 . It is our understanding that the City presently has available on cronar transparencies plan and topographic information on the area to be studied and that this information would be furnished for our use. In accordance with our conference of June 5 we propose to perform all necessary engineering work including required on -site visual inspection of existing conditions to properly analyze and study the storm drainage of the areas designated Area 41 and Area 42 as outlined below. Upon completion of the investigation and study we will prepare and present a final report which will include one (1) set of planimetiic maps at a scale equal to the scale of the existing City topography on cronar film with drafting in ink showing subdivided drainage areas, indicated flow quantities, suggested flow lines of ditches and other drainage structures, expected quantities of runoff for design storm, and other related information. We will also furnish bound copies of our final report which will outline the procedure followed, give particular information on individual drainage areas, give suggestions for solution for special drainage and structural problems, and give such conclusions as we feel warranted. The form of the report will be similar to the original report. Our fee for this proposed work would be: Area �1 - That area commonly known as Flour Bluff, limited on the north by the U. S. Government property (Naval Air Station), on the west by Oso Creek, on the south by the King Ranch fence, and on the east by the Laguna Madre. $ 7,500.00 6 -7 -68 Page -2- Area #2 - That area between the Nueces River and Nueces Bay on the north, the existing city limit line on the south and west, the boundry of the previous study area on the wouth and east, but not including the Flour Bluff area as outlined above. $ 13,000.00 This proposal does not include the cost of printing, binding and reproduction. We would be happy to handle this necessary work and bill the expense directly to the City of Corpus Christi or let the City handle the printing expense as a separate item. We estimate the cost of making duplicate originals on film of the topography and planimetric work, the cost of making necessary working prints, reduced negatives and blueline prints for the final report, printing of the final report, collating and binding would be about $ 2,200.00 for 25 bound sets. We would propose that payment for services rendered be made on a bi- monthly basis based on an estimate as to percentage completion of the total work as agreed upon between ourselves and the City. We would further suggest that our previous contract dated July 7, 1960, be used as a basis for the general contractural terms, specifically with regard to items 3, 4, 5, 6 and 7. We feel that we could complete this study in eight (8) calendar months.
