HomeMy WebLinkAbout08916 ORD - 07/03/1968AN ORDINANCE APPROVING AND ADOPTING THE DIRECTOR OF PUBLIC WORKS' WRITTEN STATEMENT AND REPORT OF THE ESTIMATES OF THE VARIOUS COSTS FOR STREET IMPROVEMENTS ON NORTH STAPLES STREET, -FROM KINNEY AVENUE TO I.H. 37, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; DETERMINING AND FIXING THE PORTION OF SAID COSTS TO BE PAID BY AND ASSESSED AGAINST ABUTTING PROPERTY, THE PORTION THEREOF TO BE PAID BY THE CITY OF CORPUS CHRISTI, TEXAS; DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING PROPERTY; ORDERING AND SETTING A HEARING TO BE HELD ON AUGUST 7, 1968, TO GIVE NOTICE OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE OF TEXAS AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, HERETOFORE ON THE 3RD DAY OF JULY, 1968, BY DULY ENACTED ORDINANCE DETER- MINED THE NECESSITY FOR AND ORDERED THE IMPROVEMENT OF THE PORTION OF NORTH STAPLES STREET, FROM KINNEY AVENUE TO I.H. 37, A DULY EXECUTED NOTICE OF SAID ORDINANCE HAVING THEREAFTER BEEN FILED IN THE NAME OF THE CITY WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS; AND �p WHEREAS, PURSUANT TO THE ORDINANCE OF JULY 3, 1968, ABOVE MENTIONED, AND AFTER HAVING ADVERTISED FOR AND RECEIVED BIDS ON THE CON- STRUCTION OF SAID IMPROVEMENTS FOR THE LENGTH OF TIME AND IN THE MANNER AND FORM AS REQUIRED BY THE CHARTER OF SAID CITY AND THE LAWS OF THE STATE OF TEXAS, THE CITY HAS DULY AND REGULARLY MADE APPROPRIATION OF FUNDS AVAILABLE FOR SAID PURPOSE TO COVER THE ESTIMATED COST TO SAID CITY OF SAID IMPROVEMENTS; AND WHEREAS, THE SAID CITY COUNCIL HAS CAUSED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE ESTIMATES OF THE COSTS OF SUCH IMPROVEMENTS AND ESTIMATES OF THE AMOUNT PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE PROPERTY ABUTTING SAID STREET TO BE IMPROVED, AND THE REAL AND TRUE OWNERS THEREOF, AND SAID DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATEMENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCIL, AND THE SAME HAVING BEEN RECEIVED AND EXAMINED BY SAID CITY COUNCIL; AND WHEREAS, IN ACCORDANCE WITH SAID STATEMENT OF ESTIMATES AND OTHER MATTERS PREPARED AND FILED BY SAID DIRECTOR OF PUBLIC WORKS HEREIN APPROVED 8916 BY SAID CITY COUNCIL, THE TOTAL ESTIMATED COST OF THE WHOLE IMPROVEMENT OF THE AFORESAID STREETS, WITHIN THE LIMITS HEREINABOVE DEFINED, 15 $14o,o66.15. THAT THE TOTAL ESTIMATED AMOUNT OF THE COST OF SAID IMPROVEMENTS TO THE FOREGOING STREET PROPOSED TO BE ASSESSED AGAINST THE ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS THEREOF IS $84,914.98; THE TOTAL ESTIMATED AMOUNT OF THE COST OF SAID IMPROVEMENTS TO THE FORE- GOING STREETS WITHIN THE LIMITS ABOVE DEFINED AND PROPOSED TO BE PAID BY THE CITY OF CORPUS CHRISTIIS $55,151.17; AND WHEREAS, ACCORDING TO SAID WRITTEN STATEMENT OF SAID DIRECTOR OF PUBLIC WORKS, THE NAMES OF THE APPARENT OWNERS OF SAID ABUTTING PROPERTY, THE DESCRIPTION OF THEIR PROPERTY, THE NUMBER OF FRONT FEET OWNED BY EACH, THE ASSESSEMENT RATES IN SQUARE AND LINEAL FEET, THE AMOUNT PROPOSED TO BE ASSESSED AGAINST EACH ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS THEREOF AND OTHER MATTERS CONTAINED IN STATEMENT ARE AS FOLLOWS, TO -WIT: -2- TO: THE MAYOR AND CITY COUNCIL FROM: DIRECTOR OF PUBLIC WORKS This project No. 220 -61 -50 is titled North Staples Street Improvements from Kinney to Interstate Higliway 37. This project is to be contracted by excavating to a width and depth to permit the laying of standard six inch curb and gutter section, the installa- tion of a pavement consisting of compacted sub - grade, twelve inches of com- pacted caliche base, a prime coat, 2-2 inches of type "A" Asphaltic concrete 12 inches of type "D" Asphaltic concrete surface, for a total width of sixty feet measured from the back of the curbs. Also to be constructed on this project: one reinforced concrete side- walk, five feet wide, four inches thick, tied to the back of the curb, concrete driveways as needed and as required by property owners, and storm sewers as needed to drain the street. All utilities shall be adjusted where required to properly facilitate the street construction. Assessment rates have been determined by using the unit prices taken from the low bid submitted in 1963, and also the revised unit prices as agreed upon by contractor and city,by change order. The revised unit prices resulted due to the increased or decreased scope of work as shown on the approved plans. These rates were applied to the front footage of the abutting properties as follows: 1. Property zoned or used other than R -1 or R -2 and a street width of 60 feet B.B. Curb, gutter and pavement $16.34 p.lf. 2. Property zoned or used other than R -1 or R -2 and a street width of 41 feet B.B. Curb, gutter and pavement 11.64 p.lf. 3. Edge Thickening .43 p.lf. 4.
