HomeMy WebLinkAbout08938 ORD - 07/17/1968THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the / day of July, 1968, the City until of the City of Corpus Christi, Texas, convened in Q2,Meeting, with the following members of said Council esent, to -wit: Jack R. Blackmon Mayor V. A. Bradley, Jr. P. Jimenez, Jr., M. D. Gabe Lozano, Sr. Commissioners Ken McDaniel W. J. Roberts Ronnie Sizemore T. Ray Kring City Secretary with the following absent: constituting a quorum, at which time the following among other business was transacted: Mr. Blackmon, Mayor, presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council a communication in writing pertaining to said proposed ordinance, as follows: "Corpus Christi, Texas July /—Z, 1968 "TO THE CITY COUNCIL Corpus Christi, Texas Gentlemen: The public importance and pressing need for the permanent improvements to be constructed by use of the proceeds of the bonds voted at the election held on July 13, 1968, create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring ordinances to be considered and voted upon at three regular meetings. I, therefore, request that the City Council pass the proposed ordinance 8938 canvassing the returns and declaring the result of the election for the issuance of said bonds as an emergency measure. You will please consider this request in con - nection with the ordinance which has been introduced in the City Council on this subject. Yours very truly, /s/ Jack R. Blackmon Jack R. Commissioner moved that the Charter provision prohibiting ordi nces from being passed finally on the date introduced be suspended for the reasons stated in the written request of the Mayor and stated in the emer- gency clause the ordinance. The motion was seconded by Commissioner The motion was carried by the following o e: AYES: Commissioners Bradley, Jimenez, Lozano, McDaniel, Roberts and Sizemore. NAYS: None. The Mayor requested that the records show that he voted Aye. This was done Commissioner, moved that the ordinance be ssed finally. The Mayor requested that the records show that he voted Aye. This was done. The Mayor announced that the ordinance had been passed. The ordinance is as follows: ORDINANCE NO. � BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF AN ELECTION ON THE QUESTION OF THE ISSUANCE OF THE FOLLOWING BONDS: $4,500,000 WATERWORKS SYSTEM IMPROVE- MENT REVENUE BONDS AND $2,500,000 AIRPORT IMPROVEMENT TAX BONDS; AND DECLARING AN EMERGENCY. WHEREAS, heretofore on the 19th day of June, 1968, the City Council of the City of Corpus Christi, Texas, passed an ordinance calling an election to be held in said City on the 13th day of July, 1968, on the Propositions hereinafter stated; and WHEREAS, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding, and making returns of said election; and WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1.. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed by the City Council prior to said election, that said election was duly held, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accord- ance with law. 2. That the City Council officially finds and determines that only resident, qualified electors who own taxable property in said City, and who have duly rendered the same ±or taxation were allowed to vote at said election, and Y 1 that the following votes were cast at said election on each Proposition submitted: PROPOSITION NO. 1 VOTES: FOR ) THE ISSUANCE OF $4,500,000 WATER - WORIZS SYSTEM IMPROVEMENT REVENUE o VOTES: AGAINST ) BONDS PROPOSITION NO. 2 O 6 VOTES: FOR ) THE ISSUANCE OF $2,500,000 AIRPORT IMPROVEMENT TAX BONDS VOTES: AGAINST ) 3. That the City Council officially finds, determines and declares the result of said election to be that said Proposi- tions so submitted received a favorable majority vote and carried, and that all of said bonds receiving a favorably majority vote may be issued in accordance with law. _ 4. That the public importance and the pressing need for the permanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring same to be considered and voted upon at three regular meetings, and such facts require that this ordinance be passed and.take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and shall be in full force and effect immediately upon its passage.
