AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER
INTO A LEASE AGREEMENT, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI, WITH THE COASTAL BEND REGIONAL
PLANNING COMMISSION FOR A PERIOD OF FIVE YEARS, FOR
BUSINESS OFFICE PURPOSES OF THE SAID COMMISSION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS
SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED
TO ENTER INTO A LEASE AGREEMENT, FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, WITH THE COASTAL BEND REGIONAL PLANNING COMMISSION FOR A PERIOD
OF FIVE (5) YEARS, COVERING THE LEASING OF THE INTERNATIONAL ARRIVAL
BUILDING AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT, ALL AS MORE FULLY
SET FORTH IN THE LEASE, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF.

WHEREAS,, THE CITY OF CORPUS CHRISTI IS THE OWNER OF A BUILDING
AT CORPUS CHRISTI INTERNATIONAL AIRPORT, LOCATED AS SHOWN ON THE MAP OF THE
INTERNATIONAL' ARRIVAL BUILDING, ATTACHED HERETO AND MADE A PART HEREOF,
WHICH BUILDING IS TEMPORARILY NOT NEEDED FOR AIRPORT PURPOSES BUT IS
EXPECTED TO BE USED FOR AIRPORT PURPOSES IN THE NEAR FUTURE; AND
WHEREAS, COASTAL BEND REGIONAL PLANNING COMMISSION, A NONPROFIT
ORGANIZATION AUTHORIZED BY AN ACT OF THE LEGISLATURE, WHOSE MEMBERSHIP FROM
THE CITY CONSISTS OF THOSE REPRESENTATIVES AUTHORIZED IN ORDINANCE NO. 82463
PASSED AND APPROVED BY THE CITY COUNCIL ON NOVEMBER 16, 1966; AND
WHEREAS, SAID COASTAL BEND REGIONAL PLANNING COMMISSION DESIRES
TO LEASE, AND HAS AGREED WITH THE CITY OF CORPUS CHRISTI TO LEASE, THE
BUILDING DESIGNATED ON SAID MAP SITUATED AT CORPUS CHRISTI INTERNATIONAL
AIRPORT FOR BUSINESS OFFICE PURPOSES OF SAID COMMISSION:
NOW, THEREFORE, THE CITY OF CORPUS CHRISTI, ACTING BY AND THROUGH
ITS DULY AUTHORIZED CITY MANAGER, R. MARVIN TOWNSEND, HEREINAFTER CALLED
"LESSOR", DOES HEREBY LEASE TO COASTAL BEND REGIONAL PLANNING COMMISSION,
ACTING BY AND THROUGH ITS CHAIRMAN, HOMER DEAN, HEREINAFTER CALLED "LESSEE",
THE AFORESAID PREMISES UNDER THE FOLLOWING TERMS AND CONDITIONS:
1. THE LESSEE AGREES TO PAY THE RENT HEREINAFTER PROVIDED, FOR THE
USE OF,SAID PREMISES FOR THE TERM OF FIVE (5) YEARS, COMMENCING .JUNE ,
19168, FOR A RENTAL OF FORTY -TWO THOUSAND 'FIVE HUNDRED AND N0/100 DOLLARS
($42,500), PAYABLE MONTHLY AS PROVIDED HEREIN.
2. LESSEE WILL AT ITS OWN EXPENSE MAKE SUCH MODIFICATIONS TO
THE INTERIOR WALLS.AS TO MAKE THE BUILDING COMPATIBLE WITH THE NEEDS OF
SAID COMMISSION WITHOUT IN ANY WAY MODIFYING THE EXTERIOR WALLS. COMMISSION
WILL AT ITS EXPENSE, AT THE WRITTEN REQUEST OF LESSOR, RESTORE THE BUILDING
TO ITS ORIGINAL CONDITION WHEN ITS USE IS COMPLETED, BY -THE TERMS HEREINAFTER
PROVIDED OR INITIAL TERMS AS HEREINAFTER PROVIDED.
3. THE COMPENSATION,TO BE PAID FOR THIS LEASE OF $42,500 IS
PAYABLE MONTHLY ON THE FIRST DAY OF EACH MONTH, BEGINNING JUNE 1, 1968,
AT THE RATE OF SEVEN HUNDRED EIGHT AND 35/100 DOLLARS $708.35) FOR THE
FIRST ELEVEN (11) MONTHS OF EACH YEAR OF SAID TERM, AND SEVEN HUNDRED
EIGHT AND 15/100 DOLLARS ($708.15) FOR THE TWELFTH (12TH) MONTH OF EACH
YEAR OF SAID TERM.
4. COASTAL BEND REGIONAL PLANNING COMMISSION, LESSEE, UNDER-
STANDS THAT CITY HAS CONSTRUCTED THIS BUILDING FOR HANDLING REGULARLY
SCHEDULED INTERNATIONAL FLIGHTS AND EITHER PARTY MAY, BY NINETY (90)
DAYS WRITTEN NOTICE, TERMINATE THIS LEASE.
THE LESSOR CITY AGREES TO THE FOLLOWING:
1. LESSOR WILL PROVIDE CUSTODIAL SERVICE.
2. LESSOR WILL MAINTAIN THE BUILDING IN REPAIR AND PROVIDE
HEATING AND AIR CONDITIONING, MAINTAIN THE PLUMBING FACILITIES.
3. LESSOR WILL CARRY OUT ALL RESPONSIBILITY USUALLY ASSOCIATED
WITH LANDLORD OF SUCH OFFICE BUILDINGS.
THIS LEASE SHALL SUPERSEDE THE INFORMAL AGREEMENT EXISTING
BETWEEN THE PARTIES HERETO AND CONSTITUTE THE LEASE BETWEEN LESSOR AND
LESSEE.
WITNESS OUR HANDS IN DUPLICATE, EACH OF WHICH SHALL BE CONSIDERED
AN ORIGINAL, THIS THE DAY OF , 1968.
