HomeMy WebLinkAbout08969 ORD - 08/07/1968BJw:8/7/68 a AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, SUPPLE- MENTAL AGREEMENTS WITH THE STATE OF TEXAS, FOR AND ON BEHALF OF THE TEXAS HIGHWAY DEPARTMENT, COVERING ROAD- WAY ILLUMINATION SYSTEMS ON I.H. 37 AND S.H. 286 FOR THE PURPOSE OF ILLUMINATING SIGNS IN CONNECTION WITH THE ILLUMINATION OF THE ROADWAYS, COPIES OF WHICH SUPPLE- MENTAL AGREEMENT, IDENTIFIED AS TO PROJECTS "A ®, "B" AND "C ", ARE ATTACHED HERETO AND MADE A PART HEREOF; ` AND DECLARING AN EMERGENCY. WHEREAS, EXPRESSWAY ILLUMINATION AGREEMENTS HAVE BEEN ENTERED INTO BETWEEN THE STATE OF TEXAS AND THE CITY OF CORPUS CHRISTI COVERING THE CONSTRUCTION, MAINTENANCE AND OPERATION OF ROADWAY ILLUMINATION SYSTEMS ON I.H. 37 FROM WACO STREET TO LANTANA STREET, AND ON S.H. 286 FROM I.H. 37 TO TARLTON STREET, AND IN THE AFORESAID AGREEMENTS THE CITY OF CORPUS CHRISTI AND THE STATE HAVE AGREED TO EACH PAY A PORTION OF THE COST OF THE ELECTRICAL ENERGY FOR THE ROADWAY ILLUMINATION SYSTEM; AND WHEREAS, THE TEXAS HIGHWAY DEPARTMENT PROPOSES TO INSTALL OVER- HEAD GUIDE SIGNS COMPLETE WITH ILLUMINATION FOR THESE SECTIONS OF I.H. 37 AND S.H. 286, AND SINCE IT WOULD BE MORE ECONOMICAL TO UTILIZE THE TRANS- FORMER STATIONS DESIGNED TO SUPPLY POWER TO THE EXPRESSWAY ILLUMINATION CIRCUITS RATHER THAN INSTALL SEPARATE POWER SOURCES FOR THE OVERHEAD GUIDE SIGN ILLUMINATION; AND WHEREAS, THE STATE OF TEXAS AND THE CITY OF CORPUS CHRISTI HAVE AGREED TO FORMALIZE THEIR UNDERSTANDING BY WRITTEN AGREEMENT, AND IT IS NECESSARY THAT THE CITY MANAGER EXECUTE SUCH AGREEMENTS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, SUPPLEMENTAL AGREEMENTS WITH THE STATE OF TEXAS, FOR AND ON BEHALF OF THE TEXAS HIGHWAY DD�EPARTMENT, COVERING ROADWAY ILLUMINATION SYSTEMS ON I.H. 37 AND S.H. 286 FOR THE PURPOSE OF ILLUMINATING SIGNS IN CONNECTION WITH THE ILLUMINATION OF THE ROADWAYS, COPIES OF WHICH SUPPLEMENTAL AGREE- MENTS ARE ATTACHED HERETO AND MADE A PART HEREOF; SUPPLEMENTAL AGREEMENT 8969 AS TO PROJECT 'e ADDS 176 F48T12 AND 130 F72T12 LAMPS TO THE ROADWAY ILLUMINATION AGREEMENTS ON I.H. 37 FROM WACO STREET TO LANTANA STREET AND ON S.H. 286,FROM I.H. 37 TO TARLTON STREET; SUPPLEMENTAL AGREEMENT AS TO PROJECT °B" ADDS 32 F48T12 AND 14 F72T12 LAMPS TO THE SAFETY LIGHTING ` AGREEMENT ON 1'.H. 37 FROM CORN PRODUCTS ROAD TO THE M.P. RAILROAD UNDERPASS NEAR CALALLEN; AND THE SUPPLEMENTAL AGREEMENT AS TO PROJECT "C" ADDS 16 F48T12 AND 22 F72T12 LAMPS TO THE ROADWAY ILLUMINATION AGREE- MENTS ON S.,H. 286, FROM TARLTON STREET TO GOLLIHAR ROAD. SECTION 2. THE NECESSITY TO AUTHORIZE THE HEREINABOVE DESCRIBED SUPPLEMENTAL AGREEMENTS AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGEJJCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE,BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE. AND EFFECT AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE / DAY OF AUGUST, 1968. ATTEST- CIT -SECRET R APPROVED: DAY OF AUGUST, 1968: CITY ATTORNEY MAYOR ro em THE CITY 0 CO US HRISTI, TEXAS PROJECT A ; SUPPLEMENTAL AGREEMENT WHEREAS, expressway illumination agreements have been entered into between the State of Texas and the City of Corpus Christi covering the Construction, Maintenance and Operation of roadway illumination systems on I.H. 37 from Waco Street to Lantana Street, and on S.H. 286 t from I.H. 37 to Tarlton Street, and in the aforesaid agreements the City of Corpus Christi and the State.have agreed to each pay a portion of the cost of the electrical energy for the roadway illumination system,,and WHEREAS, the Texas Highway Department proposes to install overhead guide signs complete with illumination for these sections of I.H. 37 and S.H. 286, and since it would be more economical to utilize the transformer stations designed to supply power to the expressway illumination circuits rather than install separate power sources for the overhead guide sign illumination; NOW, THEREFORE, it is hereby agreed between the parties hereto that the aforesaid agreements be modified to the extent as follows:. 1. All cost of construction of the overhead guide signs and sign illumination system as provided by the signing project plans and specifics tions, such as sign luminaires, conduits, and electrical conductor, will be financed by the State. - 2. The State hereby agrees to reimburse the City in the amount of 1007 of the cost of electrical energy used by that portion of the overhead sign illumination system connected to the roadway illumination system trans- former stations. The quantity of electrical energy used by the overhead sign illumination system shall be determined by multiplying the sum of the manufacturer's rated input wattages, as shown on the project plans of that portion of the overhead sign illumination system connected to the roadway illumination system transformer stations, by the number of hours the lamps are energized divided by 1000. The number of hours that the lamps are energized shall be from dusk until dawn each night in the year, the total burning time for each lamp being approximately thirty -nine hundred and fifty (3,950) hours during each year. 3. The State's payment for the electrical energy cost for that portion of the overhead sign illumination system connected to the roadway illumination system transformer stations shall be based upon the minimum unit rates charged the City under the City's contract with the power agency supplying electrical energy to the City. The City will forward the State two copies of its existing contract with the power agency for electri- cal energy, and thereafter will furnish two copies of subsequent contracts as the existing or governing control is terminated and new contracts are executed. . 4. The State further agrees to maintain the overhead guide signs and the overhead guide sign illumination system including the circuits from the overhead sign mounts to the roadway illumination system transformer stations where connections are made for power, and any circuits and service poles in- stalled by the State specifically for the purpose of furnishing electrical energy to the overhead guide signs. 5. This agreement shall remain in force for a period of two years from the date of execution, and it shall be understood by both parties that at the end of this two year period and each succeeding two year period the agree- ment will be automatically renewed for two years unless terminated in writing by either party 30 days prior to the termination date. Railroad Underpass near Calallen, and in the aforesaid agreement the State has agreed to reimburse the City for the cost of the electrical energy for the safety lighting system, and WHEREAS, the Texas Highway Department proposes to install overhead guide . signs complete with illumination for this section of I.H. 37, and since it would be more economical to utilize the transformer stations designed to supply power to the safety lighting circuits rather than in- stall separate power sources for the overhead guide sign illumination; NOW, THEREFORE, it is hereby agreed between the parties hereto that the aforesaid agreement be modified to the extent as follows; 1. All cost of construction of the overhead guide signs and sign illumination system as provided by the signing project plans and speci- fications, such as sign luminaires, conduits, and electrical conductor, will be financed by the State. 2. The State hereby agrees to reimburse the City in the amount of 100% of the cost of electrical energy used by that portion of the over- head sign illumination system connected to the safety lighting system transformer stations.
