HomeMy WebLinkAbout08970 ORD - 08/07/19688-7-68: FMB AN ORDINANCE APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $2,86o.06, FOR THE ACQUISITION OF RIGHT OF WAY TO SERVE THE NEW ELEMENTARY SCHOOL ON GREENWOOD DRIVE, APPLICABLE TO NO. 220 -64 -64 MINOR STREET RIGHT OF WAY; AUTHORIZING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACQUIRE THE AFORESAID RIGHT OF WAY FROM THE JUAN A. GONZALEZ ESTATE BY PROPER CONVEYANCE AND BY THE EXECUTION OF SUCH OTHER INSTRUMENTS AS MAY BE NECESSARY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF N0. 220 STREET BOND FUND THE SUM OF $2,860.06, FOR THE ACQUISITION OF RIGHT OF WAY TO SERVE THE NEW ELEMENTARY SCHOOL ON GREENWOOD DRIVE, APPLICABLE TO NO. 220 -64 -64 MINOR STREET RIGHT OF WAY, SAID PARCEL OR TRACT BEING DESCRIBED AS FOLLOWS, TO -WIT: A TRACT OF LAND 20 FEET IN WIDTH AND 1300 FEET IN LENGTH, BEING THE NORTHWEST 20 FEET OF LOT 12, SECTION D, PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT AS SHOWN BY MAP OR PLAT OF RECORD IN VOLUME A, PAGE 28, NUECES COUNTY, TEXAS, MAP RECORDS, SAID 20 FOOT TRACT OF LAND BEING ADJACENT AND PARALLEL TO GREENWOOD DRIVE. SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO ACQUIRE THE AFORESAID PARCEL OR TRACT AND EXECUTE SUCH INSTRUMENTS AND DO SUCH OTHER THINGS AS ARE NECESSARY TO ACQUIRE THE PARCEL OR TRACT DESCRIBED FROM THE OWNERS, THE JUAN A. GONZALEZ ESTATE. SECTION 3. THE NECESSITY TO APPROPRIATE THE HEREINABOVE DESCRIBED FUNDS AND TO AUTHORIZE THE IMMEDIATE ACQUISITION OF THE PARCEL OR TRACT OF LAND HEREINABOVE DESCRIBED SO THAT THE HEREINABOVE DESCRIBED PROJECT MAY PROCEED WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 7TH DAY OF AUGUST, 1968.
