HomeMy WebLinkAbout08979 ORD - 08/14/1968Bdw :8/13/68 AN ORDINANCE AMENDING ORDINANCE NO. 8294, AS AMENDED, KNOWN AS THE "BAY DRILLING ORDINANCE OF THE CITY OF CORPUS CHRISTI ", BY DELETING THE PRESENT SUBSECTION 4.1 AND SUBSTITUTING THEREFOR A NEW SUBSECTION 4.1, PROVIDING FOR A CHANGE IN THE COMPOSITION OF THE MEMBERSHIP OF THE BAY DRILLING COMMITTEE; AND BY DELETING SUBSECTION 4.2 AND SUBSTITUTING THEREFOR A NEW SUBSECTION 4.2, SETTING FORTH THE NECESSARY CHANGES IN ROTATION OF MEMBERSHIP; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE N0. 8294, AS AMENDED, KNOWN AS THE -BAY DRILLING ORDINANCE OF THE CITY OF CORPUS CHRISTI", BE AND THE SAME ISHEREBY AMENDED BY DELETING THE PRESENT SUBSECTION 4.1, AND SUBSTITUTING THEREFOR A NEW SUBSECTION 4.1 READING AS FOLLOWS: 114.1 THERE IS HEREBY ESTABLISHED AS AN ADVISORY BODY TO ASSIST THE CITY COUNCIL IN ITS FUNCTION HEREUNDER, THE BAY DRILLING COMMITTEE, TO EXIST UNTIL ABOLISHED BY THE COUNCIL. THE MEMBERSHIP OF THIS COMMITTEE SHALL BE COMPOSED OF SIX (6) PERSONS WHO ARE RESIDENTS OF THE CITY OF CORPUS CHRISTI, THREE (3) OF WHOM SHALL BE SELECTED FROM AMONG THE GENERAL PUBLIC NOT CONNECTED WITH THE BUSINESS OF EXPLORING OR DRILLING FOR, OR PRODUCING OIL, GAS AND OTHER HYDROCARBONS, AND THREE (3) OF WHOM SHALL BE SELECTED FROM THE OIL AND GAS INDUSTRY. THE PUBLIC MEMBERS SHALL BE APPOINTED BY THE MAYOR WITH THE APPROVAL OF THE COUNCIL, AND THE INDUSTRY MEMBERS SHALL BE APPOINTED BY THE MAYOR WITH THE APPROVAL OF THE COUNCIL FROM THOSE PERSONS NOMINATED BY THE OIL AND GAS INDUSTRY AS HEREINAFTER PROVIDED. NOT LATER THAN ONE (1) MONTH PRIOR TO THE BEGINNING OF A NEW TERM FOR EACH INDUSTRY MEMBER, OR WITHIN ONE (1) MONTH AFTER OCCURRENCE OF A VACANCY IN THE POSITION OF SUCH A MEMBER, ANY LESSEE MAY NOMINATE ONE PERSON FROM HIS OR ITS OWN ORGANIZATION FOR THE POSITION OF INDUSTRY MEMBER OF THE COMMITTEE. SUCH NOMINATION SHALL BE IN WRITING AND FILED WITH THE CITY SECRETARY, AND THE INDUSTRY MEMBERS OF THE COMMITTEE SHALL BE APPOINTED FROM SUCH NOMINEES. IN MAKING SUCH APPOINTMENTS, THE MAYOR SHALL GIVE DUE CONSIDERATION TO THE EXTENT OF INTEREST OWNED BY EACH LESSEE MAKING A NOMINATION IN THE AREA COVERED BY THIS ORDINANCE. IN THE EVENT THAT NO SUCH NOMINATION IS SUB- MITTED OR, IN THE EVENT NO PERSON SO NOMINATED IS APPOINTED AND APPROVED, THE MAYOR SHALL APPOINT ANY PERSON HE DEEMS SUITABLE WITH THE APPROVAL OF THE COUNCIL TO FILL THE POSITION OF INDUSTRY MEMBER OF THE COMMITTEE.° SECTION 2. THAT ORDINANCE NO. 8294, AS AMENDED, KNOWN AS THE "BAY DRILLING ORDINANCE OF THE CITY OF CORPUS CHRISTI", BE, AND THE SAME IS HEREBY, AMENDED BY DELETING THE PRESENT SUBSECTION 4.2 AND SUBSTITUTING THEREFOR A NEW SUBSECTION 4.2 READING AS FOLLOWS: °4.2 EXCEPT AS PROVIDED HEREIN, MEMBERS OF THE COMMITTEE SHALL BE APPOINTED FOR TERMS OF THREE (3) YEARS, AND MAY SUCCEED THEMSELVES. TO ESTABLISH ROTATION OF MEMBERSHIP, THE TERMS OF THE COMMITTEE SHALL EXTEND FROM SELECTION TO THE END OF THE DAY INDICATED, VIZ: ONE PUBLIC MEMBER - TO DECEMBER 31, 1970, AND ONE INDUSTRY MEMBER - TO DECEMBER 31, 1970; ONE PUBLIC MEMBER - TO DECEMBER 31, 1968, AND ONE PUBLIC MEMBER - TO DECEMBER 31, 1969; ONE INDUSTRY MEMBER - TO DECEMBER 31, 1968, AND ONE INDUSTRY MEMBER - TO DECEMBER 31, 1969. VACANCIES ON THE COMMITTEE, HOWEVER BROUGHT ABOUT, SHALL BE FILLED AS PROVIDED IN SECTION 4.1 FOR A NEW TERM OR FOR THE BALANCE OF ANY UNEXPIRED TERM VACATED, AS THE CASE MAY BE. A MEMBER OF THE COMMITTEE MAY RESIGN AT ANY TIME UPON WRITTEN NOTICE TO THE SUPERINTENDENT, OR ANY MEMBER MAY BE REMOVED AT ANY TIME BY A MAJORITY VOTE OF THE COUNCIL FOR CAUSE DEEMED SUFFICIENT BY IT.- SECTION 3. THE NECESSITY TO MAKE THE NECESSARY APPOINTMENTS TO THE BAY DRILLING COMMITTEE AT THE EARLIEST POSSIBLE TIME, CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESO4UTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE � DAY OF AUGUST, 1968.
