HomeMy WebLinkAbout08990 ORD - 08/21/1968BJW:8/20/W . .a AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR STREET IMPROVEMENTS ON UP RIVER ROAD, FROM LEOPARD STREET TO I.H. 37, PROJECT NO. 220- 53 -4.2; APPRO- PRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF S 2, 1 IONTIC CONSTRUCTION CONTRACT AND $918 1SFORCON- GENCIES AND INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR STREET IMPROVEMENTS ON UPRIVER ROAD, FROM LEOPARD STREET TO I.H. 37, SAID CONSTRUCTION TO CONSIST OF EXCAVA- TIONS, BASE WORK, HOT MIX ASPHALTIC CONCRETE SURFACING FOR A PAVEMENT WIDTH OF 45 FEET BACK TO BACK OF CURB EXCEPT THE RESIDENTIAL AREA WHICH WILL BE 54 FEET WIDE FOR A PARKING LANE, CURBS, GUTTERS, SIDEWALKS AND STORM SEWER FACILITIES ON UPRIVER ROAD, LEOPARD TO I.H. 37, DESIGNATED AS PROJECT No. 220- 53 -4.2, SAID CONSTRUCTION BEING MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF FOWCO CONSTRUCTION COMPANY OPENED ON THE 19TH DAY OF JUNE,1968, THE SAID BID OF FOWCO CONSTRUCTION BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 220 STREET BOND FUND THE SUM OF $135,000, OF WHICH AMOUNT $125,118.17 IS FOR THE CON- STRUCTION CONTRACT AND $9,881.83 IS FOR THE CONTINGENCIES AND INCIDENTAL EXPENSES. SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE AFORE- SAID CONTRACT AND THE APPROPRIATION OF THE NECESSARY FUNDS TO PROVIDE STREET IMPROVEMENTS BADLY NEEDED IN THE AREA ABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ 8990 AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT ,FROM AND AFTER ITS PASSAGE, I IS ACCORDINGLY SO ORDAINED, THIS THE --5 /J(L� -- DAY OF AUGUST, 1968. Fund from which it is proposed to be drawn, and such money is not appropriated for any other purpose. 6 / Director F nce CORPUS CHRISTI, TEXAS DAY OF9�� _ S TO THE MEMEIERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
