AN ORDINANCE
APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM
OF $30,620.20, OF WHICH AMOUNT $30,373.20 IS FOR THE
ACQUISITION OF PARCELS N0. 4, 5 AND 6, AND $247.00 IS
FOR INCIDENTAL EXPENSE, ALL APPLICABLE TO PROJECT
220- 67 -97, OCEAN DRIVE, CRAIG TO ALAMEDA; AUTHORIZING
AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE
SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI WITH THE OWNERS, MESOG V. DONIGAN AND
LUCY V. WELCH; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF N0. 220 STREET
BOND FUND THE SUM OF $30,620.20, OF WHICH AMOUNT $30,373.20 IS FOR THE
ACQUISITION OF PARCELS N0. 4, 5, AND 6, AND $247 IS FOR INCIDENTAL EXPENSE,
ALL APPLICABLE TO PROJECT NO. 220- 67 -97, OCEAN DRIVE, CRAIG TO ALAMEDA,
SAID PARCEL OF LAND BEING DESCRIBED AS FOLLOWS:
TRACT NO. I:
A tract of land out of the most northerly 285 feet out of that certain tract of land
containing 9.9 acres originally conveyed by 11. Y. Evans to V. M. Donigan by deed dated
February 26, 1931 recorded in Volume 196 Page 530, Deed Records Nueces County, Texas,
being referred to as the Alta Vista Hotel Tract, and being a portion of the tract known
as the "Home Tract" set aside to Mesog V. Donigan and Lucy V. Welch in that certain
Partition Deed dated January 15, 1951, between Mesog V. Donigan et al, recorded in
Volume 501 Page 228, Deed Records of Nueces County, Texas, with accompanying plat
recorded in Volume 1, Page 48, Miscellaneous Map Records of Nueces County, Texas, the
tract herein conveyed being more particularly described by metes and bounds as follows:
Beginning at the southwest corner of the said "Home Tract" for a corner of this tract;

Thence N 30 40' 05" W with the Southwest boundary line of the said "Home Tract" a
distance of 14.00 feet to a point.
Thence with the present east right of way line of Ocean Drive in a northerly direction
along the are of a Sircular curve to the right having a radius of 339.91 feet and a
central angle of 52 56' 28" a distance of 314.08 feet to a point, the present north-
west corner of said "Home Tract" for a corner of this tract;
Thence N 59 o 19' 55" E with the north boundary line of said "Home Tract" a distance of
53.82 feet to a point for a corner of this tract;
Thence S 50 24' 45" E, a distance of 144.93 feet to a point;
Thence in a southerly direction with the are of a circular curve to the left having a
radius of 1119.82 feet and a central angle of 80 27' 32 ", a distance of 165.33 feet to
a point in the south boundary line of said "Home Tract" for a corner of this tract;
Thence S 590 19' 55" W with the south boundary line of said "Home Tract" a distance of
67.77 feet to the place of beginning.
TRACT NO. II:
A portion of Tract Two (2), being 123.45 feet in width out of the Alta Vista Hotel Tract,
in the City of Corpus Christi, Texas, set aside to Lucy V. Welch in a partition Deed
dated January 15, 1951, between Mesog V. Donigan et al, recorded in Volume 501, Page 228,
Deed Records of Pdueces County, Texas, with accompanying plat recorded in Volume I Page 48,
Misccllanenus Map Records of Nueces County, Texas; the tract herein conveyed being more
particularly described by metes and bounds as follows, to -wit:

Beginning at the Northwest corner of said Tract Two for a corner of this tract;
Thence N. 59 19' 55" E with the northwest boundary line of said Tract Two, a distance
of 42.81 feet to a point for a corner of this tract;
Thence in a southeasterly direction with the arc 8f a circular curve to the left having
• radius of 1119.82 feet and a central angle of 6 23' 22 ", a distance of 124.88 feet to
• point in the southeast boundary line of said Tract Two for a corner of this tract;
Thence S 590 19' 55" W with the southeast boundary line of said Tract Two, a distance of
24.58 feet to the southwest corner of said Tract Two for a corner of this tract;
Thence N 300 40' 05" W with the southwest boundary line of said Lot Two, being also the
northeast right of way line of Ocean Drive, a distance of 123.45 feet to the place of
beginning.

A tract of land out of a portion of Tract I being 98.75 feet in width set aside to
Mesog V. Donigan in Partition Deed dated January 15, 1951, between Mesog V. Donigan et al,
recorded in Volume 501, Page 228, Deed Records of Nueces County, Texas, with accompanying
plat recorded in Volume I Page 48, Miscellaneous Map Records of Nueces County, Texas; the
tract herein conveyed being more particularly described by metes and bounds as follows,
to -wit:
Beginning at the southwest corner of said Tract I for a corner of this tract;
Thence N 300 40' 05" W with the southwest boundary, line of said Tract I, being also the
northeast right of way line of Ocean Drive, a distance of 98.75 feet to the northwest
corner of said Tract I for a corner of this tract;
Thence N 590 19' 55" E with the northwest boundary line of said Tract I, a distance of
67.77 feet to a point for a corner of this tract;
Thence in a southeasterly direction with the are of a circular curve to the left, having
• radius of 1119.82 feet and a central angle of 50 12' 48 ", a distance of 101.89 feet to
• point in the southeast boundary line of said Tract I for a corner of this tract;
Thence S 59 19' 55" W with the southeast boundary line of said Tract I, a distance of
42.81 feet to the place of beginning.
SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF THE ABOVE DESCRIBED PARCELS
OF LAND FROM MESOG V. DONIGAN AND LUCY V. WELCH, OWNERS.
SECTION 3. THE NECESSITY TO MAKE THE APPROPRIATION DESCRIBED
ABOVE AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE NECESSARY INSTRUMENTS
FOR THE PURCHASE OF THE ABOVE DESCRIBED PARCELS OF LAND SO THAT THE PROJECT
DESCRIBED HEREINABOVE MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY
AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF INTRO-
DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY

AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER
RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUC-
TION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS �p

FOR THE REASONS SET FORTH IN THE EMERGENCY .CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
