HomeMy WebLinkAbout09004 ORD - 08/28/196818/28/68 AN ORDINANCE APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $45,163, OF WHICH AMOUNT $44,850 IS FOR ACQUISITION OF PARCEL NO. 45, AND $313 IS FOR INCIDENTAL EXPENSE, ALL APPLICABLE TO PROJECT 220- 67 -97, OCEAN DRIVE, CRAIG TO ALAMRDA; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE OWNERS, JOSEPH WELDON BAILEY AND LENORE MAXWELL BAILEY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated out of No. 220 Street Bond Fund the sum of $45,163, of which amount $44,850 is for the acquisi- tion of Parcel No. 45, and $313 is for incidental expense, all applicable to Project No. 220- 67 -97, Ocean Drive, Craig to Alameda, said parcel being described as follows, to -wit: Being out of the Southeast portion of Lot 6 in Section 15 of the Flour Bluff and Encinal Farm and Garden Tract, of record of Nueces County, Texas, described by metes and bounds as follows to -wit: Beginning at a 3/4" iron pipe set for the intersect of Westerly right of way line of Palmetto Street and the Southerly right of way line of Ocean Drive, Thence cross.Ocean Drive with the projection of said Westerly line of Palmetto Street N. 290 E. 80.20 feet to the intersect of Northerly right of way line of Ocean Drive, Thence with said Northerly line of Ocean Drive, N. 560 54, W 25 feet to the place of beginning, Thence continue with 'said right of way line N. 560 54' W 526.41 feet to point for most Westerly corner of this tract, Thence North 290 E to point in the shore of Corpus Christi Bay for the North corner of this tract, Thence in Southeasterly direction along the meanders of the shores of Corpus Christi Bay 550 feet more or less for the East corner of this tract, Thence South 290 West to the Northeast corner of a tract conveyed to Bolivar J. DePena by W. B. Lee, Trustee, recorded in Volume 1062, Page 114, of the Deed Records of Nueces County, Texas, for a corner of this tract. Thence South 810 46, W. 31.32 feet for a corner, Thence South 290 W. 39.26 feet to place of beginning. SECTION 2. That the City Manager be, and he is hereby, authorized and directed to acquire the aforesaid parcel and execute such instruments and do such other things as are necessary to acquire the parcel described from the owners, Joseph Weldon Bailey and Lenore Maxwell Bailey. 9004 SECTION 3. The necessity to appropriate the hereinabove described funds and to authorize the immediate acquisition of the parcel or tract of land hereinabove described so that the project may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this Ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the��ay of 1968.
