HomeMy WebLinkAbout09033 ORD - 09/18/1968BJW:9 /18/68 TEXAS: AN ORDINANCE APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $125.00 FOR ACQUISITION OF RIGHT OF WAY EASEMENT, BEING PARCEL NO. 16, APPLICABLE TO PROJECT 220 -67 -97 OCEAN DRIVE, CRAIG TO ALAMEDA; AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACQUIRE THE AFORESAID PARCEL FROM THE OWNER, LOWELL 0. RYAN, BY PROPER CONVEYANCE AND BY THE EXECUTION OF SUCH OTHER INSTRUMENTS AS MAY BE NECESSARY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF NO. 220 STREET BOND FUND THE SUM OF $125.00, WHICH AMOUNT IS FOR THE ACQUISITION OF PARCEL NO. 16, ALL APPLICABLE TO PROJECT 220- 67 -97, OCEAN DRIVE, CRAIG TO ALAMEDA, SAID PARCEL OF LAND BEING DESCRIBED AS FOLLOWS: PARCEL NO. 16 A TRIANGULAR TRACT OF LAND OUT OF LOTS 29 AND 30, BLOCK 14, PORT ARANSAS CLIFFS ADDITION AS SHOWN BY MAP OR PLAT OF RECORD IN VOLUME A, PAGE 27, MAP RECORDS OF NUECES COUNTY, TEXAS, THE PORTION HEREBY CONVEYED BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS, TO -WIT: BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 30 FOR A CORNER OF THIS TRACT; THENCE S. 11° 441 25" E. WITH THE EAST BOUNDARY LINE OF SAID LOTS 30 AND 29, BEING ALSO THE WEST RIGHT -OF- WAY LINE OF OCEAN DRIVE, A DISTANCE OF 45.27 FEET TO A POINT FOR A CORNER OF THIS TRACT; THENCE IN A NORTHWESTERLY DIRECTION WITH THE ARC OF A - CIRCULAR CURVE TO THE LEFT WHOSE RADIUS IS 942.50 AND WHOSE CENTRAL ANGLE IS 2° 431 46", A DISTANCE OF 44.90 FEET TO A POINT IN THE NORTHWEST BOUNDARY LINE OF SAID LOT 30 FOR A CORNER OF THIS TRACT; THENCE N. 58° 141 25° E. WITH THE NORTHWEST BOUNDARY LINE OF SAID LOT 30, A DISTANCE OF 1.14 FEET TO THE PLACE OF BEGINNING. SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF THE ABOVE DESCRIBED PARCEL FROM LOWELL 0. THE NECESSITY TO MAKE THE APPROPRIATION DESCRIBED ABOVE AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE NECESSARY INSTRU- MENTS FOR THE PURCHASE OF THE ABOVE DESCRIBED PARCEL OF LAND SO THAT THE PROJECT DESCRIBED HEREINABOVE MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE ../t_�DAY OF SEPTEMBER, 1968.
