AN ORDINANCE
CLOSING THE HEARING ON STREET IMPROVEMENTS FOR OCEAN
DRIVE FROM HEWIT DRIVE TO AIRLINE ROAD, AND FINDING
AND DETERMINING THAT PROPERTY ABUTTING SAID STREET
WILL BE SPECIFICALLY BENEFITTED AND ENHANCED IN VALUE
IN EXCESS OF COST OF THE IMPROVEMENTS, AND LEVYING AN
ASSESSMENT; FIXING A CHARGE AND LIEN, THE MANNER AND
TIME OF PAYMENT AND COLLECTION; AND DECLARING AN
EMERGENCY.
WHEREAS, THE CITY COUNCIL OF CORPUS �CpHRISTI, TEXAS, BY DULY ENACTED
ORDINANCE PASSED AND APPROVED ON AUGUST 21, 1968, DETERMINED THE NECESSITY
FOR, AND ORDERED THE IMPROVEMENT OF OCEAN DRIVE, FROM HEWIT DRIVE TO AIRLINE
ROAD, IN THE MANNER AND ACCORDING TO THE PLANS AND SPECIFICATIONS HERETOFORE
APPROVED AND ADOPTED BY THE CITY COUNCIL BY ORDINANCE DATED AUGUST 21, 1968,
A DULY EXECUTED NOTICE OF SAID ORDINANCE HAVING BEEN FILED IN THE NAME OF
SAID CITY WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS; AND
WHEREAS, SAID CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
AFTER HAVING ADVERTISED FOR AND RECEIVED BIDS ON THE CONSTRUCTION OF SAID
IMPROVEMENTS FOR THE LENGTH OF TIME AND IN THE MANNER AND FORM AS REQUIRED
BY THE CHARTER OF SAID CITY AND THE LAWS OF THE STATE OF TEXAS, AND AFTER
HAVING DULY AND REGULARLY MADE APPROPRIATION OF FUNDS AVAILABLE FOR SUCH
PURPOSE TO COVER THE ESTIMATED COST OF SAID IMPROVEMENTS TO SAID CITY, ALL
AS PROVIDED BY THE CORPUS CHRISTI CITY CHARTER AND BY LAW, DID AWARD A CON-
TRACT FOR THE CONSTRUCTION OF SAID IMPROVEMENTS TO HELDENFELS BROTHERS ON
THEIR LOWEST AND MOST ADVANTAGEOUS BID AND SAID CONTRACT HAS BEEN HERETOFORE
DULY EXECUTED BY SAID
D CITY OF CORPUS CHRISTI AND HELDENFELS BROTHERS AND IS
DATED AUGUST 21, 1968, AND THE PERFORMANCE BOND REQUIRED BY SAID CONTRACT
HAS BEEN PROPERLY FURNISHED BY SAID HELDENFELS BROTHERS AND ACCEPTED BY THE
SAID CITY COUNCIL OF SAID CITY AS TO FORM AND AMOUNT AS REQUIRED BY THE
CHARTER OF SAID CITY AND THE LAWS OF THE STATE OF TEXAS; AND
WHEREAS, THE SAID CITY COUNCIL HAS CAUSED THE DIRECTOR OF PUBLIC
WORKS TO PREPARE AND FILE ESTIMATES OF THE COST OF SUCH IMPROVEMENTS AND
ESTIMATES OF THE AMOUNT PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE
PROPERTY ABUTTING UPON A PORTION OF OCEAN DRIVE, WITHIN THE LIMITS HEREIN
DEFINED, TO BE IMPROVED, AND THE REAL AND TRUE OWNERS THEREOF, AND SAID
DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATEMENT

OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCIL, AND SAME HAS BEEN
RECEIVED, EXAMINED AND APPROVED BY SAID CITY COUNCIL; AND
Co WHEREAS, SAID CITY COUNCIL, BY DULY ENACTED ORDINANCE DATED AUGUST
21, 1968, 010 DETERMINE THE NECESSITY OF LEVYING AN ASSESSMENT FOR THAT
PORTION OF THE COST OF CONSTRUCTING SAID IMPROVEMENTS ON THE ABOVE -NAMED
STREET, WITHIN THE LIMITS HEREIN DEFINED, TO BE PAID BY THE ABUTTING PROPERTY
AND THE REAL AND TRUE OWNERS THEREOF, AND DID ORDER AND SET A HEARING TO BE
HELD AT 2:00 O'CLOCK P.M. ON SEPTEMBER 9, 1968, IN THE COUNCIL CHAMBER OF
THE CITY HALL OF CORPUS CHRISTI, TEXAS, FOR THE REAL AND TRUE OWNERS OF THE
PROPERTY ABUTTING UPON SAID STREET, WITHIN THE LIMITS ABOVE DEFINED, AND FOR
ALL OTHERS OWNING OR CLAIMING ANY INTEREST IN, OR OTHERWISE INTERESTED IN
SAID PROPERTY, OR ANY OF SAID MATTERS AS TO THE ASSESSMENTS AND AMOUNTS TO
BE ASSESSED AGAINST EACH PARCEL OF ABUTTING PROPERTY AND THE REAL AND TRUE
OWNER OR OWNERS THEREOF, AND AS TO THE SPECIAL BENEFITS TO ACCRUE TO SAID
ABUTTING PROPERTY BY VIRTUE OF SAID IMPROVEMENTS, IF ANY, OR CONCERNING ANY
ERROR, INVALIDITY, IRREGULARITY OR DEFICIENCY IN ANY PROCEEDINGS, OR CONTRACT,
TO APPEAR AND BE HEARD IN PERSON OR BY COUNSEL AND OFFER EVIDENCE IN
REFERENCE TO SAID MATTERS; AND SAID CITY COUNCIL DID BY SAID ORDINANCE ORDER
AND DIRECT THE CITY SECRETARY TO GIVE NOTICE OF SAID HEARING TO THE REAL AND
TRUE OWNERS OF THE PROPERTY ABUTTING UPON SAID STREET, WITHIN THE LIMITS
DEFINED, BY PUBLICATION IN THE CORPUS CHRISTI TIMES, THE OFFICIAL NEWSPAPER
OF THE CITY OF CORPUS CHRISTI, A NEWSPAPER PUBLISHED IN THE CITY OF CORPUS
CHRISTI, TEXAS, OF GENERAL CIRCULATION, SAID NOTICE TO BE PUBLISHED IN SAID
NEWSPAPER AT LEAST THREE TIMES PRIOR TO THE DATE OF SAID HEARING, THE FIRST
PUBLICATION OF WHICH IS TO BE AT LEAST TEN (10) DAYS PRIOR THERETO, ALL AS
PROVIDED FOR IN ACCORDANCE WITH THE PROVISIONS 40TH SAID CITY CHARTER AND OF
CHAPTER 106 OF THE FIRST CALLED SESSION OF THE MOTH LEGISLATURE OF THE STATE
OF TEXAS, KNOWN AND SHOWN AS ARTICLE 1105B, VERNON'S ANNOTATED CIVIL STATUTES

WHEREAS, SAID CITY COUNCIL DID FURTHER ORDER AND DIRECT SAID CITY
SECRETARY, IN ADDITION TO SAID PUBLISHED NOTICE AS AFORESAID, WHICH WAS PRO-
VIDED TO BE VALID AND SUFFICIENT IN ITSELF, TO KEEP ON FILE A COPY OF SAID
DIRECTOR OF PUBLIC WORKS' REPORT, AND INCLUDE THEREIN THE LIST OF NAMES OF

THE APPARENT OWNERS, AND THE DESCRIPTIONS OF SAID ABUTTING PROPERTY AS SET
OUT IN SAID DIRECTOR OF PUBLIC WORKS' REPORT, PROVIDED, HOWEVER, THAT THE
SAID LIST OF APPARENT OWNERS AND PROPERTY DESCRIPTIONS SO INCLUDED IN SAID
NOTICE, SHALL MERELY BE CUMULATIVE OF AND IN ADDITION TO THE REQUIREMENT OF

OWNERS OF PROPERTY ABUTTING UPON THE STREET HEREINABOVE DESCRIBED; AND
WHEREAS, AFTER DUE, REGULAR AND PROPER NOTICE THEREOF, ALL AS PROVIDED
BY LAW AND THE CHARTER OF THE CITY OF CORPUS CHRISTI, SAID HEARING OF WHICH

MAYOR JACK R. BLACKMON CALLED THE MEETING TO ORDER.
CITY SECRETARY T. RAY KRING CALLED THE ROLL OF THOSE IN ATTENDANCE.
MAYOR BLACKMON ANNOUNCED THE PUBLIC HEARING REGARDING PAVING ASSESSMENTS ON
THE PROPOSED STREET IMPROVEMENTS ON OCEAN DRIVE BETWEEN HEWIT DRIVE AND 595' EAST OF
AIRLINE ROAD.
MAYOR BLACKMON CALLED ON TOM MCDOWELL TO BEGIN THE PROCEEDINGS, AND HE
REQUESTED JAMES K. LONTOS, THE CITY ENGINEER, TO GIVE AN EXPLANATION OF EACH SEGMENT
OF THE IMPROVEMENTS AND THE BASIS FOR THE ASSESSMENT RATES. HE STATED THE TOTAL COST
OF THE CONSTRUCTION WAS $1,248,514.4o; THE PROPERTY OWNERS ASSESSMENT IS $262,933.87;
THAT THE CITY'S PORTION IS $985,580.53, AND EXPLAINED THE MANNER IN WHICH SUCH PRO
RATA SHARE WAS COMPUTED. HE FURTHER EXPLAINED THAT THE PROJECT ALSO INCLUDES THE
CONSTRUCTION OF A CONCRETE SEAWALL ALONG OCEAN DRIVE FROM POENISCH TO SOUTH SHORE
DRIVE FOR THE PURPOSE OF CONTROLLING EROSION OF THE ROAD.
PROPERTY OWNERS IN THE AUDIENCE WERE GIVEN THE OPPORTUNITY TO QUESTION
MR. LONTOS, AT WHICH TIME MR. HOWELL WARD, ATTORNEY REPRESENTING MR. ROBERT C. KIRMSE,
ASKED WHETHER THERE WAS ANY DISTINCTION MADE BETWEEN VACANT PROPERTY AND RESIDENTIAL
PROPERTY, AND WAS TOLD THAT THERE WAS NOT. MR. WARD QUESTIONED OTHER ASPECTS OF THE
PROJECT, AS DID MRS. MARY DAIMWOOD BELL, PAT MORRIS, REPRESENTING J. J. TROMM AND
HENTON CONSTRUCTION COMPANY, AND DAVE COOVER, ATTORNEY FOR MORRIS L. LICHTENSTEIN,
MR. MCDOWELL CALLED ON MR. HAROLD CARR TO TESTIFY AS THE CITY'S EXPERT
WITNESS, AND ASKED PERMISSION FOR HIS STATEMENT OF QUALIFICATIONS TO BE DISPENSED WITH
AS MR. CARR HAS APPEARED IN THIS CAPACITY ON NUMEROUS OTHER OCCASIONS AND THE COUNCIL
IS FAMILIAR WITH HIS QUALIFICATIONS AS A REAL ESTATE APPRAISER. MR. CARR TESTIFIED
THAT HE HAD PERSONALLY VIEWED AND UNDERSTOOD THE EXTENT AND SPECIFICATIONS OF THE

PROPOSED IMPROVEMENTS, AND STATED THAT IN HIS OPINION, AFTER A FEW MINOR ADJUSTMENTS
ARE MADE WHICH ARE STILL TO BE DISCUSSED) THAT EACH AND EVERY PROPERTY WOULD BE
ENHANCED IN VALUE AT LEAST TO THE EXTENT OF THE PROPOSED ASSESSMENTS, WITH THE FOLLOW-
ING EXCEPTIONS:
ITEM C. E. AND DOROTHY STARRETT - THIS ASSE33MENT HAS ALREADY BEEN
ELIMINATED.
ITEM SEASIDE MEMORIAL CEMETERY - MR. CARR STATED THEY ALREADY HAVE
STANDARD CURB AND GUTTER AND TWO DRIVEWAYS. HE FURTHER STATED THAT THE PORTION OF
PLANTER IS CERTAINLY A STANDARD CURB AND GUTTER AND HE RECOMMENDS CREDIT FOR THIS.
ITEM , W. C. CUNNINGHAM - THIS PROPERTY HAS STANDARD CURB AND GUTTER IN
FRONT OF ABOUT VJ FEET OF ITS SAID MR. CARR, AND THERE IS A PRIVATE DRIVEWAY. MR.
CARR RECOMMENDS CREDIT ON THE PART OF PROPERTY HAVING THE STANDARD CURB AND GUTTER,
WHICH IS IN FRONT OF APPROXIMATELY ONE -HALF OF HIS PROPERTY.
ITEM #107, MAY DOUGHERTY CARR - THIS PROPERTY HAS STANDARD CURB AND GUTTER
IN FRONT OF A PORTION OF IT, WHICH IS HER HOME SITE, AND NEEDS TO BE MEASURED, ACCORD-
ING TO MR. CARR. MR. MARVIN TOWNSEND., CITY MANAGER, STATED IT IS HIS RECOMMENDATION
THAT AS LONG AS THERE 13 STANDARD CURB AND GUTTER, REGARDLESS OF ITS LOCATIONS THAT
MRS. CARR SHOULD RECEIVE CREDIT FOR THIS.
MR.7OARR,'4HOWEDaSLIDES TO MORE ACCURATELY PORTRAY THE CONDITION OF THE ROAD-
WAY AND ABUTTING PROPERTIES AS FAR AS THEIR APPEARANCE IS CONCERNED AND ALSO A PORTION
OF OCEAN DRIVE WHICH HAS ALREADY BEEN IMPROVED.
MAYOR BLACKMON STATED HE WOULD CALL THE NAMES OF THE PROPERTY OWNERS AS THEY
ARE LISTED ON THE ASSESSMENT ROLL AND INVITED EACH PROPERTY OWNER TO STATE HIS APPROVAL
OR OBJECTION TO ANY OF THE PROPOSED IMPROVEMENTS OR ASSESSMENTS TO HIS PROPERTY. THE
FOLLOWING PERSONS APPEARED:
ITEM 12, C. L. VAN CURA - HE STATED HE HAS STRENUOUS OBJECTIONS TO HIS
ASSESSMENT BECAUSE THE CITY TOOK PART OF HIS FRONTAGE AND GAVE A VERY SMALL FEE FOR
THE TAKING AND NOW HE IS BEING CHARGED FOR COMMERCIAL RATES, ALTHOUGH NOT ALL OF THE
PROPERTY IS BEING USED AS SUCH. HE SAID HE CANNOT SEE WHERE THERE IS ANY ENHANCEMENT
TO HIS PROPERTY. MR. VAN CURA STATED HE WANTED TO CALL THE COUNCILS ATTENTION TO
HIS OBJECTION PREVIOUSLY WITH SPECIAL REFERENCE TO THE USE AND ZONING OF 3221 OR
3223 OCEAN DRIVE, AND THE ASSESSMENT THEREON.
ITEM 9, FARRELL SMITH - MR. SMITH STATED HE RESERVES THE RIGHT TO WORK OUT
WITH THE RIGHT -OF -WAY DEPARTMENT THE EXACT DISTANCES BECAUSE IT SHOWS ON ITEM #7 A

LOT WHICH HE OWNS A PART OF AND THIS COULD IN EFFECT INCREASE HIS ASSESSMENT. HE
SAID HE HAD MADE A PRELIMINARY MEASUREMENT AND HE WOULD LIKE TO CHECK IT OUT AND
SUBMIT IT AS EVIDENCE.
SECONDLY, MR. SMITH BROUGHT UP THE SUBJECT OF AN ORDINANCE PROVISION'CON-
CERNING PROPERTY WHICH BACKS OR SIDES ONTO A STREET. HE HAS A MIXTURE OF ABOUT FIVE
OR SIX OUT OF THREE DIFFERENT SUBDIVISIONS WHERE THEY COME TOGETHER AND PART OF
THIS PROPERTY BACKS ONTO OCEAN DRIVE AND AT THAT POINT THE CITY OWNS A CONSIDERABLE
PORTION FOR A UTILITY EASEMENT. MR. SMITH STATED HIS HOME FRONTS ON MAVIS DRIVE,
THAT THE CITY HAS EASEMENTS FOR WATER, GAS, ETC,, WHICH GO THROUGH THERE AND ALSO
PREVENT ANY CONSTRUCTION. HE FURTHER STATED HE HAS NOTHING ABUTTING OCEAN DRIVE
WHERE HE NOW LIVES.
ITEM #23, MARY DAIMWOOD BELL - WHEN SINCLAIR WAS PAVED SHE HAD TO PAY FOR
CURBING AND SHE INQUIRED AS TO WHETHER OR NOT SHE WOULD GET ANY CREDIT FOR THIS
FORMER ASSESSMENT. MR. CARR STATED HE WOULD CHECK THIS OUT. MAYOR BLACKMON SAID
THAT SHE SHOULD �1HIAVE CREDIT WHETHER OR NOT THE CURBING IS USEABLE AT THIS TIME OR NOT.
ITEM #41, J. M. WILSON - HE REQUESTED AN OPENING ACROSS THE MEDIAN IN THE
MIDDLE OF THE BLOCK AND THE COUNCIL GAVE ITS APPROVAL FOR SAME.
ITEMS #42, #72, #103, #117, AND #129, FLATO BROS., ET AL - MR. FRED FLATO
STATED THAT THEY QUESTION THE ENHANCEMENT VALUE TO ANY OF THEIR PROPERTY AND THAT THE
IMPROVEMENT WILL ONLY HELP THE CITY HANDLE TRAFFIC MORE EFFICIENTLY.
ITEM*#45, MAY DOUGHERTY CARR - ATTORNEY BILL GRANBERRY, SPEAKING ON BEHALF
OF MRS. CARR, CALLED ATTENTION TO THE FACT THAT LOT 1, BLOCK 2, COLE PLACE, WAS SHOWN
ON THE ASSESSMENT ROLL, WHEREAS IT PROBABLY WAS INTENDED TO SHOW LOT 1, BLOCK 1, AND
THEREFORE NEEDS TO BE INVESTIGATED.
ITEM J107, MAY DOUGHERTY CARR - MR. GRANBERRY STATED THAT THIS PROPERTY IS
SUBJECT TO BEING MEASURED FOR CREDIT FOR EXISTING STANDARD CURB AND GUTTER; HE WOULD
LIKE TO CHECK THE FRONTAGE ON THESE LOTS. MR. GRANBERRY SAID THAT TECHNICALLY THE
HOUSE ACTUALLY FACES THE WATER AND BACKS ONTO OCEAN DRIVE, AND HE WOULD LIKE TO
REQUEST AN ADJUSTMENT ON THE ASSESSMENT.
ITEMS #46, 57A, 74, AND 131, - LORINE E. VOGT & KATHLEEN J. ALEXANDER AND
BENJAMIN E. ESHLEMAN, JR. - A SPOKESMAN FOR THE ABOVE NAMED STATED HE WANTS TO GO ON
RECORD AS SAYING THE PROPERTY WILL NOT BE ENHANCED TO THE VALUE OF THE ASSESSMENT.

ITEM M, DAVID 0. RUDINE (JAMAICAN APTS.) - MR. CHALMERS, CO -OWNER OF THE
JAMAICAN APARTMENTS OBJECTED TO THE THEORY OF ENHANCEMENT, BUT AGREES THAT CURBS
AND GUTTERS MAY ENHANCE. HE SAYS THAT OFTEN BUSINESS 13 HARMED BY HEAVY TRAFFIC
RATHER THAN ENHANCED.

ITEM #69, ROBERT C. KIRMSE - HOWELL WARD, ATTORNEY REPRESENTING MR. KIRMSE,
STATED THERE IS DOUBT THAT 'i REET IMPROVEMENTS WILL ENHANCE THE PROPERTY. MR. CARR
SAID THAT HE BELIEVES THAT IT WOULD BE AN ENHANCEMENT AS FAR AS THE SALE OF PROPERTY
GOES.
ITEM h84, ROBERT G. LIVINGTON - MR. LIVINGSTON WOULD LIKE TO GO ON RECORD
AS OPPOSING THE ASSESSMENTS AS HE FEELS THAT WIDENING OCEAN DRIVE 13 NOT GOING TO
ENHANCE THE VALUE OF HIS PROPERTY] BUT QUITE THE OPPOSITES AS ACCESSIBILITY TO OCEAN
DRIVE IS GOING TO BE MUCH MORE DIFFICULT THAN AT PRESENT.
ITEM p D. S. MENDLOWITZ - MR. MENDLOWITZ REQUESTED THE CITY TO EXTEND
UTILITIES TO HIS LOT. THE CITY MANAGER ASSURED HIM THAT UTILITIES ARE EXTENDED
ACROSS OCEAN DRIVE AT ROPES DRIVE AND THAT AS PART OF THE FUTURE DEVELOPMENT OF THAT
AREA THE OWNERS WILL BE REQUIRED TO MAKE THE PROPER EXTENSIONS TO THEIR LOTS FROM

MORE ENHANCEMENT THAN ANY OTHER, INASMUCH AS THE PROPERTY IN QUESTION HAS AN EXISTING
CURB ALONG THE BOUNDARY LINE AND PROPERTY LINE. MR. CARR REPLIED THAT UNIFORMITY

SAME OR ANY INTEREST THEREIN, BE AND THE SAME IS HEREBY CLOSED AND ALL PRO-
TESTS AND OBJECTIONS, WHETHER SPECIFICALLY MENTIONED OR NOT, SHALL BE, AND

MENTS TO SAID PORTION OF SAID STREET UPON WHICH SAID PROPERTY ABUTS, WILL
BE IN EXCESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENTS AS PROPOSED TO
BE, AND AS HEREIN ASSESSED AGAINST SAID ABUTTING PROPERTY AND THE REAL AND

OCEAN DRIVE IMPROVRAKMPS UNIT III
•Hewit Drive to 595' East of Airline Road
This project number 220 -67 -97 includes the reconstruction of Ocean Drive from
Hewit Drive to approximately 595' East of Airline Road.
The improvements consist of excavation to a width to permit the construction
of curbs and gutters, the placing of 9" lime- stabilized base, 9" compacted
caliche base, the application of a prime coat; and the laying of 200 # per
s.y. of Type A Asphaltic Concrete, and 125 # per s.y. of Type D Asphaltic
Concrete
Width of street varies at intersections, but generally it is 73' from face
to face of curbs on either side of street. This width provides two moving
lanes in each direction, one safety shoulder, each direction, and 8' wide
median in the center with varying widths at intersections. Median consists
of curb and gutter, filled with top soil for future landscaping.
Concrete sidewalks are included along all the west side and adjacent to apart-
ment zoned property along the east side from C/L of Robert Drive southward,
varying in width from 3' to 5' wide and tied to the curb. Concrete driveways
are also included, which are to be built as shown in the plans unless other-
wise changed by the owners.
Assessment rates have been calculated on the basis of applying the unit
prices obtained by bids and calculation of the quantities for the improve-
ment abutting the property.
Credits have been given to property owners for the existing concrete drive-
ways and sidewalks in public right of way. No credits, however, have been
given to property owners for other improvements such as pavements, curbs,
and gutters, since these improvements are not of permanent nature.
The assessment rates are as follows:

FRONTAGE OF SAID PROPERTY AND THE ACTUAL COST OF SAID IMPROVEMENTS, THE
AMOUNT NAMED IN SAID CERTIFICATE IN NO CASE TO EXCEED THE AMOUNT HEREIN
ASSESSED AGAINST SUCH PROPERTY UNLESS SUCH INCREASE BE CAUSED BY AN EXCESS
OF FRONT FOOTAGE OVER THE AMOUNT HEREINABOVE STATED, SUCH ACTUAL COST AND

SAID PROPERTY AVAILING THEMSELVES OF OPTION "2" OR "T'
ABOVE SHALL HAVE THE PRIVILEGE OF PAYING ONE, OR ALL, OF
SUCH INSTALLMENTS AT ANY TIME BEFORE MATURITY THEREOF BY
PAYING THE TOTAL AMOUNT OF PRINCIPAL DUE, TOGETHER WITH

SECTION 6. THAT FOR THE PURPOSE OF EVIDENCING SAID ASSESSMENTS,
THE LIENS SECURING SAME AND THE SEVERAL SUMS ASSESSED AGAINST THE SAID PAR-
CELS OF PROPERTY AND THE REAL AND TRUE OWNER OR OWNERS THEREOF AND THE ]ME
AND TERMS OF PAYMENT, AND TO AID IN THE ENFORCEMENT THEREOF, ASSIGNABLE
CERTIFICATES SHALL BE ISSUED BY THE CITY OF CORPUS CHRISTI, TEXAS TO ITSELF

SEAL OF SAID CITY1 AND WHICH CERTIFICATES SHALL DECLARE THE AMOUNTS OF SAID
ASSESSMENTS AND THE TIMES AND TERMS THEREOF, THE RATE OF INTEREST THEREON,
THE DATE OF THE COMPLETION AND ACCEPTANCE OF THE IMPROVEMENTS FOR WHICH THE
CERTIFICATE IS ISSUED, AND SHALL CONTAIN THE NAMES OF THE APPARENT TRUE
OWNER OR OWNERS AS ACCURATELY AS POSSIBLE, AND THE DESCRIPTION OF THE
PROPERTY ASSESSED BY LOT AND BLOCK NUMBERS OR FRONT FOOT THEREOF1 OR SUCH
OTHER DESCRIPTION AS MAY OTHERWISE IDENTIFY THE SAME, AND IF THE SAID PRO-
PERTY SHALL BE OWNED BY AN ESTATE OR FIRM, THEN TO SO STATE THE FACT SHALL
BE SUFFICIENT AND NO ERROR OR MISTAKE IN DESCRIBING SUCH PROPERTY OR IN GIVING
THE NAME OF ANY OWNER OR OWNERS, OR OTHERWISE, SHALL IN ANYWISE INVALIDATE
OR IMPAIR THE ASSESSMENT LEVIED HEREBY OR THE CERTIFICATE ISSUED IN EVIDENCE

ABLE ATTORNEYS FEES AND ALL EXPENSES AND COSTS OF COLLECTION, IF INCURRED,
AND SAID CERTIFICATE SHALL SET FORTH AND EVIDENCE THE PERSONAL LIABILITY
OF THE REAL AND TRUE OWNER OR OWNERS OF SUCH PROPERTY, WHETHER NAMED OR
CORRECTLY NAMED THEREIN OR NOTI AND THE LIEN UPON SUCH PROPERTY AND THAT
SAID LIEN IS FIRST AND PARAMOUNT THEREON SUPERIOR TO ALL OTHER LIENSj TITLES

LARLY HAD IN COMPLIANCE WITH THE LAW AND CHARTER IN FORCE IN SAID CITY AND
THE PROCEEDINGS OF SAID CITY COUNCIL OF SAID CITY, AND THAT ALL PREREQUISITES
TO THE FIXING OF THE ASSESSMENT LIEN AGAINST THE PROPERTY THEREIN DESCRIBED,
OR ATTEMPTED TO BE DESCRIBED, AND THE PERSONAL LIABILITY OF THE REAL AND
TRUE OWNER OR OWNERS THEREOF, EVIDENCED BY SUCH CERTIFICATES, HAVE BEEN
REGULARLY DONE AND PERFORMED, WHICH RECITALS SHALL BE EVIDENCE OF ALL THE
MATTERS AND FACTS SO RECITED AND NO FURTHER PROOF THEREOF SHALL BEREQUIRED
IN ANY COURT.
THAT SAID CERTIFICATES SHALL FURTHER PROVIDE IN EFFECT THAT THE
CITY OF CORPUS CHRISTI, TEXAS, SHALL EXERCISE ALL OF ITS LAWFUL POWERS, IN
THE ENFORCEMENT AND COLLECTION THEREOF AND SAID CERTIFICATES MAY CONTAIN
OTHER AND FURTHER RECITALS, PERTINENT AND APPROPRIATE THERETO. IT SHALL
NOT BE NECESSARY THAT SAID CERTIFICATES SHALL BE IN THE EXACT FORM AS ABOVE
SET FORTHI BUT THE SUBSTANCE AND EFFECT THEREOF SHALL SUFFICE.

SECTION 7. THAT ALL SUCH ASSESSMENTS LEVIED ARE A PERSONAL LIA-
BILITY AND CHARGE AGAINST THE REAL AND TRUE OWNER OR OWNERS OF THE PROPERTY
DESCRIBED OR ATTEMPTED TO BE DESCRIBED, NOTWITHSTANDING SUCH OWNER OR
OWNERS MAY NOT BE NAMED OR CORRECTLY NAMED, AND ANY IRREGULARITY IN THE NAME
OF THE PROPERTY OWNER, OR THE DESCRIPTION OF ANY PROPERTY OR THE AMOUNT OF
ANY ASSESSMENTS OR IN ANY OTHER MATTER OR THING SHALL NOT IN ANYWISE INVALI-
DATE OR IMPAIR ANY ASSESSMENT LEVIED HEREBY OR ANY CERTIFICATE ISSUED AND
SUCH MISTAKE, OR ERRORS INVALIDITY OR IRREGULARITY WHETHER IN SUCH ASSESSMENT
OR IN THE CERTIFICATE ISSUED IN EVIDENCE THEREOF MAY BED BUT IS NOT REQUIRED
TO BED TO BE ENFORCEABLE, AT ANY TIME CORRECTED BY THE SAID CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI. FURTHER THAT THE OMISSION OF SAID IMPROVEMENTS
IN FRONT OF ANY PART OR PARCEL OF PROPERTY ABUTTING UPON THE AFOREMENTIONED
STREETS, WHICH IS EXEMPT FROM THE LIEN OF SAID ASSESSMENTS SHALL IN NO WISE
AFFECT OR IMPAIR THE VALIDITY OF ASSESSMENTS AGAINST THE OTHER PARCELS OF
PROPERTY ABUTTING UPON SAID STREET; AND THAT THE TOTAL AMOUNTS ASSESSED
