HomeMy WebLinkAbout09070 ORD - 10/09/1968B,Iw :I 0/9/68 ; ' AN ORDINANCE APPROVING AND ADOPTING THE DIRECTOR OF PUBLIC WORKS' WRITTEN STATEMENT AND REPORT OF THE ESTIMATES OF THE VARIOUS COSTS FOR THE IMPROVEMENTS OF THAT PORTION OF OCEAN DRIVE, FROM HEWIT DRIVE TO AIRLINE ROAD; AND DETERMINING AND FIXING THE PORTION OF SAID COSTS TO BE PAID BY THE CITY OF CORPUS CHRISTI; DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUT- TING PROPERTY; ORDERING AND SETTING A HEARING TO BE HELD ON NOVEMBER *,1968, TO GIVE NOTICE OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE OF TEXAS AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, HERETOFORE ON THE 21ST DAY OF AUGUST, 1968, BY DULY ENACTED ORDINANCE DETERMINED THE NECESSITY FOR AND ORDERED THE IMPROVEMENT OF THE PORTION OF OCEAN DRIVE, FROM HEWIT DRIVE TO AIRLINE ROAD, A DULY EXECUTED NOTICE OF SAID ORDINANCE HAVING THEREAFTER BEEN FILED IN THE NAME OF THE CITY WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS; AND WHEREAS, ACCORDING TO THE WRITTEN STATEMENT OF THE DIRECTOR OF PUBLIC WORKS, THE NAMES OF THE APPARENT OWNERS OF THE PROPERTY ABUTTING ON SAID OCEAN DRIVE, THE DESCRIPTION OF THEIR PROPERTY, THE NUMBER OF FRONT FEET OWNED BY EACH, THE ASSESSMENTS RATES IN SQUARE AND LINEAL FEET, THE AMOUNT TO BE ASSESSED AGAINST EACH ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS THEREOF AND OTHER MATTERS CONTAINED IN SAID STATEMENT FILED BY THE DIRECTOR OF PUBLIC WORKS AND HERETOFORE RECEIVED BY THE COUNCIL ARE AS FOLLOWS: 9070 OCEAN DRIVE IMPROVEMENTS UNIT III •Hewi.t Drive to 595' East of Airline Road This project number 220 -67 -97 includes the reconstruction of Ocean Drive from Hewit Drive to approximately 595' East of Airline Road. The improvements consist of excavation'to a width to permit the construction of curbs and gutters, the placing of 9" lime - stabilized base, 9" compacted caliche base, the application of a prime coat; and the laying of 200 -# per s.y. of Type A Asphaltic Concrete, and 125 -r per s.y. of Type D Asphaltic Concrete Width of street varies at intersections, but generally it is 73' from face to face of curbs on either side of street. This width provides two moving lanes in each direction, one safety shoulder, each direction, and 8' wide median in the center with varying widths at intersections. Median consists of curb and gutter, filled with top soil for fixture landscaping. Concrete sidewalks are included along all the west side and adjacent to apart- ment zoned property along the east side from C/L of Robert Drive southward, varying in width from 3' to 5' wide and tied to the curb. Concrete driveways are also included, which are to be built as shown in the plans unless other- wise charged by the owners. Assessment rates have been calculated on the basis of applying the unit prices obtained by bids and calculation of the quantities for the improve - ment abutting the property. Credits have been given to property owners for the existing concrete drive- ways and sidewalks in public right of way. No credits, however, have been given to property owners for other improvements such as pavements, curbs, and gutters, since these improvements are not of permanent nature. The assessment rates are as follows: 1. Property zoned and used R -1 or R -2 . Curb,gutter, and pavement $5,88 p.l.f. 2. Property zoned or used other than R -1 or R -2 Curb,gutter, and pavement 17.65 p.l.f. Sidewalk .43 p.s.f. Driveway .85 p.s.f. The project also includes the construction of a concrete seawall along Ocean Drive from Poenisch to South Snores Drive for the purpose of controlling ero- sion of the road. THE FACT THAT THE STREET WITHIN THE LIMITS ABOVE DEFINED IS BADLY IN NEED AT THIS TIME OF PERMANENT STREET IMPROVEMENTS, AND THE FURTHER FACT THAT THE PRESENT CONDITION OF SAID PORTIONS OF SAID STREET ARE DANGEROUS TO THE HEALTH AND PUBLIC WELFARE OF THE INHABITANTS OF THE CITY OF CORPUS CHRISTI DUE TO THE CONDITIONS AND INCREASE OF TRAFFIC ALONG SAID PORTION OF SAID STREET CREATES A PUBLIC EMERGENCY AND PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF OCTOBER, 1968.
