AN ORDINANCE
APPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND
FUND THE SUM OF $725 FOR ACQUISITION OF PARCEL
NO. 14,HILLTOP INTERCEPTOR, LINE 34 -A, SECTION II,
APPLICABLE TO PROJECT 250 -64 -36.5; AUTHORIZING AND
DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF
THE CITY OF CORPUS CHRISTI, TO ACQUIRE THE AFORE-
SAID PARCEL NO. 14 FROM THE OWNER, MARTHA S. DAVIS
VAN METRE, BY PROPER CONVEYANCE AND BY THE EXECU-
TION OF SUCH OTHER INSTRUMENTS AS MAY BE NECESSARY;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THERE IS HEREBY APPROPRIATED OUT OF N0. 250
SANITARY SEWER BOND FUND THE SUM OF $725 FOR ACQUISITION OF PARCEL NO. 14,
HILLTOP INTERCEPTOR, LINE 34 -A, SECTION 11, APPLICABLE TO PROJECT 250 -64 -36.5,
SAID PARCEL BEING DESCRIBED AS FOLLOWS:
BEING A 50 FOOT WIDE BY 210.0 FOOT LONG UTILITY EASEMENT OUT
OF SURVEY N0. 3o4 AND OUT OF THE MARTHA S. DAVIS 0.506 ACRE
TRACT AS DESCRIBED BY DEED RECORDED IN VOLUME 1185 PAGE 270,
NUECES COUNTY, TEXAS DEED RECORDS AND MORE PARTICULARLY
DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING AT THE POINT OF INTERSECTION OF THE NORTHEAST RIGHT
OF WAY LINE OF UPRIVER ROAD AND THE NORTHWEST LINE OF SAID
DAVIS TRACT FOR THE SOUTHWEST AND BEGINNING CORNER OF THE
TRACT HEREIN DESCRIBED,
THENCE N. 22° 521 E, WITH THE NORTHWEST LINE OF SAID DAVIS
TRACT, A DISTANCE OF 210.0 FEET TO A POINT, THE NORTHWEST
CORNER OF SAID DAVIS TRACT AND THE NORTHWEST CORNER OF THE
TRACT HEREIN DESCRIBED,
THENCE S. 67' 081 E, WITH THE NORTHEAST LINE OF SAID DAVIS
TRACT, A DISTANCE OF 50.0 FEET TO A POINT FOR THE NORTHEAST
CORNER OF THE TRACT HEREIN DESCRIBED,
THENCE S. 220 521 W, A DISTANCE OF 210.0 FEET TO A POINT IN
THE NORTHEAST RIGHT OF WAY LINE OF 60 FOOT WIDE UPRIVER ROAD
FOR THE SOUTHEAST CORNER OF THE TRACT HEREIN DESCRIBED,
THENCE N. 67° 081 W, WITH THE NORTHEAST RIGHT OF WAY LINE OF
SAID UPRIVER ROAD, A DISTANCE OF 50.0 FEET TO THE PLACE OF
BEGINNING.
SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI, WITH THE OWNER, MARTHA S. DAVIS VAN METRE, OF CORPUS
CHRISTI, TEXAS.
SECTION 3. THE NECESSITY TO EXECUTE THE AFORESAID REAL ESTATE
SALES CONTRACT IN ORDER TO ACQUIRE THE PARCEL OR TRACT OF LAND FOR THE CITY

CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR
HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED
THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY 30 ORDAINED, THIS THE
DAY OF OCTOBER, 1968.

contract, agreement, obligation, or expenditure contemplated in the above
and foregoing ordinance is in the Treasury of the City of Corpus Christi
to the credit of No. 250 Sanitary Sewer Bond Fund
$725.00 Project No. 250 -64 -36.5
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
