HomeMy WebLinkAbout09121 ORD - 11/13/1968• BJw:11/13/68 1 1 • AN ORDINANCE APPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND FUND THE SUM OF $50.00 FOR THE ACQUISITION OF PARCEL NO. 2, HILLTOP MAIN, LINES 31 -A AND 31 -B, APPLICABLE TO PRO- JECT NO. 25o -64 -36.9; AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO ACQUIRE THE AFORESAID PARCEL FROM THE OWNERS, E. N. FULGHUM AND A. G. RHODES, BY PROPER CONVEYANCE AND BY THE EXECUTION OF SUCH OTHER INSTRUMENTS AS MAY BE NECESSARY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF N0. 250 SEWER BOND FUND THE SUM OF $50.00, FOR THE ACQUISITION OF PARCEL N0. 2, HILLTOP MAIN LINES 31 -A AND 31 -8, APPLICABLE TO PROJECT No. 250 -64 -36.9, SAID PARCEL OF LAND BEING DESCRIBED AS FOLLOWS: PARCEL NO. 2 A TRIANGULAR TRACT OF LAND OUT OF THAT CERTAIN TRACT OF LAND CONVEYED BY MITTIE MAY BEVERLY TO E. N. FULGHUM BY WARRANTY DEED DATED JUNE 1, 1956, AND RECORDED IN VOL. 736, PAGE 223 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS, SAID TRIANGULAR TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING AT THE EAST CORNER OF THE SAID E. N. FULGHUM TRACT FOR A CORNER OF THIS TRACT; THENCE S. 62° 41, W. ALONG THE E. N. FULGHUM TRACT, A DISTANCE OF 39.63 FEET TO A POINT FOR A CORNER OF THIS TRACT; THENCE N. 35° 241 E. A DISTANCE OF 34.62 FEET TO A POINT IN THE NORTHEAST BOUNDARY LINE OF SAID E. N. FULGHUM TRACT FOR A CORNER OF THIS TRACT; THENCE S. 56° 231 E. WITH THE NORTHEAST BOUNDARY LINE OF SAID E. N. FULGHUM TRACT A DISTANCE OF 18.18 FEET TO THE PLACE OF BEGINNING. AND ALSO THE RIGHT TO USE THE LAND EXTENDING 20 FEET TO THE NORTHWEST OF THE ABOVE DESCRIBED TRACT DURING THE PERIOD OF CONSTRUCTION OF A SANITARY SEWER LINE. SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF THE ABOVE DESCRIBED PARCEL FROM E. N. FULGHUM AND A. G. RHODES, THE OWNERS. .J1-21- SECTION 3. THE NECESSITY TO MAKE THE APPROPRIATION DESCRIBED ABOVE AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE NECESSARY INSTRUMENTS FOR THE PURCHASE OF THE ABOVE DESCRIBED PARCEL OF LAND SO THAT THE PROJECT DESCRIBED HEREINABOVE MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF NOVEMBER, 1968.
