HomeMy WebLinkAbout09140 ORD - 11/27/19680 11 -26 -68 :FMB • AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF THE PROPOSAL OF AMEND- MENT OF THE ENGINEERING CONTRACT WITH REAGAN AND McCAUGHAN, DATED NOVEMBER 20, 1967, AUTHORIZED BY ORDINANCE NO. 8655, AS AMENDED BY AUTHORITY OF ORDI- NANCE NO. 9115, DATED NOVEMBER 6, 1968, CONCERNING ENGINEERING SERVICES IN CONNECTION WITH IMPROVEMENTS TO THE WATER DISTRIBUTION SYSTEM IN THE CITY OF CORPUS CHRISTI, TO COMPLY WITH THE REQUIREMENTS OF THE ECONOMIC DEVELOPMENT ADMINISTRATION AS OUTLINED IN THEIR MANUAL ENTITLED "REQUIREMENTS FOR APPROVED PROJECTS, SECOND EDITION," DATED MARCH 15, 1968, WITHOUT ANY ADDITIONAL COST TO THE CITY, ALL AS MORE FULLY SET FORTH IN THE PROPOSAL OF THE SAID REAGAN AND McCAUGHAN, DATED NOVEMBER 8, 1968, A COPY OF WHICH PROPOSAL IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE NECESSITY TO AMEND THE CONTRACT HERETOFORE ENTERED INTO BETWEEN THE CITY AND REAGAN AND MCCAUGHAN AS HEREINABOVE SET FORTH CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND 91 4.0.l' C. O, Box 1622 Corpus Christi, Texas 78403 Dear Mr. Townsend: 320 WILSON 6UILOINO CORPUS CHRISTI, TEAS 76401 by � iJ hOV 1968 City Manasst To comply with the requirements of the Economic Development Adminis- tration as outlined in their Manual entitled "Requirements for Approved Projects, Second Edition dated March 15, 1968, we recommend that the portion of our Engineering Contract, dated November 20, 1967, and in- cluding that portion added by letter agreement dated October 25, 1968 and approved by the City Council on November 6, 1968, be amended to include the 12 items of work shown in Section I, paragraph 2B of the above Manual and specifically set out as follows: (1) Provide sufficient plans, specifications, bid sheets, cost estimates, design analysis, and other contract documents required for the project. (2) Attend bid openings and prepare and submit tabulations of bids. (3) Review Proof of Bidders Qualifications and recommend appro- val or disapproval. (4) Provide surveillance of project construction to assure com- pliance with plans, specifications, and all other contract documents. (5) Prepare and submit proposed contract change orders when applicable. (6) Submit a monthly report to the Grantee /Borrower and a copy of the report to the Construction Management Branch, EDA Area Office covering the general progress of the job and describing any problems or factors contributing to delay. Page 2 Mr. Marvin Townsend November 8, 1968 (7) Review and approve the contractors' schedule of amounts for contract payment. (8) Certify partial payments to contractors. (9) Assure that a ten percent (1016) retainage is withheld from all payments on construction contracts (see Section 25 of the General Conditions, Exhibit "R "), until final acceptance by Grantee /Borrower and approval_ by the Construction Manage- ment Branch, EDA Area Office. is (10) Prepare "as- built" drawings after completion of the project. One copy will be furnished to the Construction Management Branch, EDA Area Office within 60 days after all construction has been completed and the final inspection has been performed. (11) Review and approve contractors' submission of samples and shop drawings where applicable. (12) Comply with all applicable provisions of the Regulations of the United States Department of Commerce (Part 8 of Subtitle 15 of the Code of Federal Regulations) issued pursuant to the Civil Rights Act of 1964, in regard to nondiscrimination in employ- ment because of race, creed, color, or national origin. " The above services are to be included in our contract for that portion of the work to be included in E. D. A. Projects whether or not they are specifically mentioned in the contract. If this is satisfactory with the City the amendment can be made as required by your legal department, or by approval of this letter of recommendation.
