AN ORDINANCE
APPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND FUND
THE SUM OF $982.00 FOR ACQUISITION OF PARCEL NO. 13,
HILLTOP INTERCEPTOR, LINE 34 -A, SECTION 11, APPLICABLE
TO PROJECT 250 -64 -36.5; AUTHORIZING AND DIRECTING THE
CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, TO ACQUIRE THE AFORESAID PARCEL NO. 13 FROM
THE OWNER, RAY J.E. BERKELAND AND WIFE LOLA BERKELAND,
BY PROPER CONVEYANCE AND BY THE EXECUTION OF SUCH
OTHER INSTRUMENTS AS MY BE NECESSARY; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF NO. 250 SANITARY
SEWER BOND FUND THE SUM OF $982.00 FOR THE ACQUISITION OF PARCEL NO. 13,
HILLTOP INTERCEPTOR, LINE 34 -A, SECTION 11, APPLICABLE TO PROJECT
ND. 250 -64 -36.5, SAID PARCEL OF LAND BEING DESCRIBED AS FOLLOWS:
PARCEL NO. 13
BEING A 60 FOOT WIDE UTILITY EASEMENT OUT OF SURVEY N0. 304
AND OUT OF THE RAY J. BERKELAND 3.67 ACRE TRACT AS DESCRIBED
BY DEED IN VOLUME 1033 PAGE 272, NUECES COUNTY, TEXAS DEED
RECORDS AND MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS
AS FOLLOWS:
BEGINNING AT A POINT IN THE NORTHEAST LINE OF SAID BERKELAND
TRACT, SAID POINT BEING 341.27 FEET, S. 28° 40' E. FROM THE
NORTHEAST CORNER OF SAID BERKELAND TRACT FOR THE NORTHEAST
AND BEGINNING CORNER OF THE TRACT HEREIN DESCRIBED;
THENCE CONTINUING S. 28° 4Ol E., WITH THE NORTHEAST LINE OF
SAID BERKELAND TRACT, A DISTANCE OF 62.26 FEET TO A POINT
FOR CORNER;
THENCE S. 76° 58' W., A DISTANCE OF 12.25 FEET TO A POINT
FOR AN INTERIOR CORNER OF THE TRACT HEREIN DESCRIBED;
THENCE S. 22' 52' W., A DISTANCE OF 165.32 FEET TO A POINT
IN THE MOST EASTERLY SOUTH LINE OF SAID BERKELAND TRACT FOR
CORNER;
THENCE N. 67° O8, W., WITH THE MOST EASTERLY SOUTH LINE OF
SAID BERKELAND TRACT, A DISTANCE OF 60.0 FEET TO A POINT
FOR CORNER;
THENCE N. 22° 521 E., A DISTANCE OF 195.96 FEET TO A POINT
FOR CORNER;
THENCE N. 76° 581 E., A DISTANCE OF 26.25 FEET TO THE PLACE
OF BEGINNING;
ALSO THE RIGHT TO USE THE LAND EXTENDING 40 FEET SOUTHEAST
OF THE ABOVE DESCRIBED EASEMENT DURING THE PERIOD OF CON-
STRUCTION OF A SANITARY SEWER LINE.

SECTION P. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF
THE CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF THE ABOVE DESCRIBED PARCEL
FROM RAY J. E. BERKELAND AND WIFE LOLA BERKELAND.
SECTION 3. THE NECESSITY TO MAKE THE APPROPRIATION DESCRIBED
ABOVE AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE NECESSARY INSTRUMENTS
FOR THE PURCHASE OF THE ABOVE DESCRIBED PARCEL OF LAND SO THAT THE PROJECT
DESCRIBED HEREINABOVE MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY
AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED
SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION
OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE J/-&� DAY

ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
