AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AN AGREEMENT BETWEEN THE CITY AND CORPUS CHRISTI
STAKE BRANCH GENEALOGICAL LIBRARY OF THE CHURCH OF
JESUS CHRIST OF LATTER DAY SAINTS FOR THE ESTABLISH-
MENT OF A LOCAL GENEALOGICAL LIBRARY FOR RESEARCH BY
MEMBERS OF THE SAID CHURCH OF JESUS CHRIST OF LATTER
DAY SAINTS AND THE GENERAL PUBLIC, A COPY OF SAID
AGREEMENT BEING ATTACHED HERETO AND MADE A PART HERE-
OF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI,
FOR AND ON BEHALF OF SAID CITY, BE AND HE IS HEREBY AUTHORIZED AND DIRECTED
TO EXECUTE AN AGREEMENT BETWEEN THE CITY AND CORPUS CHRISTI STAKE BRANCH
GENEALOGICAL LIBRARY OF THE CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS FOR
THE ESTABLISHMENT OF A LOCAL GENEALOGICAL LIBRARY FOR RESEARCH BY MEMBERS
OF THE SAID CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS AND THE GENERAL
PUBLIC, A COPY OF SAID AGREEMENT BEING ATTACHED HERETO AND MADE A PART
HEREOF.
SECTION 2. THE NECESSITY TO IMMEDIATELY EXECUTE THE AFORESAID
AGREEMENT SO THAT THE TERMS AND CONDITIONS SET FORTH THEREIN CAN BE EFFECTED
WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION
SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI-
NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO
EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS
ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS
PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE / /IAY OF DECEMBER,

AGREEMENT,
THIS AGREEMENT, duly executed this day of ,
19 , in duplicate original, by and between CORPUS CHRISTI STARE
BRANCH GENEALOGICAL LIBRARY OF THE CHURCH 08 JESUS CHRIST OF LATTER
DAY SAINTS, hereinafter referred to as "Branch Library" and the City
of Corpus Christi, a municipality of the state of Texas hereinafter
further identified as the "City of Corpus Christi."
WITNESSE'TH:
WHEREAS, Branch Library desires to establish a local
genealogical library for genealogical research by members of the
Church of Jesus Christ of Latter -day Saints and the general public;
and,
F4EEREAS, the City of Corpus Christi -maintains a public li-
brary providing facilities, and reference works normally available in
institutions of this kind; and
WHEREAS, the parties desire jointly to provide a genealo-
gical research facility within the City of Corpus Christi's public
library wherein members of said Church and the general public may
conduct research in this field of knowledge;
NOW TORE, for the purpose of accomplishing the aims
indicated above and in consideration of the mutual covenants and con-.
ditiona herein provided, the parties agree as follows:
1. The City of Corpus Christi shall provide for the use
and benefit of Branch Library a separate room, which
will also contain genealogy and related materials be-
longing to the public library, in its physical plant
and facilities sufficient for the Branch Library to
store and maintain the reference works, materials
and equipwent to be used by it, which facilities shall
include, at least, the following:

e. Adequate storage space to meet the requirements of
Branch Library as may be specifically indicated by
a mutually agreeable separate written statement and
which requirement may vary from time to time as
Branch Library expands or reduces its facilities.
b. A reading area at least large enough to accommodate
two microfilm reading machines with about twenty -five
square feet of space for each reader, a film cabinet,
tables and chairs, which apace shall be satisfactori-
ly lighted and otherwise maintained to meet the spe-
cific aeede of microfilm reading.
c. Modern shelving and storage facilities with ready ac-
cess thereto by personnel of Branch Library to make
such materials available to the public.
d. The area of the City of Corpus Christi's facility as-
signed to the Branch Library shall be available to it
and the geeeral public during the same hours maintained
by the City of Corpus Christi in connection with its
own facilities.
2. Records, books, films, reading machines, research facili-
ties and other materials of the Branch Library shall be
similarly housed and available to the public and such items
shall be non - religious in character and shall contain only
material related to genealogy.
3. Branch Library shall be solely responsible for all books,
records, films and other equipment and properties of the
Genealogical Society of the Church of Jesus Christ of.
Latter -day Saints coming into its hands or into the fa-
cilities jointly occupied by the parties hereto. Such
items which are the property of the CenealogLcal Society
of the Church of Jesus Christ of Letter -day Saints shall
not be comingled with property of either Branch Library
or the City of Corpus Christi; however, all additions
to the branch library collection shall -have the approval
of the City Library Director.
4.- Branch Library shall, upon request, and under such re-
gulatione.as may from time to time be adopted by it in
conference and in agreement with the City of Corpus Christi
for handling cost thereof, procure, to -the extent that
the same are available for public use through Branch
Libraries from the Genealogical Society of the Church of
Jesus Christ of Latter -day Saints and its library at Salt
Lake City, Utah, genealogical records which are on micro-
film old 'requested by patrons, and make the -same available
for public use in the rooms and quarters provided by the
City of Corpus Christi without discrimination as to any
person, race, color, or creed whatsoever or whomsoever.
Use of such records in the branch library shall be made
subject to.uniform library rules applicable to all persons
alike.
5.. Distinguishing characteristics and markings shall be
placed by Branch Library on all reference works, material,
equipment and personal property of Branch Library by clear-
ly and distinctively marking each item in such a manner
that the same can be easily inventoried and shall not be-
come confused with assets of the City of Corpus Christi.
The use of physical properties in said library, whether
books, records, films or otherwise, by either party or
the public shall not be construed under any circumstances
as passing title thereto from or to any other party.

b. The facilities to be provided by the City of Corpus
Christi shall be without cost to the Branch Library
but it is understood that the Branch Library will
wholly support and maintain itself as to coat of es•
tabliehing and maintaining its library and providing
personnel in connection therewith.
The City of Corpus Christi shall have no financial
responsibility for the Branch Library and the Branch
Library shall be alone responsible for paying current-
ly all required deposits, payments of postage, rentals
and other similar expenses upon receipt from return of
items to the Genealogical Library in Salt Lake City,
Utah.
7. A genealogical librarian shall be provided by Branch
Library without coat to the City of Corpus Christi, it
being understood and agreed that the qualifications of
such a librarian shall be determined by Branch Library
so long as the librarian is qualified to meet the needs
of researchers and others of the general public using
these facilities. Assistant librarians, if needed, shall
also be provided by Branch Library without cost to owner.
8. This Agreement shall continue under the same terms and
conditions provided herein, unless amended by mutual
agreement in writing, until such time as either party
may desire to terminate this Agreement.
a. Either party may terminate this Agreement upon 90
days by furnishing written notice to the other party.
b. Upon termination, Branch Library shall have a reason•
able opportunity and time within which to remove its
equipment and properties from the aforesaid facilities
at its own expense.

be provided by Branch.Library and the City of Corpus
Christi together with weaselly rental or otherwise to
