AN ORDINANCE
RECEIVING AND ACCEPTING CONSTRUCTION OF THE SOUTH PADRE
ISLAND DRIVE, TULOSO CIRCLE AND GREENWOOD DRIVE SANITARY
SEWER IMPROVEMENTS, PROJECT NO. 250- 67 -65, AS PERFORMED
BY THE CONTRACTOR, MANSHEIM COMPANY, UNDER THEIR CONTRACT
DATED APRIL 17, 1968, AUTHORIZED BY ORDINANCE NO. 88140;
AUTHORIZING PAYMENT OF FINAL ESTIMATE NO. 6, DATED
NOVEMBER 25, 1968, IN THE AMOUNT OF $9,312.214, A COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, SAID PAY-
MENT TO BE MADE FROM NO. 250 SANITARY SEWER BOND FUNDS
PREVIOUSLY APPROPRIATED; GRANTING A 13 -1/2 DAY EXTENSION
OF CONTRACT TIME FOR PROJECT COMPLETION; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CONSTRUCTION OF THE SOUTH PADRE ISLAND DRIVE,
TULOSO CIRCLE AND GREENWOOD DRIVE SANITARY SEWER IMPROVEMENTS, PROJECT
NO. 250- 67 -65, AS PERFORMED BY THE CONTRACTOR, MANSHEIM COMPANY, UNDER THEIR
CONTRACT DATED APRIL 171 1968, AUTHORIZED BY ORDINANCE N0. 88140, HAVING BEEN
PERFORMED AND COMPLETED IN ACCORDANCE WITH THE TERMS AND PROVISIONS OF THE
CONTRACT, PLANS AND SPECIFICATIONS THEREIN CONTAINED, EXCEPT AS HEREINAFTER
PROVIDED, AND THE DIRECTOR OF PUBLIC WORKS HAVING INSPECTED THE SAME AND
CERTIFIED TO THE COMPLETION OF SAID WORK IN ACCORDANCE WITH SAID PLANS AND
SPECIFICATIONS, EXCEPT AS HEREINAFTER SET FORTH, AND IS HERE AND NOW ACCEPTED
AND RECEIVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY GRANTED A CONTRACT TIME EXTENSION OF
13 -1/2 DAYS FOR COMPLETION OF THE HEREINABOVE DESCRIBED CONTRACT.
SECTION 3. THAT FINAL PAYMENT IS HEREBY AUTHORIZED AS DUE UNDER
THE CONTRACT AND AS SET OUT IN FINAL ESTIMATE N0. 6, ATTACHED HERETO AND
MADE A PART HEREOF, PREPARED BY THE DIRECTOR OF PUBLIC WORKS DATED
NOVEMBER 25, 1968, IN THE AMOUNT OF $9,312.214, FROM FUNDS PREVIOUSLY
APPROPRIATED.
SECTION 14. THE NECESSITY FOR COMPLETION OF SUCH WORK BY SAID
ACCEPTANCE AND FINAL PAYMENT IMMEDIATELY CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH
EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF
THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE DAY OF
DECEMBER, 1968.
