HomeMy WebLinkAbout09170 ORD - 12/23/19680. 1 . 0 AN ORDINANCE AMENDING ORDINANCE NO. 8896, BY CORRECTING SECTION 1 THEREOF TO CORRECT THE DESCRIPTION OF THAT PORTION OF HORNE ROAD, LOCATED BETWEEN NAVIGATION BOULEVARD AND OLD BROWNSVILLE ROAD, TO BE ABANDONED AS A PUBLIC STREET; AND DECLARING AN EMERGENCY. WHEREAS, IT WAS INTENDED BY ORDINANCE No. 8896 TO CLOSE THAT PORTION OF HORNE ROAD LOCATED BETWEEN NAVIGATION BOULEVARD AND OLD BROWNSVILLE ROAD WHICH OCCUPIED A PORTION OF LOT 4, SECTION V, RANGE 91 GUGENHEIM COHN FARM LOTS, BUT THE DESCRIPTION WAS INADVERTENTLY SHOWN AS BEING LOCATED IN LOT 6, SECTION V, RANGE 9, GUGENHEIM COHN FARM LOTS, AND IT IS DESIRED TO CORRECT SAID ERROR: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 1 OF ORDINANCE No. 8896 BE, AND THE SAME IS HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: "SECTION 1. THAT A PORTION OF HORNE ROAD, BEING A 1.2+3 ACRE 4 TRACT OF LAND OUT OF LOT , SECTION V, RANGE 9, GUGENHEIM COHN FARM LOTS, LOCATED BETWEEN NAVIGATION BOULEVARD AND OLD BROWNSVILLE ROAD, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, IS HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY; RETAINING THE UTILITY EASEMENT FOR PIPELINES IN EXISTENCE AT THE PRESENT TIME, SAID EASEMENT EXTENDING FIVE (5) FEET ON EACH SIDE OF THE CENTERLINE OF SAID EXISTING PIPELINE." SECTION 2. THE NECESSITY TO AMEND THE DESCRIPTION TO CORRECTLY REFLECT THE INTENT OF THE CITY COUNCIL IN CLOSING A PORTION OF HORNE ROAD, DESCRIBED HEREINABOVE, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND 91-70 • TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI] TEXAS CORPUS CHRISTI TEXAS DAY OFjj1y�L.C''- C�x�L�fi� '19�CA FOR THE REASONS SET FORTH IN THE E1ERGENCY CLAUSE OF THE FOREGOING ORDINANCES A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS I, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
