HomeMy WebLinkAbout09208 ORD - 01/22/1969• AN ORDINANCE • AMENDING SECTION 9 AND SECTION 10 OF ORDINANCE NO. 8127, GENERALLY REFERRED TO AS THE CLASSIFICATION AND COMPEN- SATION PLAN FOR THE CITY OF CORPUS CHRISTI, TEXAS, . SO AS TO PROVIDE PROVISIONS FOR HOLIDAY LEAVE, VACATION LEAVE, AND SICK LEAVE FOR FIREMEN AND POLICEMEN; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMERGENCY.- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 9, Subsection (a) of said Ordinance No. 8127, be, anu the same is hereby amended to hereafter read as follows: "(a) The following days, or parts of days, are hereby declared holidays for all City officers and employees: The first day of January (New Year's Day) The thirtieth day of May (Memorial Day) The fourth day of July (Independence Day) The first Monday of September (Labor Day) The fourth Thursday of November (Thanksgiving Day) The twenty -fifth day of December (Christmas Day): provided, however, that whenever Christmas Day falls on a Saturday, that December 24th shall be a holiday instead of December 25." SECTION 2. That Section 9, Subsection (e) of said Ordinance No. 8127, be, and the same is hereby amended to hereafter read as follows: "(e) Firemen and Policemen shall be credited with one day holiday leave with pay for each designated holiday worked. If a declared holiday falls upon the employee's normal day off, an extra day shall be added to his holiday leave. Unused holiday leave shall be paid on termination." SECTION 3. That Section 9, of said Ordinance No. 8127, be, and the same is hereby amended by adding the following Subsection (f): "(f) When a holiday for all regular City officers and employees falls upon the normal day off of any employee in the labor and trades group required to work on a rotating shift, the employee shall be granted equal time off at a time desig- nated by the head of the division or department." SECTION 4. That Section 10, subsection (a) of said Ordinance No. 8127, be, and the same is hereby amended to hereafter read as follows: "(a) Vacation Leave. Every officer or employee in the City service except part - time, temporary employees, and all positions below grade 7, and Police an:l Fire- 920F) • . • fighting personnel shall accrue and be allowed vacation leave with pay on the number of regular hours worked per week according to the following schedule: 40 hours per week 12 working days vacation per year 44 hours per week 13 working days vacation per year 48 hours per week 14 working days vacation per year All employees except Police and Firefighting personnel who are regularly required to work more or less hours per week than set forth in the above sche- dule shall accrue and be allowed vacation leave in the same ratio as 12 working days bears to 40 hours. A working day of vacation is defined as 8 working hours. All employees who have completed 15 years of continuous service with the City shall begin to accrue and be allowed an annual total of 17 working days of va- cation leave with pay. Vacation leave credit may be accumulated to a maximum of 25 working days by all employees at any one time and such leave may be granted in periods of not less than one day and not more than 25 days; however, employees who regularly work 2 day on a sixth working day of a week may take vacation in the amount of i day pro- viding it is taken concurrently with other days of authorized vacation leave. Accrued vacation leave shall be reviewed annually on an employee's anniversary date of employment and any vacation leave credit in excess of 25 working days to which an employee may have otherwise been entitled shall be permanently withdrawn on that date. Exceptions to this rule may be permitted for the convenience of the City upon written approval of the City Manager. Absence on account of sickness, injury, or disability in excess of that hereinafter authorized for such purposes may, at the request of the employee and within the discretion of the department head, be charged against vacation leave allowance No vacation credit shall be granted or paid at termination unless the employee has been employed for a period of time in excess of six months. An employee, or his beneficiary in the event of death, shall be paid for accrued vacation leave credit upon separation from the City service at the rate of his last monthly salary or hourly rate for an equivalent period. No more than 25 working days of vacation shall be paid an employee upon termination. Page 2 - Official City holidays occurring during an employee's vacation shall not be considered or charged as a part of the employee's vacation. Each department shall keep necessary records of vacation leave allowance and shall schedule vacation leaves with particular regard to seniority of the employees, in accord with the operating requirements, and insofar as possible, with the re- quests of employees. SECTION 5. That Section 10, Subsection (b) of said Ordinance No. 8127, be, and the same is hereby amended to hereafter read as follows: "(b) Sick Leave. Every employee in the City service, except part -time and temporary employees may be granted one working day sick leave allowance for each completed month of service upon recommendation of the division and department head. Police and Firefighting personnel shall be granted an additional 4 day each month in compliance with state law. Such sick leave allowance may be used only by an employee when incapacitated to perform his duties due to sickness or non- service- connected injury, when quarantined, or in the event of a serious illness or death in the employee's immediate family. All foreseeable leaves for such purposes shall require specific prior approval of the department head. In the event of sick leave for any purpose, the department head may require a certificate of a medical doctor or other competent professional individual giving information as to the circumstances involved. The immediate family for these purposes shall be regarded to include the parents, spouse, children, brothers, and sisters in any case, and also shall include grandparents, grandchildren, and immediate in -laws when living in the household of the employee. Payment of accrued sick leave, not to exceed ninety (90) working days, on termination due to retirement in accordance with the City retirement plan, or death, shall be provided all employees or their beneficiaries in the City service. Payment of such accrued sick leave shall be at the rate of the employee's last monthly salary, or hourly rate, for an equivalent period. SECTION 6. That Section 10 of said Ordinance No. 8127, be, and the same is hereby amended by adding the following subsection (g): "(g) VACATIONS FOR FIREMEN AND POLICEMEN. Firemen and Policemen shall be entitled to 15 working days vacation a year which shall accrue at the rate of 14 days per month. After 15 continuous years of service, Firemen and Policemen shall begin to accrue 17 working days vacation a year which shall accrue at the rate of 1 -5/12 days per month. Page 3 A member of the Fire Division shall be permitted to take, during any calendar year, only those number of days vacation which he had accrued on December 31 of the preceding calendar year. Only the number of days accrued as of December 31 of any calendar year will be taken into consideration in determining whether or not a member of the Fire Division has exceeded the maximum number of accrued vacation days allowed by the compensation ordinance. For those members of the Fire Division who are scheduled to work an average SCHEDULED of 56 hours a week on an annual basis, 12 /working hours, shall be counted as one working day for vacation purposes; for those members of the Fire and Police Divisions scheduled to work 40 hours a week, eight working hours shall be counted as one working day for vacation purposes. Except as provided in the paragraphs of this subsection, all regulations and conditions relating to vacations for City employees generally shall apply to members of the Fire and Police Divisions. SECTION 7. Except as herein amended, Ordinance No. 8127, as amended, shall remain in full farce and effect. SECTION 8. If for any reason any section, paragraph, subdivision, clause, phrase or provision of this ordinance shall be held invalid, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which these rules and regulations relate. SECTION 9. The effective date of the above changes shall be January 1, 1969. SECTION 10. The necessity to make the hereinabove set forth amendment at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or reso- lution shall be passed finally on the date of its introduction and that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and Page 4 • • CORPUS CHRISTI XAS DAY OF TO THE MEMBERS OF THE CITY COUNCIL CORPUS CKRISTij TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
