1/29/69:E • I , AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE WITH SARATOGA LAND COMPANY, INC., A CONTRACT PROVIDING THAT THE CITY OF CORPUS CHRISTI WILL BE RESPONSIBLE FOR STREET LIGHT BILLINGS TO THE EXTENT OF $486.00 ON SIX (6) 2,500 LUMEN RESIDENTIAL STREET LIGHTS TO BE INSTALLED ON ORNAMENTAL POLES IN COUNTRY CLUB ESTATES, UNIT 6, UPON PAYMENT TO THE CITY OF $486.00 BY SARATOGA LAND COMPANY, INC., A COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, SARATOGA LAND COMPANY, INC., IS THE DEVELOPER OF COUNTRY CLUB ESTATES, UNIT 6, A SUBDIVISION WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, AND DESIRES THAT THE SAID SUBDI- VISION HAVE SIX (6) 2,500 LUMEN RESIDENTIAL STREET LIGHTS ON ORNAMENTAL STANDARDS, INSTALLED, MAINTAINED AND SUPPLIED WITH ELECTRICITY BY CENTRAL POWER AND LIGHT COMPANY FOR THE BENEFIT OF THE RESIDENTS OF THE SAID SUBDIVISION; AND WHEREAS, THE DEVELOPER IS WILLING AND DESIROUS TO PAY TO THE CITY OF CORPUS CHRISTI THE SUM OF THREE YEARS NORMAL CHARGES FOR THE AFOREMENTIONED STREET LIGHTS, AMOUNTING TO $486.00, IF THE CITY OF CORPUS CHRISTI WILL REQUEST THAT THE FIFTEEN RESIDENTIAL STREET LIGHTS ON ORNA- MENTAL STANDARDS BE INSTALLED, AND THE SAID CITY OF CORPUS CHRISTI WILL MAKE PAYMENT OF STREET LIGHT BILLINGS ON THE SAID LIGHTS UP TO THE SAID SUM OF $4&.00; AND WHEREAS, IT IS BENEFICIAL TO THE RESIDENTS OF THE SAID SUBDIVI- SION OF COUNTRY CLUB ESTATES, UNIT 6, AND IN THE PUBLIC INTEREST TO DO SO: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE WITH THE SARATOGA LAND COMPANY, INC., A CONTRACT PROVIDING THAT SARATOGA LAND COMPANY, INC., WILL PAY TO THE CITY OF CORPUS CHRISTI THE SUM OF $486.00, UPON RECEIPT OF WHICH THE CITY OF CORPUS CHRISTI WILL ASSUME RESPONSIBILITY FOR PAYMENT OF STREET LIGHT BILLINGS TO CENTRAL POWER AND LIGHT COMPANY ON SIX (6) 2,500 LUMEN RESIDENTIAL STREET LIGHTS ON ORNAMENTAL STANDARDS, TO BE INSTALLED IN THE SUBDIVISION OF COUNTRY CLUB ESTATES, UNIT 6, UP TO THE SUM OF $486.00. 921P, 0 1 1 1 1 SECTION 2. THE NECESSITY FOR ADEQUATE STREET LIGHTING FOR THE RESIDENTS OF THE SUBDIVISION OF COUNTRY CLUB ESTATES, UNIT 6, AND THE CITIZENS OF CORPUS CHRISTI USING THE STREETS IN THAT SUBDIVISION TO HAVE ADEQUATE LIGHTING CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29TH DAY OF JANUARY, 1969. Inc., hereinafter referred to as "Developer ", that Developer agrees to pay City, within a reasonable time, the sun or Foss Hundred iighty�;i.x Dollars ($0.86.O0), :nor and in consideration that City, upon re- ceipt of the payment by Developer to City of the sun of $406.O0, will, and City agrees to, For and in consideration of the said payment, send a letter of authorization to Central rower and Light Company of Corpus Christi, Texas, saying that City agrees with Central Power and Light Company to be responsible for street light billings at the normal rate of Two and 25/100 Dollare ($2.25) par month per unit for company owned and maintained street lights, on six (6) 2,500 lumen residential street lights on ornamental standards, up to the sum of $486.00, commencing from the time Central Posner and Light Company installs the afore- said lights at or near the following locations in a subdivision known as Country Club Cstates, Unit 6, to-wit- Six (G) 2,500 lumen residQatial street lights on ornamental standards: (1) Southeast corner at intersection of Greenbriar Drive and River Oaks Drive; (2) Greenbriar Drive at Lot 5, Chock 12; (3) Greenbriar Drive at Lot 11, Block 11; (4) River Oaks Drive at Lot 35, Block 13; (5) River Oaks Drive at Lot 30, Block 13; (6) St. Andrew Drive at Lot 12, Block 13. All of the locations are within the corporate limits of the City of Corpus Christi, Texas. I 0 1 - 2 - If, within thirty -sirs (36) Months from date hereof, fifty per cent (50A) of the total residential lots is such Country Club Estates Unit 6 have been improved by the con - struction of houses thereon and such houses are occupied as private dwellings, sheer City shall refund to Developer a cash sun equal to the amount obtained by multiplying $13.50 by the nusmb©r of months remaining under the terms of this contract (that is, 36 minus the number of months which have expired since the date of execution of this contract). It is further understood and- agreed that said street lights are to be owned by Central Power and bight Company end, except for the said agreement for payment of street light billings up to the sum of $486.00, continued responsibility by City will be subject to the same discretion of the City Council Of the City of Corpus Christi, Texas, as is the remainder of existing City light system.
